Melendy, Owners & Applicants PROPERTY LOCATION: 152 Gulfstream Drive, Tequesta, FL 33469 LEGAL DESCRIPTION: 25-40-42, PT OF GOV LT 2 BOUNDED ON N& W BY COUNTRY CLUB POINT & ON S BY A LINE PARA TO & 3753 FT N OF S LINE OF GOV LT 2/LESS PARCELS IN OR1496P341 & OR1553P397/ PARCEL CONTROL NUMBER: 60-42-40-25-00-002-0021 REQUEST: for a vt�riance from sections 26-20(a) and 26-20(g), �Ilage Code of Ordinances ORDER GRANTING DOCK VARIANCE This cause was heard upon the application for a variance and the Tequesta Planning and Zoning Board considered the evidence presented by the Applicant and other interested persons at a hearing called and properly noticed. The Planning and Zoning Board being otherwise duly advised, THEREUPON, THE TEQUESTA PLANNING AND ZONING BOARD FINDS AS FOLLOWS: 1. The Applicant has applied for a variance from sections 76-20(a)(1) and 76-20(g), Village Code of Ordinances. 2. The subject property is located in the R-1 district in the Village of Tequesta. 3. Pursuant to section 78-61, Village Code of Ordinances, this board has the authority to consider and issue variances relating to single-family properties and structures located within the R-lA and R-1 single family dwelling districts of the Village of Tequesta. 4. The Applicant submitted all documents required by the Village's Code of Ordinances for Planning and Zoxung Board review and final action. 5. The application, all supporting documents, and presentation materials were reviewed by the Planning and Zoning Board at a meeting on Apri121, 2016, and as kept on file by the Village, aze made a part of this order and are hereby incorporated by reference. 6. Under the Village Code of Ordinances, the Planning and Zoning Board has the right, Page 1 of 2 power and authority to act upon the flpplicant's cequest. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDUED BY 7'HE PLANNING AND ZONING BOARD OF THE VILLAGE OF TEQUESTA, FLORIDA. AS FOLLOWS: The application in case number VAR 02-16 for a variance from: 1. Section 76-20(A)(1), Village Code of Ordinances, to allow the installation of a dock that is 122 feet in waterward length, where the code limits the dock to 75 feet in length; and 2. Section 76-20(g), Village Code of Ordinances, to allow dock area of 610 square feet, whe►•e the code limits the dock area to 500 square feet at the above-referenced property in the Village of Tequesta, Palm Beach County, Florida, attached to this order as Exhibit A is hereby GRANTED. The Vill�ge Planni�lg and Zoning Board finds that the Applicant has provided competent, substantial evidence that satisfy the statutory criteria at sections 76-7(b) and 78-4, Village Code of Ordinances, to be granted a variance from sections 76-20(A)(1) and 76-20(g). Please note: � The Applicant's representative, Jeff Anton, appeared at the hearing and was placed under oath. Mr. Anton stated a current (2016) UEP permit �vould be filrnished to the Village Builcl- ing Department before seeking a building pe►•mit for construction of the dock in accordance I I I with the dimensions as stated in this order. Additionally, Mr. Anton stated the dock would be constructed in accordance Florida law.
