(1) removing dead or diseased parts of plants, (2) pruning ;such parts thofbdf to prouide clear - vi sibili ty to signage, permitted outdoor advertising signs (per Florida Statute 479.106), and for those using the roadway and /or sidewalk, (3) preventingr any other potential roadway hazards. Plant materials shall be those items which would be scientifically classified as plants including trees, palms, shrubs, groundcover and turf. To maintain also means to remove or replace dead or diseased plants in their entirety, or to remove or replace. those that fall below original project standards. Palms shall be kept fruit free year round. To maintain means to keep the header 'curbs #fiat contain the specialty surfacing treatment in optimum condition. To maintain also. means to keep the hardscape areas clean, free from weeds and to repair said hardscape as is necessary to prevent a safety hazard. To maintain also means to keep litter removed from the median and areas outsidee the'travel way to the right of way line. All .plants removed for whatever reason shall be replaced by plants of the same species type,. size, and grade as specified in the original plans and. specifications. Any changes. to the original plans shall be submitted by permit application to the DEPARTMENT for review and approval. C. If it becomes necessary to provide utilities (waterlelectricity) to the medians or areas outside the travelway to maintain these improvements, all costs associated with the utilities for the landscape improvements including, but not limited to any impact and connection fees, and the on -going cost of utility usage for water and electrical are the maintaining .AGENCY responsibility. (1) The AGENCY shall be solely responsible for any impact and/or connection fees AND {2) The AGENCY shall be responsible for the described ongoing utility costs upon final acceptance of the construction project by the DEPARTMENT and thereafter. The Project is accepted prior to the start of the FDOT Specification 580 Contractor's Plant Establishment Period. AND (3) The AGENCY shall be responsible for these improvements immediately after final acceptance of the construction project by the DEPARTMENT except for the plant materials which will be included in the FDOT Specificat 580 Co�iractor's Plant 'Establishment Period. The AGENCY shall be responsible for the maintenance of all landscape improvements after the completion of the FDOT Specification 580 Contractor's Plant Establishment Period. D. The maintenance functions to be performed by the AGENCY may be subject to periodic inspections by the DE PARTMENT at the discretion of the DEPARTME Such inspection findings will be shared with the AGENCY and shall be the basis of all decisions regarding, repayment, reworking or Agreement termination. The AGENCY .shall not change or deviate from said plans without written approval of the DEPARTMENT. NOTICE OF MAINTENANCE DEFICIENCIES A. If at any time after the AGENCY has undertaken the maintenance responsibilities for the landscape improvements, it shall come to the attention of the DEPARTMENT'S District Secretary that the limits, or a part thereof, are not ro , erl maintained p p y al ed pursuant to the terms of this Agreement, said District Secretary may at his /her option, issue a written .notice that a deficiency or deficiencies exist(s), by sending a certified letter to the AGENCY, placing said AGENCY on notice thereof. Thereafter the AGENCY shall have a period of thirty .(3Q) calendar days within which to correct the cited deficiencies. If said deficiencies are not corrected within this time period, the DEPARTMENT may at its option, proceed as follows: (1) Maintain the landscape improvements or any part thereof, with DEPARTMENT or Contractor's personnel and invoice the AGENCY for expenses, incurred, and / or (2) At the discretion of the DEPARTMENT, terminate the Agreement in accordance with Paragraph 9 of this Agreement and remove, by the DEPARTMENT or Contractors personnel, all of .the "landscape improvements installed under this Agreement or any preceding Agreements, exce t as to trees an g 9 p d palms, and charge the AGENCY the reasonable cost. of such removal; B. The AGENCY agrees to reimburse the DEPARTMENT all monies expended by the DEPARTMENT for the landscape improvements listed in Exhibit 'B" in the amounts lis#ecl in Exhibit "C" should the landscape improvement fall to be maintained in accordance with the terms and conditions of this Agreement. 5. FUTURE DEPARTMENT IMPROVEMENTS It is understood between the parties hereto that the landscape improvements covered by this Agreement_ may be removed, relocated or adjusted at any time in the future as determined to be. necessary by the DEPARTMENT in order that the adjacent state road be widened, altered or otherwise changed to meet future criteria or planning needs of the DEPARTMENT. The AGENCY shall be given sixty (60) calendar days notice to remove said landscape improvements at AGENCCY'S. expense after which time the DEPARTMENT may remove same. Ail permits (including tree permits), fees and. any mitigation associated With the removal, relocation or adjustments of these improvements are the maintaining {AGENCY'S responsibility. 6. FUTURE AGENCY IMPROVEMENTS The AGENCY may construct .additional landscape improvements within the limits of the improvements rights of ways identified herein, subject to the following conditions: (a) Plans for any new landscape improvements shall be subject to approval by the DEPARTMENT. (c) All landscape improvements shall be developed and implemented in accordance with appropriate state and roadway design �n standards. (d) The AGENCY agrees to comply with the 'requirements of this Agreement with regard to any additional Ian 'dscape improvements it choses to have installed and there will be no cost to the DEPARTMENT. 7. ADJACENT PROPERTY OWNED IMPROVEMENT$ The DEPARTMENT may allow an adjacent ; property owner to construct additional landscape improvements within the of the rights of way identified in Exhibit "A" of this Agreement and the AGENCY shall be responsible for maintaining those improvements under this Agreement subject to the following conditions (a) Plans for any new landscape improvements shall .be subject to approval by the DEPARTMENT and shall require a valid permit attached with a letter of consent to said plans by the. AGENCY. The plans shall not be changed or deviated from without written approval by the C3PARTMENT and the AGENCY. (b) All landscape improvements shall be developed and implemented in accordance with appropriate state safety-and roadway design standards. (c) The AGENCY agrees to comply with the requirements of this Agreement with regard to any additional Landscape improverrients installed by an adjacent owner. 8. LANDSCAPE IMPROVEMENTS COST The DEPARTMENT agrees to enter into a contract for the installation of the. landscape improvements with an estimated amount. of 81157.96 as referenced in Exhibit "C ". This amount may be reduced or eliminated at the sale:.discretion of the DEPARTMENT or due to budgetary constraints of the. DEPARTMENT, The DEPARTMENT'S participation in the landscape improvements' cast, as described in Exhibit "'+G" is limited to only 'those items which are directly related to the Landscape improvement plans -. (1) The AGENCY shall be invited to assist the DEPARTM in the. final acceptance of the landscape improvements. by the DEPARTMENT associated with the roadway.co'nstruction project 9. AGREEMENT TERMINATION In addition to those conditions otherwise contained herein, this Agreement may be terminated under any one (1) of the following: conditions' (a) By the DEPARTMENT, if the AGENCY fails to perform its duties tender this Agreement, following ten (10) days written notice. A. The tern of this Agreement commences upon execution by all parties. The term of this Agreement shall remain in effect faf1wenty -five (25) years. B. If the DEPARTMENT chooses not to implement the landscape improvements desp.Oed in Exhibit "B"', this Agreement becomes void and the original Agreement is reinstated if any. 11. LIABILITY AND INSURANCE REQUIREMENTS A. With respect to any of the AGENCY'S agents,. consultants, sub- consultants contractors,. and /or Sub- contractors, such party in 'any contract for the landscape improvements shall agree to indemnify, defend, save :and hold harmless: the DEPARTMENT from all claims, demands liabilities and suits of any nature_ arising out of, becaiuse. of or due tG any intentianall and /,or `negligent act or occurrence, Qmission or commission of such agents, consultants,, suibcorisultants, .contractors and/or subcontractors. The AGENCY shall provide to the DEPARTMENT written evidence of the: foregoing upon the: request of the DEPARTMENT- It is specifically understood and ;agreed that'this indemnification clause does. not cover or indemnify the DEPARTMENT for its oven negligence, B. E- VERIFY REQUIREMENTS The AGENCY shall: (a) Utilize the U.S. Department of Homeland Security's E-Verify, system to verify the employment eligibility of all new employees hired by the AGENCY during the term of the contract; .and (b) Expressly require any subcontractors performing work or providing services Pursuant to the state contract to likewise utilize the U.S. Department of Homeland Security's E Verify system to verify the employment eligibility of all new employees hired by the subcontractor during� the contract term. 13. SUPERSEDED AGREEMENTS This writing, en^ibodies the entire Agreement and :understanding between the parties hereto and there are no other Agreements and understanding, oral or written, with reference to the subject matter hereof that are not merged herein and superseded hereby. 14. FISCAL TERMS The DEPARTMENT, during any fiscal year, shall not expend money, incur any liability, or enter into any contract which, by its terms, involves the expenditure of money in excess of the amounts budgeted as available for expenditure during such fiscal year Any contract, verbsl or written, made in violation of this:subsection is null and void, and no money maybe paid on such contract. Ther DEPARTMENT shall require a -sta#ement from the Comptroller of the DEPARTMENT that funds are 'available prior to entering into any such contract or other binding commitment of funds. Nothing herein contained shall prevent. the 'making of contracts for period's exceeding one (1) . y e a r , but any. contract so made shall "be executory only for the value of the services to be rendered ar agreed '. to be paid for in succeedin, fiscal years; and this paragraph shall be incorporated verbatim in all - contracts of the DEPARTMENT which are for an amount in excess of TWENTY FIVE THOUSAND DOLLARS ($25,000.00) and which- have a'tenn for a period of more than one year. 15. ASSIGNMENT This Agreement may not be assigned or transferred by the AGENCY in whole or part without the consent of the DEPARTMENT. 17. LAWS GOVERNING This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. In the event of a conflict between 'any portioh of the contract and Florida law, the laws of Florida shall prevail. The AGENCY agrees to waive forum and venue and that the DEPARTMENT shall determine the forum and venue in which any dispute under this agreement is deckled. 18. NOTICES Any and 911 notices given or required under this Agreement shall be in writing and either personally delivered with receipt acknowledgement or sent by certified retail, return receipt requested.. Department of Transportation and the AGENCY. (1) Prior to acceptance by the DEPARTMENT, all lanes for each of the stamped asphalt crossings projects shall be tested for friction in accordance with ASTM E 27406. All costs for friction testing will be the responsibility of the AGENCY. The initial friction resistance shall be at least 35 obtained at 40 mph with a ribbed test tire (FN40R) or equivalent. Failure to achieve this minimum resistance shall require all deficient crmwaik areas to be removed to their full extent (lane-by- lane) and replaced with the same product installed initially. If more than 50 °/Q of the lanes in the intersection require replacement, the entire intersection installation may be reconstructed with a different product on the Qualified Products List (QPL). SCOPE This. method covers the testing procedures for evaluating the friction resistance of Patterned surfaces used in crosswalks over asphalt. and concrete surfaces Rtete: This test method contains two parts: Part A Friction testing performed with the Locked Wheel friction Tester Part B- Friction testing performed with the Dynamic Friction Tester (DFT) 2. APPARATUS 2.1 Locked Wheel Friction Tester This apparatus shall be standardized in accordance with ASTM E 274, "Standard Test Method for Skid Resistance of Paved Surfaces Using a Full -Scale Tire". The friction test fire used shall be in accordance with ASTM E 501, "Standard Sfaecification for Standard Rib Tire for Pavement Skid - Resistance ". 2.2 Dynamic Friction Tester- This apparatus shall be standardized in accordance with ASTM E 1911, "Standard Test Method for Measuring Paved Surface Frictional Properties Using the Dynamic Friction Tester". 3. FRICTION NUMBER CONVERSION The regression equations relating the locked wheat test results and the DFT results:at 40 mph (65 km1h) are: FN40R = 0.64 - DFT40 +9.23 1) DFT40 =1.56 • FN40R- 1.4.42 (2) where, FN40R = Friction Number from locked wheel testing at 40 mph using a ribbed fire DFT40 = Coefficient of Friction from DFTT at 40 mph multiplied by 100. Although the above equations can be used to convert the DFT result to the locked wheel faction number at 40 mph and vice versa, conditions do exist where the DFT testing or the locked wheel testing at 40 mph is not feasible due to constraints such as safety, traffic congestion, speed limits, andfor roadway geometries.
