Village of Tequesfa, a rr�unieipal cnrp�ration, existinc� under ihe L�ws of�iorida, hereinafEer
ca!!ed the AGENCY.
WITN � SSETH:
WHEREAS, the DEPARTMENT has jurisdictian over St�te Road � �US 1} as part �pf th�e
Stafe Highway System as d�scrib�d �r� Exhibid"A": and
WHEREAS, the DEPARTM�I�T seeks to install and have rnaintai�ed by the AGENGY
certain landscape improvemen#s within the right of way af Sfate Road � (US 1) as describecE
within �xhibit "B"; and
WHER�AS, as part c�f the ct�ntinual �pd�ting of the State of �lorida Highway System,
#he D�PARTMENT, for the purpose of safety, prat�ction of the investment �nd other
reasons, has co�structed and daes maintain the h�ghw�}�faciEity as described in Exh�bit"A"
(at#ac#�et� hereta and incorporated by reference herein)� within the corporate lim€t� af the
AGENGY; and
WHEREAS, the AGENCY is agreeable to mainta�ning those �andscape Irnpravements
within the AGENCY'S limits incfuding plant materials, irrigation system a�dfor hardscape to
the meciians and areas oc�side the travelway to the right of way line andlor ar��S within the
tra�elway #hat may contain specia#ty surfacing (concrefe pave�s, color stamped concrete
and calar stamp�d asphalt [also known �s patterned pavernentj) includin� any other
t�ardscape (if applicable), but excluding standard can�rste sid�walk; and agrees suc#�
irr�provemen#s shall b� rnaintained by penodic rr�owing, fertiiizing, weeding, litter pick-up,
prurting, r�ecessary repfantirrg, irrigation r�pair andfor repair of th� median concrete
repfacemen#s associated with the specialty surfacin� (if applicaY�le) as �eeded; and

N�1W ZFfEREF4RE, far and in consideration af the mutual benefits to flovar each to the
other, #he parties ctavenant�nd �grse as foflows:
1. The recitals set fa�th at�ov� are true and correct and are deemed ir�corpo�ated herein,
2. lNSTALLATION t�F FACILITIES
I The DEF�ARTMEt�T shall inst�fl ar ca�ased to be installed fandseape impravements
described as: pfant materials, imgatian andfar hardscape or� the highway facilities
substan#ially as specffied in p8ans and specifications hereinaf�er referred to as the Project(s)
and incc�rporated hereir� as refer�nc�c! in Exhibit "�" and "D". Hardscape shafl mean, but
not be lirnited to, site furnishings, landscape accent lighting, �ike racks, fauntain, tree grat�s,
d�corative free standing or retaining wall(s) andfor arty non-standard roadway, sid�+n+aik,
medi�n ar crosswa{k surfacing, such as, but not be limited to th� fo(lowin�: speeialty
surfacing (concrete p�vers, coior stampecl concrete and colar stamped asphait [�lsc� Ecnawn
as patterned pav�ment]�. If ther� are any rtiajor changes #o the pfan(s}, the pEPARTMENT
shali pro�ide the modified p�an(s} to the qG�NCy and the AGENCY shafa provid� their
approval or disappravai #o the DEpARTMENT within 1� busine$s days, The DEPARTMENT
may �lect to withdraw the lands�ape improvements if changes ar� not appraued within the
gi�en time frarrte.
3, MAINTENANCE OF FACfLtT�ES
A. Ths AGENCY a�ress to maintain the landscaRe improvem�nts, as exi�ting and
those to be ir�st�fled, witk�in the physica� limits descri6ed in �xhibit '"A" ar�d as
further desc�ibed in Ext�ibi#"B", The n�n-standard irr�prQvements withEn and outside
the travelway shal! be mainta�ned by the A�ENCY regardless ff the said
improvemerot was macfe by the DEPARTMENT, the AGENCY, or Qthers authorized
pursu�n# �o sectian 7, by period"rc mowing, pruning, �ertilizing, weeding, curb and
sidewalk �dging, iit�er pi�kup, necessary replanting, irrigation system re�air and/ ar
�epair af any rn�d�an concrete replacement associated v�uith specialty surfacing (if

guideGnes, �xhibit "�", Patterr�ed Ravement Mai�tenance_ The AGENGY'S
respar�sibifity for rnainten�nce sh�lE include all landscaped, tia�ed and hardscape
areas ar� the sidewalk ar witt�i� the medians and areas o�tside the traveEway to the
righf-of-way andPor ar�as �►vithin the travelway canta�ning spec€alty surfacing. ft shalf
be the responsibility o�th�AGEIVCY to restar� an unacceptable ride canditiQn of the
raadway caused by th� differentiai characteristics vf non-standard �ravelway
surFac�ng ar�d the �ssociated header curb and concrete areas {�f �pplicable) on
DEPARTNIEI�T right-of-way within the limits of#his Agreem�nt.
B. Such maintenance #a t�� prouided by the AGENGY is specificaily set out as follt�ws:

properly prune all plants which at a minimum includes. (1) removing dead or
diseased parts of plants, (2) pruning ;such parts thofbdf to prouide clear - vi sibili ty to
signage, permitted outdoor advertising signs (per Florida Statute 479.106), and for
those using the roadway and /or sidewalk, (3) preventingr any other potential roadway
hazards. Plant materials shall be those items which would be scientifically classified
as plants including trees, palms, shrubs, groundcover and turf. To maintain also
means to remove or replace dead or diseased plants in their entirety, or to remove or
replace. those that fall below original project standards. Palms shall be kept fruit free
year round. To maintain means to keep the header 'curbs #fiat contain the specialty
surfacing treatment in optimum condition. To maintain also. means to keep the
hardscape areas clean, free from weeds and to repair said hardscape as is
necessary to prevent a safety hazard. To maintain also means to keep litter removed
from the median and areas outsidee the'travel way to the right of way line. All .plants
removed for whatever reason shall be replaced by plants of the same species type,.
size, and grade as specified in the original plans and. specifications. Any changes. to
the original plans shall be submitted by permit application to the DEPARTMENT for
review and approval.
C. If it becomes necessary to provide utilities (waterlelectricity) to the medians or areas
outside the travelway to maintain these improvements, all costs associated with the
utilities for the landscape improvements including, but not limited to any impact and
connection fees, and the on -going cost of utility usage for water and electrical are the
maintaining .AGENCY responsibility.
(1) The AGENCY shall be solely responsible for any impact and/or connection fees
AND
{2) The AGENCY shall be responsible for the described ongoing utility costs upon
final acceptance of the construction project by the DEPARTMENT and thereafter.
The Project is accepted prior to the start of the FDOT Specification 580
Contractor's Plant Establishment Period.
AND
(3) The AGENCY shall be responsible for these improvements immediately after
final acceptance of the construction project by the DEPARTMENT except for the
plant materials which will be included in the FDOT Specificat 580 Co�iractor's
Plant 'Establishment Period. The AGENCY shall be responsible for the
maintenance of all landscape improvements after the completion of the FDOT
Specification 580 Contractor's Plant Establishment Period.
D. The maintenance functions to be performed by the AGENCY may be subject to
periodic inspections by the DE PARTMENT at the discretion of the DEPARTME
Such inspection findings will be shared with the AGENCY and shall be the basis of
all decisions regarding, repayment, reworking or Agreement termination. The
AGENCY .shall not change or deviate from said plans without written approval of the
DEPARTMENT.

4. NOTICE OF MAINTENANCE DEFICIENCIES
A. If at any time after the AGENCY has undertaken the maintenance responsibilities for
the landscape improvements, it shall come to the attention of the DEPARTMENT'S
District Secretary that the limits, or a part thereof, are not ro , erl maintained
p p y al ed
pursuant to the terms of this Agreement, said District Secretary may at his /her
option, issue a written .notice that a deficiency or deficiencies exist(s), by sending a
certified letter to the AGENCY, placing said AGENCY on notice thereof. Thereafter
the AGENCY shall have a period of thirty .(3Q) calendar days within which to correct
the cited deficiencies. If said deficiencies are not corrected within this time period,
the DEPARTMENT may at its option, proceed as follows:
(1) Maintain the landscape improvements or any part thereof, with DEPARTMENT or
Contractor's personnel and invoice the AGENCY for expenses, incurred, and / or
(2) At the discretion of the DEPARTMENT, terminate the Agreement in accordance
with Paragraph 9 of this Agreement and remove, by the DEPARTMENT or
Contractors personnel, all of .the "landscape improvements installed under this
Agreement or any preceding Agreements, exce t as to trees an
g 9 p d palms, and
charge the AGENCY the reasonable cost. of such removal;
B. The AGENCY agrees to reimburse the DEPARTMENT all monies expended by the
DEPARTMENT for the landscape improvements listed in Exhibit 'B" in the amounts
lis#ecl in Exhibit "C" should the landscape improvement fall to be maintained in
accordance with the terms and conditions of this Agreement.
5. FUTURE DEPARTMENT IMPROVEMENTS
It is understood between the parties hereto that the landscape improvements covered by
this Agreement_ may be removed, relocated or adjusted at any time in the future as
determined to be. necessary by the DEPARTMENT in order that the adjacent state road be
widened, altered or otherwise changed to meet future criteria or planning needs of the
DEPARTMENT.
The AGENCY shall be given sixty (60) calendar days notice to remove said landscape
improvements at AGENCCY'S. expense after which time the DEPARTMENT may remove
same. Ail permits (including tree permits), fees and. any mitigation associated With the
removal, relocation or adjustments of these improvements are the maintaining {AGENCY'S
responsibility.
6. FUTURE AGENCY IMPROVEMENTS
The AGENCY may construct .additional landscape improvements within the limits of the
improvements rights of ways identified herein, subject to the following conditions:
(a) Plans for any new landscape improvements shall be subject to approval by the
DEPARTMENT. The AGENCY shall not change or deviate from said plans without
written approval by the DEPARTMENT,

(b) The AGENCY shall procure a permit from the DEPARTMENT.
(c) All landscape improvements shall be developed and implemented in accordance
with appropriate state and roadway design �n standards.
(d) The AGENCY agrees to comply with the 'requirements of this Agreement with regard
to any additional Ian 'dscape improvements it choses to have installed and there will be
no cost to the DEPARTMENT.
7. ADJACENT PROPERTY OWNED IMPROVEMENT$
The DEPARTMENT may allow an adjacent ; property owner to construct additional landscape
improvements within the of the rights of way identified in Exhibit "A" of this
Agreement and the AGENCY shall be responsible for maintaining those improvements
under this Agreement subject to the following conditions
(a) Plans for any new landscape improvements shall .be subject to approval by the
DEPARTMENT and shall require a valid permit attached with a letter of consent
to said plans by the. AGENCY. The plans shall not be changed or deviated from
without written approval by the C3PARTMENT and the AGENCY.
(b) All landscape improvements shall be developed and implemented in accordance
with appropriate state safety-and roadway design standards.
(c) The AGENCY agrees to comply with the requirements of this Agreement with
regard to any additional Landscape improverrients installed by an adjacent owner.
8. LANDSCAPE IMPROVEMENTS COST
The DEPARTMENT agrees to enter into a contract for the installation of the. landscape
improvements with an estimated amount. of 81157.96 as referenced in Exhibit "C ". This
amount may be reduced or eliminated at the sale:.discretion of the DEPARTMENT or due to
budgetary constraints of the. DEPARTMENT,
The DEPARTMENT'S participation in the landscape improvements' cast, as described in
Exhibit "'+G" is limited to only 'those items which are directly related to the Landscape
improvement plans -.
(1) The AGENCY shall be invited to assist the DEPARTM in the. final
acceptance of the landscape improvements. by the DEPARTMENT associated
with the roadway.co'nstruction project
9. AGREEMENT TERMINATION
In addition to those conditions otherwise contained herein, this Agreement may be
terminated under any one (1) of the following: conditions'
(a) By the DEPARTMENT, if the AGENCY fails to perform its duties tender this
Agreement, following ten (10) days written notice.

(b) By the DEPARTMENT; for refusal by the AGENCY to allow public access to all
documents, papers, letters, or other material subject to the provisions of Chapter
119, Florida Statutes, and made or received by the AGENCY in conjunction with
this Agreement.
10, AGREEMENT TERM.
A. The tern of this Agreement commences upon execution by all parties. The term of
this Agreement shall remain in effect faf1wenty -five (25) years.
B. If the DEPARTMENT chooses not to implement the landscape improvements
desp.Oed in Exhibit "B"', this Agreement becomes void and the original Agreement
is reinstated if any.
11. LIABILITY AND INSURANCE REQUIREMENTS
A. With respect to any of the AGENCY'S agents,. consultants, sub- consultants
contractors,. and /or Sub- contractors, such party in 'any contract for the landscape
improvements shall agree to indemnify, defend, save :and hold harmless: the
DEPARTMENT from all claims, demands liabilities and suits of any nature_ arising
out of, becaiuse. of or due tG any intentianall and /,or `negligent act or occurrence,
Qmission or commission of such agents, consultants,, suibcorisultants, .contractors
and/or subcontractors. The AGENCY shall provide to the DEPARTMENT written
evidence of the: foregoing upon the: request of the DEPARTMENT- It is specifically
understood and ;agreed that'this indemnification clause does. not cover or indemnify
the DEPARTMENT for its oven negligence,
B. In the event that AGENCY cont w'acts with a third party to provide: the serv ices set
forth herein.,. any. contract with such third party shall include. the
he following provisions:
(1) AGENCY'S contractor shall at all times during the term of this Agreement keep
and maintain m fill force arid 0e. at contractor's; ,sole cast and .expense,
Comprehensive General Liability with minimum limits of $1,000,000 OD per
occurrence combined single limit for Bodily: Injury Liability a nd Property pariiage
Liability and: Wotker's Compe nsation insurariee with minim limits cif
$500`' 000.00 per Liability- Coverage must be °afforded on a form no more
restrictive than the latest edition . of the Cttnprehensive General Liability and
V Torker's Co. mpen$atJdn policy without restddtiva endorsements as. filed by this
lnsurardce Services Office and shall name the DEPARTMENT as an additional
insured 'on such policies.
(2) AGENCY'S contractor shall furnish AGENCY with Certificates, of Insurance of
Endorsements evrdeneing the, insurance coverage specified herein prior to the
beginning performance of work under this Agreement.
(3) Coverage is not to cease and is to remain in full .force and effect (subject to
cancellation notice) until all performance required of AGENC.Y!'.S contractor is

least thirty (30) days notice of cancellation and or /or restriction. If any of the
insurance coverage`wiVexp ire prior`fo - ft completion of W&R, "copies - of r=enewal
policies shall be furnished at least (30) days prior to the date of expiration_
12. E- VERIFY REQUIREMENTS
The AGENCY shall:
(a) Utilize the U.S. Department of Homeland Security's E-Verify, system to verify the
employment eligibility of all new employees hired by the AGENCY during the term
of the contract; .and
(b) Expressly require any subcontractors performing work or providing services
Pursuant to the state contract to likewise utilize the U.S. Department of Homeland
Security's E Verify system to verify the employment eligibility of all new employees
hired by the subcontractor during� the contract term.
13. SUPERSEDED AGREEMENTS
This writing, en^ibodies the entire Agreement and :understanding between the parties hereto
and there are no other Agreements and understanding, oral or written, with reference to the
subject matter hereof that are not merged herein and superseded hereby.
14. FISCAL TERMS
The DEPARTMENT, during any fiscal year, shall not expend money, incur any liability, or
enter into any contract which, by its terms, involves the expenditure of money in excess of
the amounts budgeted as available for expenditure during such fiscal year Any contract,
verbsl or written, made in violation of this:subsection is null and void, and no money maybe
paid on such contract. Ther DEPARTMENT shall require a -sta#ement from the Comptroller of
the DEPARTMENT that funds are 'available prior to entering into any such contract or other
binding commitment of funds. Nothing herein contained shall prevent. the 'making of
contracts for period's exceeding one (1) . y e a r , but any. contract so made shall "be executory
only for the value of the services to be rendered ar agreed '. to be paid for in succeedin, fiscal
years; and this paragraph shall be incorporated verbatim in all - contracts of the
DEPARTMENT which are for an amount in excess of TWENTY FIVE THOUSAND
DOLLARS ($25,000.00) and which- have a'tenn for a period of more than one year.
15. DISPUTES
The DEPARTMENT'S District Secretary shall decide all questions, difficulties "and disputes
of any nature whatsoever that may arise under or by reason of this Agreement, the
prosecution or fulfrll"mont of'the .service hereunder and the character, quality, amount and
value thereof, and his decision upon all claims, questions and disputes shall be final and
conclusive upon the parties hereto.

16. ASSIGNMENT
This Agreement may not be assigned or transferred by the AGENCY in whole or part without
the consent of the DEPARTMENT.
17. LAWS GOVERNING
This Agreement shall be governed by and construed in accordance with the laws of the
State of Florida. In the event of a conflict between 'any portioh of the contract and Florida
law, the laws of Florida shall prevail. The AGENCY agrees to waive forum and venue and
that the DEPARTMENT shall determine the forum and venue in which any dispute under
this agreement is deckled.
18. NOTICES
Any and 911 notices given or required under this Agreement shall be in writing and either
personally delivered with receipt acknowledgement or sent by certified retail, return receipt
requested.. All notices shall' be sent to the fallowing addresses.

1. ROADWAY PROJECT LOCATION:

PATTERNED PAVEMENT INSTALLATION
This Exhibit forms an integral part of the DISTRICT FOUR (4) MAINTENANCE
MEMORANDUM OF AGREEMENT between the State of Florida,. Department of
Transportation and the AGENCY.
(1) Prior to acceptance by the DEPARTMENT, all lanes for each of the stamped
asphalt crossings projects shall be tested for friction in accordance with ASTM E
27406. All costs for friction testing will be the responsibility of the AGENCY. The
initial friction resistance shall be at least 35 obtained at 40 mph with a ribbed test
tire (FN40R) or equivalent. Failure to achieve this minimum resistance shall
require all deficient crmwaik areas to be removed to their full extent (lane-by-
lane) and replaced with the same product installed initially. If more than 50 °/Q of
the lanes in the intersection require replacement, the entire intersection
installation may be reconstructed with a different product on the Qualified
Products List (QPL). All lanes receiving new installations shall again be friction
tested within 60.90 days of their acceptance by the local AGENCY. The initial
friction resistance of each new installation shall be at least 35 (FN40R) or
equivalent. Failure to achieve this minimum resistance shall require all deficient
areas be removed to their full extent (lane -ley -lane) and replaced with the same
product installed initially. If more than 50% of the lames in the intersection require
replacement, the entire intersection installation may be reconstructed with a
different product on the DEPARTMENT 'S Qualified Products List (QPL), or
replaced with conventional pavement.
(2) The results of all friction tests and condition surveys shall be sent to the
Operations Engineer at-the local FD OT District Four Operations Center located
at (Palm Beach Operations, 7900 Forest Hill Blvd., West Palm Beach, FL 33413
(561) 432 -4966, with a cover letter lefther certifying that the crosswalks comply
with the above stated requirements; or what remedial action will be taken to
restore the friction and/or integrity of the crosswalk area.
(3) When remedial action is required in accordance with the above requirements, the
local AGENCY at its own expense shall complete all necessary repairs within 90
days of the date the deficiency was identified.

PATTERNED PAVEMENT MAINTENANCE
This Exhibit forms an integral part of the DISTRICT FOUR (4) MAINTENANCE
MEMORANDUM OF AGREEMENT between the State of Florida, Department of
Transportation and the AGENCY.
"Maintenance" of all patterned pavement crosswalks in these Agreements shall be defined,
as a minimum, to include its frictional .characteris
and integrity ' as follows:
(1) Within 60 days of project acceptance by the Department, all lanes of each
patterned pavement crosswalk. shall be evaluated for surface friction. The friction
test shall be conducted using either a.locked wheel tester in accordance with FM
5 -582 ('Florida Test Method for Friction Measuring Protocol for Patterned
Pavements) or Dynamic, Friction Tester in . accordance with ASTAI E1411. All
costs for friction tesfing are tire. responsibility of the AGENCY
(2) The initial friction resistance shall be at. lea st.35 obtained at 40 mph with a ribbed
tine test (FN4aR) or equivalent (FM .5-592 attached). Failure to achieve this
minimum resistance shall require all deficient crosswalk areas to be. removed to
their full extent (land -by - land) and' replaced with the 'saute product .installed
initially. The ACENGY is responsible for all costs associated with the removal
and replacement of the crosswalk._ if the Qepartment,d0termines that more. than
50 ° !0 of the lanes in the intersection require. replacement, the entire intersection
installation may be reconstructed with a different product on the Qualified
Products List (C PL) or replaced with.convent'ional pavement.
(3) Approximately one year after project acceptance and every two years thereafter
and for the life of the adjacent pavement, only the outside traffic lane areas of
each patterned crosswalk shall be tested for friction resistance . in accordance
with ASTM E274 or ASTMS 1911. Friction resistance shall, at a minimum, have
a FN40R value of 35. (or equivalent).
(4) The results of all friction tests shall be sent to the Operations Engineer at -the
local FDOT District Four Operations Center located at (Palm Beach Operations,
79030 Forest Hill Blvd., West Palm Beach, FL 33413 (561) 432 -4966, with a
cover letter either certifying, that the crosswalks comply with the minimum friction

(5) Failure to achieve the minimum resistance shall require all lanes of the crosswalk
to be friction tested to determine the extent of the deficiency. All deficient areas
shall be removed to their full extent (lane -by -lane) and replaced with the same
product installed initially. If the Department determines that more than 5O% of the
lanes in the intersection require replacement, the entire intersection installation
may be reconstructed with a different product on the QPL, or replaced with
conventional P avement.
(6) When remedial action is required in accordance with the above requirements, the
local agency shall complete all necessary repairs at its own expense within 90
days of the date when the deficiency was identified. No more than two full depth
patterned pavement repairs shall be made to an area without first resurfacing the
underlying pavement to 1" minimum depth.
(7) The Department will not be responsible for replacing the treatment following any
construction activities by the Department in the vicinity of the treatment, or any
costs for testing.

Florida Test Method
for
Friction Measuring Protocol for Patterned Pavements
Designation: FM 5 -592
1. SCOPE
This. method covers the testing procedures for evaluating the friction resistance
of Patterned surfaces used in crosswalks over asphalt. and concrete surfaces
Rtete: This test method contains two parts:
Part A Friction testing performed with the Locked Wheel friction Tester
Part B- Friction testing performed with the Dynamic Friction Tester (DFT)
2. APPARATUS
2.1 Locked Wheel Friction Tester This apparatus shall be standardized in
accordance with ASTM E 274, "Standard Test Method for Skid Resistance
of Paved Surfaces Using a Full -Scale Tire". The friction test fire used
shall be in accordance with ASTM E 501, "Standard Sfaecification for
Standard Rib Tire for Pavement Skid - Resistance ".
2.2 Dynamic Friction Tester- This apparatus shall be standardized in
accordance with ASTM E 1911, "Standard Test Method for Measuring
Paved Surface Frictional Properties Using the Dynamic Friction Tester".
3. FRICTION NUMBER CONVERSION
The regression equations relating the locked wheat test results and the DFT
results:at 40 mph (65 km1h) are:
FN40R = 0.64 - DFT40 +9.23 1)
DFT40 =1.56 • FN40R- 1.4.42 (2)
where,
FN40R = Friction Number from locked wheel testing at 40 mph using a ribbed fire
DFT40 = Coefficient of Friction from DFTT at 40 mph multiplied by 100.
Although the above equations can be used to convert the DFT result to the
locked wheel faction number at 40 mph and vice versa, conditions do exist where
the DFT testing or the locked wheel testing at 40 mph is not feasible due to
constraints such as safety, traffic congestion, speed limits, andfor roadway
geometries. In these cases, it may be preferable to conduct the lacked wheel

testing at a slower speed, e.g., 20 or 30 mph. The following regression
equations have been developed to convert the locked wheel test results at 20
and 30 mph to those at 40 mph:

For ease of application of the above harmonization results, Table 1 summarizes
the conversions from FN30R, FN20R.and DFT40 to FiN40R. Dote that the
friction numbers shown in this table were rounded to the closest integer. The
numbers highlighted in yellow represent the current minimum required friction
numbers depending on survey cycle, test method., and speed evaluated.

4. PROCEDURE
i
The test procedures for moth the Locked Wheel Friction Tester and the Dynamic
Friction Tester are described in the following. All testing should be performed
within either the driver or passenger side wheel path, regardless of the
equipment used.
4.1 PART A- Friction Testing with the Locked Wheel Friction Tester
A) bleu►► Construction — The locked wheel test shall be conducted on. all
crosswalks within 60 days of the new surface completion date. One
valid lockup test is required for each lane; all lanes shall be evaluated

and compared. The test layout is shown in Figure 1.
B) Inventory - For in- service Qualified .Product List (QPL) test sections,
the locked wheel testis conducted at 6 month intervals up to 3 fears,
Maintenance surveys are conducted on a yearly basis. Test site shall
be confined to a single atttside traffic lane (single direction) for each
crosswalk location. The locked wheel test will require three repeat
loci ups and averaged .for the designated test lane. The lane in which
the Motion tests were conducted must be identified in the report along
with the test. 'results.
C) Retest -- At any point when friction - numfers are determined to be
below the tequired values shown in Table 1, all Ianes shall be
evaluated and the range of friction values shall be determined.
D) Special Request - At any time a patterned pavement is in need of a
Special assessment, the designated lariets) small be evaluated to
determine the range of representative friction values.

4.2 PART 8 - Skid Testing with the Dynamic Friction Tester (DFT)

A) New Construction — The DFT test shall be conducted on all
crosswalks within 60 days of the new surface completion date. DFT
tests shall be conducted at three (3) discrete locations in each lane;
the results shall be averaged and reported for each lane. tested. All

Robert Lopes brought the agreements to me to route for execution by the Department. There was a question regarding
the description of the Patterned Pavement on the Maintenance Map, an exhibit in the agreement. Elisabeth Hassett,
the District 4 Landscape Architect worked with the firm providing the information and we have a corrected description
(Legend) on the bottom ofthe two map pages.
Since the agreements are signed by the Village(Mayor Abigail Brennan) the pages cannot be changed without her
initialing the pages, per discussion with our attorney, Dawn Raduano. Attached please find the 2 new pages and a pdf
of the current pages with the iLegend highlighted. Once the pages are initialed by the Mayor, please return them by
email to me. I will then route the agreements for execution by the Department.
