Subject: LAW ENFORCEMENT TRUST FUND EXPENDITURE
Presented for your consideration and action is this request to purchase one (1) Universal
Floating Dock for use by our current and any anticipated future police/fire rescue boat. An
opportunity has recently arisen where through a private sale to the Village a relatively new
dock valued at approximately $30,000 is being offered for sale to the Village at a cost of
$10,000.
Sergeant James Pike who is our senior boat operator has inspected this dock for its suitability
and confirms that it not only a good deal financially but will serve us well into the future. I am
also aware he has spoken to your regarding this piece of equipment as well. The Law
Enforcement Trust Fund has adequate funds to cover the purchase of this item and would be
in compliance as an acceptable expenditure of asset forfeiture funds.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AUTHORIZING THE
EXPENDITURE OF $10,000.00 FROM THE LAW ENFORCEMENT
TRUST FUND TO BE USED TO PURCHASE ONE U1vIVERSAL
FLOATING DOCK; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, an opportunity has recently arisen for the Village's Police Department to
purchase for $10,000.00 through a private sale, a relatively new Universal Floating Dock valued
at approximately $30,000; and
WHEREAS, Sergeant James Pike, the Village Police Department's senior boat operator,
has inspected this dock for its suitability and confirms that it not only a good deal fmancially but
will serve the Police Department's marine unit well into the future; and -
WHEREAS, the Chief of Police has deternuned and verified that the Village's Law
Enforcement Trust Fund has adequate funds to cover the purchase of this item and that use of the
Village's Law Enforcement Trust Fund assets to pay for the Universal Floating Dock is
permissible and appropriate, and in compliance with the provisions of U.S. Department of
Treasury Guide to Equitable Sharing; and
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta hereby adopts this
Resolution and thereby approves and authorizes the use of $10,000.00 from the V illage's Special
� Law Enforcement Trust Fund to be used to purchase one (1) Universal Floating Dock.
Section 2: This Resolution shall become effective immediately upon passage.
BILL OF SALE / INDEMNIFICATION AGREEMENT �
THIS BILL OF SALE / INDEMNIFICATION AGREEMENT is dated
, 2016, by the Village of Tequesta, a municipal corporation of the
state of Florida, whose address is 345 Tequesta Drive, Tequesta, Florida, 33469 (the
"Buyer"), and by Robert L. Crane, and individual, whose address is 515 North Flagler
Drive, 20th Floor, West Palm Beach, Florida, 33401 (the "Seller").
1. The Seller, in exchange for the sum of Ten Thousand and 00/100 Dollars
($10,000.00) along with other good and valuable consideration, including the
Buyer's indemnification of the Seller as set forth herein, the receipt and
sufficiency of which is hereby acknowledged, does hereby sell and convey unto
the Buyer, the following:
2014 JET DOCK — 25' Universal Boat Dock measuring 11'8" wide and 28'4" long (the
"Dock")
2. The Seller hereby covenants with the Buyer that the Dock is in good condition;
that the Seller is the lawful owner of the Dock; and that the Seller has good right
and lawful authority to sell and convey the Dock.
3. It is agreed and understood that the Dock is sold and conveyed to the Seller in its
current "as-is" condition. It is further agreed and understood that the Dock is
currently located at 325 Beach Road (Island House SW Condo), Slip 1(northern
most slip of the property), and that it shall be at the Buyer's sole cost and
responsibility to remove and transport the Dock from its current location to a new
location of the Buyer's choosing, if relocation becomes required in the future. All
expense, and all risk of damage and/or loss to the Dock or to any other property,
or of injury to any person associated with the transportation and relocation of the
Dock shall be borne by the Buyer, and the Seller shall have no responsibility
whatsoever in this regard. The Buyer agrees that it shall indemnify, defend and
hold harmless the Seller from any claims or demands arising from any such
damage, loss or injury.
IN WITNESS WHEREOF, the Seller and the Buyer have caused this Bill of Sale /
Indemnification Agreement to be executed as of the day and year first written above.
