The Special Magistrate appointed by the Village Council to hear code compliance cases for the
Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the
Code Compliance Hearing held on December 1, 2016, and based on the evidence and testimony
presented, entered an Order Continuing the Fine Assessment Hearing. The following Findings of
Fact and Order are hereby entered:
FINDINGS OF FACT
1. The Respondent is the owner of the above-described property.
2. The Respondent was not present at the hearing; however, there was a finding of
proper notice. Respondent's representative, Dustin Nocella, was present at the
hearing. �
3. As of the hearing on December 1, 2016 and based on testimony presented by Village
staff, the property is not in full compliance with section 14-152 of the Village's Code
of Ordinances, because a portion of the playground equipment appears to be located
within the setbacks of the property.
4. The Village Building Official and Planning and Zoning staff testified to the issue of
the setback and requested proof in the form of a sealed survey indicating that the
playground equipment is not in violation of the setback requirements under the
Village Code.
5. � The Village has agreed to give the property owner thirty (30) days to provide the
� suivey, upon which time the demolition permit can undergo final inspection, which
will include final review from the Building Official and Planning and Zoning
Department. ° �

ORDER
It is the Order of the Special Magistrate that the Respondent provide proof, in the form of a
sealcd survey, that the setback requirements are met within thirty (30) days of the date of this order.
Please take notice that you must appear at the Fine Assessment Hearing which will be held on the
January 26, 2017, at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta,
Florida 33469, unless the Code Compliance Officer certifies that you have timely brought your
property into compliance.
Upon complying in an,y code compliance matter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0506 to request a
reinspection of the property.
