RE: Annexation of claves by Interlocal Agreement
For your information, I offer the following regarding Florida law impacting the annexation or
enclave areas by interlocal agreement with the county:
Effective July 1, 2016, a municipality may annex, via interlocal agreement with the county,
any enclave up to 110 acres in size (the maximum size previously was 10 acres).
Earlier in the year, I attended a meeting with the Village's Community Development Director
as well as Palm Beach County staff who handle annexation matters for the county. There
was unanimous agreement among Village and county staff, including legal, that based on
the revised statutory provision, the unincorporated enclave adjacent to Tequesta known as
"Anchorage Point" is now technically qualified to be annexed into the Village via interlocal
agreement. This area is designated as "Area A" an the attached map.
Of course, in order to have such an interlocal agreement, the governing bodies of both the
Village and the County must agree to do so. While approval af the residents in the subject
areas is not a legal requirement for annexation via interlocal agreement, both governing
bodies will have to determine for themselves the political implications, if any, of entering into
such an agreement, possibly against the desire of such residents.
However, once it is determined that there is political interest in entering into an interlocal
agreement, it should not take more than 90 days, give or take, to have the agreement
placed onto both a Village and a county agenda for adoption. We will verify this timeframe
with county staff, with the understanding that the county has the larger bureaucracy and the
more time consuming approval process.
