I respectfully present the following Comprehensive Analysis to the Village Manager.
The Village of Tequesta's water treatment plant had a free Legacy account from Comcast.
Comcast has now done away with this type of account.
In doing so, the plant needed a new account and agreement.
Monthly cost: $144.80

Statutes. Further, CONTRACTOR shall ensure that any exempt or
confidential records associated with this Agreement or associated
with the performance of the work described in the Proposal or Bid
are not disclosed except as authorized by law for the duration of the
Agreement term, and following completion of the Agreement if the
CONTRACTOR does not transfer the records to the Village.
Finally, upon completion of the Agreement, CONTRACTOR shall
transfer, at no cost to the Village, all public records in possession of
the CONTRACTOR, or keep and maintain public records required
by the Village. If the CONTRACTOR transfers all public records to
the Village upon completion of the Agreement, the CONTRACTOR
shalE destroy any duplicate public records that are exempt or
confidential and exempt from public records disclosure
requirements. If the CONTRACTOR keeps and maintains public
records upon completion of the Agreement, the CONTRACTOR
shall meet all appficable requirements for retaining public records. �
Records that are stored electronically must be provided to the
VILLAGE, upon request from the Village's custodian of public
records, in a format that is compatible with the Village's information
technology systems.

f. The GraMee/Recipiertit may provide some portion of any nonfederal shar+e for '

the Subgrantee/Subreciplent agrees to provide eny nonf�deral share not paid by
the Orantee/Recipient. The federal allowable oosts must be determined as per
2 C.F.R, and 44 C.F.R. §§ 13 and 206.
g. The approved Project Worksheets will be transmitted to the Subgrantee/ �
Subr�ecipien� and must state the cumulafive Funding ailowed, the scope of the
eligible project, and the � eligible under this P�qreemerrt.
h. Project WorksFieets ma.y obligate or deobiigate funding, theneby amending the total
fimding for the project. These actions will be denoted in fl�e final verston of the
obligated project worksheet fior each project,
i. The approved Project Worksk�eets will document the total eligible costs and the
total federal share of those costs.
j. As a condi4on of fund(ng under this qgreemerit, the SubgranteelSubrecipi�nt
a8rees that the Grantee/Redpient may withhold funds otherwise payable tc the
Subgrantee/Subrecipient from any disbursement to the Grantee/Re�ipient, by
FEMA or arry other sourc:e, upon a determination by the Grantee/Recipient or
FEMA that funds exceeding the eligible� costs have been disbursed to the
� Subgran#ee/Subrecipient pursuant fio this Agreement or any other funding
agreement administered by the Granbee/Recipierrt.
k. The Subgrantee/Subrecipierrt under�fiands and agrees that the Grantee/Recipierrt
may offset any funds due and payabf� to the Subgrantee/Subreapie�rt urrt8 the
debt to the SNate is satiisfied. In such event, the Granfiee/Recipient will notify the
Subgrantee/Subrecipient via the entry of no�bes in FloridaPAarg.
4) INSURANCE. `
a. The SubgranteelSubr+ecipient understands and agrees that disaster funding for
insurable faci(ities provided by FEMA is irttended to supplemerrt, not replace,
'financial assistance from insurance coverage and/or other sources. Actual or
arrtiapated insurance proceeds must be deducbed from all applicable FEMA Public
Assistance grents in order to avoid a duplication of benefrts. The Subgranbee/
Subreapierrt further understands and agre� that If Public Assistance funding is
obligated for work that is subsequenthr determined to be covered by insurance
and/or other sources of funding. FEMA must deobligate the funds per Stafford Act
Sections 101 (b)(4) and 312 (c). .

projects in order to be eligible fvr Public Assistanoe funding in fut�re disasters
pursuarrt to § 311 of the Stafford Act, qs stated in the StafPoRi /�ct, "Such aoverage
must at a minimum be in the amourrt of the eligible Pnoject costs.° Further, the
�afiord Act� requires a Subgrantee/Subnacipient to purc�ase and maintain
insurance, where that insurance is ° reaso�ably �vailable, �dequafe or necessary

insurance is not met, FEMA will not provide assistance for damages sustained in

aware. of, and complyir�g with, aIl insurance. consideratians contained in the
Staffond Act and in 44 C.F.R. §§ 206.252 253: .

within thirty (30) days of the date it becomes aware of any insurance coverage for
the damage identified on the app)icable Project Workshe�ets and of any entitlement

recipient futther agrees to provide all pertinent insurance i�lformation, including but
not limiteci to copies'of a�l policies, de�larations pages, insw�ing agreemerrts.

9) FINAL PAYMENT.

considered Gosed when the P.4. has been processed and FEMA has
dosed the subgrantee Grarrt); and

c. Upon the occurrence of any one or more of the foregoing events� the
Grantee/Reapient rrtay at its option give notit�e in writing to the Subgrantee/
Subrecipient fio cure ifs failure of pertormence if such failure can be cured. Upon
the failure af the Subgranbee/Subrecipient to cure, the Granfiee/ Recipient may
exercise any one or more of the following remedies: i

rescission, suspension or termination aF this Agreement by the GranteelRecipierrt
does not relieve the Subgrantee/Subrecipierrt of liability to the GranbeeJRecipierrt
` for the restitutlon of funds advanced bo Subgranbee/Subreaplent under this
� �greement, and the Gra�ee/ Recipierrt may set off arry such funds by withhotding

Subgrante�/Subrecipient, cause the terminafion of this Agreemerrt and the
rel�se of the Grantee/Reapierrt from all ffs obligatons to the Subgrant�se/ '

25) GOVERNING LAW.

PUBLIC RECORDS. In accordance with Sec. 119.0701, Florida
Statutes, CONTRACTOR must keep and maintain this Agreement
� and any other records associated therewith and that are associated
with the perFormance of the work described in the Proposal or Bid. �
Upon request from the Village's custodian of public records,
CONTRACTOR must provide the Village with copies of requested
records, or allow such records to be inspected or copied, within a
reasonable time in accordance with acxess and cost requirements
of Chapter 119, F/orida Statutes. A CONTRACTOR who fails to
provide the public records to the Village, or fails to make them
available for inspection or copying, within a reasonable time may be
subject to attorney's fees and costs pursuant to Sec. 119.0701, .
Florida Statufes, and other penalties under Sec. 119.10, Florida
Statutes. Further, CONTRACTOR shall ensure that any exempt or
confidential records associated with this Agreement or associated
with the performance of the work described in the Proposal or Bid
are not disclosed except as authorized by law for the duration of the
. Agreement term, and following completion of the Agreement if the
CONTF�4CTOR does not transfer the records to the Village.
Finally, upon completion of the Agreement, CONTRACTOR shall
transfer, at no cost to the Village, all public records in possession of
the CONTRACTOR, or keep and maintain public records required
by the Village. If the CONTRACTOR transfers all public records to
the Village upon completion of the Agreement, the CONTRACTOR
shall destroy any duplicate public records that are exempt or
confidential and exempt from public records disclosure
requirements. If the CONTRACTOR keeps and maintains public
records upon complefion of the Agreement, the CONTRACTOR
shall meet all applicable requirements for retaining public records.
Records that are stored electronically must be provided to the
VILLAGE, upon request from the Village's custodian of public
records, in a format that is compatible with the Village's information
technology systems.
