The Special Magistrate appointed by the Village Council to hear code compliance cases for
the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, heard testimony at the
Code Compliance Hearing held on January 26, 2017. Based on the evidence and testimony presented
at the hearing, the following Findings of Fact and Order Granting Fine Reduction are hereby entered:
FINDINGS OF FACT
1. Based upon the "Order Assessing Fine," dated May 2, 2016, for the above-referenced case
number, the Special Magistrate assessed. a fine in the amount of Two Thousand Two ,
Hundred Dollars ($2,200.00) and continuing to accrue at a rate of One Hundred Dollars
($100.00) per day until compliance was achieved. The total fine incurred in this case was
Four Thousand Four Hundred Dollars ($4,400.00).
2. Since the last hearing in this case, ownership of the property changed from the Estate of
Carmen Legado to Federal National Mortgage Association.
3. The Respondent's representative, Joe Bettag, requested a hearing seeking mitigation of the
lien amount assessed.
4. The Village of Tequesta opposed reduction of the fine amount which totaled Four Thousand
Four Hundred Dollars ($4,400.00). The fine amount was reduced at hearing to Three
Thousand Four Hundred Eighty-six Dollars and Fifty-four Cents ($3,486.54). Abatement and
administrative costs in the amount of One Thousand Five Hundred Thirteen Dollars and
Forty-six Cents ($1,513.46) were not reduced.
5. The property is no longer in violation of Chapter 30, Article II, Section 30-33 of the Code of
Ordinances of the Village of Tequesta. �

ORDER
It is the Order of the Village of Tequesta Special Magistrate that the penalty amount
previously imposed be reduced from $5,913.46 to $5,000.00. The Respondent is hereby ordered to
pay this mitigated fine amount, which includes Three Thousand Four Hundred Eighty-six Dollars
and Fifty-four Cents ($3,486.54) in fines and One Thousand Five Hundred Thirteen Dollars and
Forty-six Cents ($1,513.46) in abatement and administrative costs, within sixty (60) days of the date
of this order or the original penalty amount will automatically be reinstated as a penalty.
