The proposal made to the PBA was fora 1-year contract for FY2006-07, which includes a 4.6% across the board increase, along with the Cost of Living Adjustment (COLA) of 4.4% approved for the Village at the Council meeting held on October 10, 2006. All other terms and conditions of the 2003-2006 contract remain in place, with the negotiating team being instructed to resume negations as soon as possible after the execution of the 1-year contract, to restart negotiations for a period of time to be determined. The Village was advised on August 21, 2007, that the PBA has accepted the Council's proposal (copy of letter attached). RESOLUTION NO. 65-06/07 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, TO RATIFY THE PBA CONTRACT FOR THE 1-YEAR PERIOD 2006-2007, AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE CONTRACT ON BEHALF OF THE VILLAGE AND TO IMMEDIATELY RESTART NEGOTIATIONS WHEREAS, the Village Council of the Village of Tequesta, through its representative, the Village Manager, has indicated to the PBA that it will tentatively accept the terms of the Memorandum of Understanding set out in Exhibit "A", subject to Council's ratification; and WHEREAS, the PBA has communicated that this contract has been ratified by the Village of Tequesta PBA Bargaining Unit Members -Exhibit "B" NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1 Consideration is given to Resolution No. 65-06/07 by ratifying the PBA contract to be in place for one (1) year (2006-2007) and the Village Manager of the Village of Tequesta be authorized to execute the same on behalf of the Village, and to immediately restart negotiations for a period of time to be determined. Section 2 This Resolution shall become effective immediately upon passage. The foregoing Resolution was offered by moved its adoption. The Village of Tequesta, Florida (the "Village") and the Palm Beach County Police Benevolent Association, Inc. (the "PBA"} agree to the following resolution of their 2006 collective bargaining negotiations regarding all eligible law enforcement officers and sergeants of the Village of Tequesta Police Department within the bargaining unit covered by PERC Certification # 1615. The Village and the PBA agree that: The PBA is the exclusive bargaining agent for all full-time employees, excluding non-sworn employees of the Police Department, the Chief of Police, the Police Captain, and Lieutenants. 2. Article l2, Wages, Section 2, of the existing collective bargaining agreement will be modified to read as follows: Section 2: l . Unit Members shall receive performance reviews pursuant to the Village's Performance Planning and Review system ("Performance Review"). Evaluations shall be conducted on a satisfactory/unsatisfactory basis. 2. If a Unit Member receives a "satisfactory" evaluation, the Unit Member will be eligible to receive a 4.6% salary increase, effective October 1, 2006. Any Unit Member receiving an "unsatisfactory" evaluation shall not be entitled to any salary increase for a period of ninety (90) days and will be placed on probation until such time as determined by the Unit Member's supervisor. At the conclusion of the ninety (90) day period, the Unit Member will be re- evaluated and, if he or she receives a satisfactory evaluation, the Unit Member will be eligible fora 4.6% salary increase, effective with the conclusion of the ninety (90} day period. In addition, to be eligible to receive the 4.6% increase, the Unit Member must have been continuously employed by the Village for the twelve month period immediately preceding October 1, 2006. Effective October I, 2006, Unit Members shall receive a 4.4% cost of living salary increase, in addition to the increase received ;,. (} .. ~ , i. pursuant to paragraphs 1 and 2 above. 3. The parties agree that all current Unit Members, except James Dyal and Derick Velez, are eligible for the pay increases set forth above. Consequently, notwithstanding and instead of the language set forth above, the following shall apply to Dyal and Velez. Dyal shall receive a 4.4% cost of living increase effective with his date of hire (3/I 9/07). Velez shall receive a 4.4% cost of living increase, effective with his date of hire (10/16/06). Each of them will receive a performance evaluation as described above when they have completed six (6) months of employment. If the performance evaluation is satisfactory, the employee will receive a 4.6% salary increase, in addition to the aforementioned cost of living increase, effective with his date of hire. Nothing herein shall be construed to change the one-year new hire probationary period of Dyal, Velez, or any other Unit Member. 4. All other provisions of the current Collective Bargaining Agreement not subject to this Memorandum of Understanding shall remain in full force and effect. 5. The Parties have full legal authority to enter into this Memorandum of Understanding, and, 6. Upon ratification of this Memarandum of Understanding, the Parties will resume collective bargaining negotiations for the period beginning October 1, 2007.
