VILLAGE OF TEQUESTA
PLANNING AND ZONING
BOARD MEETING February 16, 2017
CALL TO ORDER AND ROLL CALL
The meeting was called to order at 5:30 p.m. by Board Chair Janet Strand. A roll call was
taken by Community Development Planner, Lance Lilly. Present were: Board Member
Elizabeth Schauer, Board Member Steve Eagen, Alternate Member Leslee Dasher and
Alternate Member Theresa Maggio. Absent were Vice-Chair Michael Schmidt and Board
Member Ashley Warren. Also present were Vilfage Attorney Keith Davis, Viiiage Attorney
Amity Barnard and Community Development Director Nilsa Zacarias.
APPROVAL OF AGENDA
MOTION: Board Member Elizabeth Schauer moved approval of the agenda; seconded by
Board Member Leslee Dasher; motion carried unanimously 5-0.
1. Approval of Previous Meeting Minutes —December 15, 2016
MOT/ON: Board Member Steve Eagen moved approval of minutes; seconded by
Alternate Committee Member Leslee Dasher; motion carried unanimously 5-0.
2. SPM 01-17:
Application from Gregory & Alejandra DeLange to install an entry gate and two (2) six-foot
entry columns per Sec. 78-284 (b). The address of the property was 19245 Riverside
Drive, Tequesta, Florida, 33469.
Attorney Barnard announced the next item was quasi-judicial and swore in one person
involved with the application. She then asked the Board for any ex-parte communications.
There were none.
MOTION: Board Member Elizabeth Schauer moved to approve SPM 01-17; seconded by
Board Member Steve Eagen; motion carried unanimously 5-0.
3. Discussion Regarding Infrastructure Surtax Citizen Oversight Committee
Attorney Davis addressed the Planning and Zoning Board and brought to their attention
the fact thaf the voters in Pafm Beach County had approved a one cent surtax, back in
November of 2016. The surtax was to only be used for infrastructure related projects. He
further revealed that for every penny, municipalities in Pafm Beach County as a group
received forty percent, which was then divided amongst all the municipalities. The Village
of Tequesta was set up to receive its' share directly from the State. The funds were
allowed to be used for projects such as roads, sidewalks and other public infrastructures.
Attorney Davis counseled that one of the components of the surtax mechanism required
every municipafity to have a Citizens Oversight Committee, which was an Advisory

Committee to a particular governing body. The Committee could be created or the
municipality could utilize a committee that was created by the Palm Beach County League
of Cities. Attorney Davis related that Council decided to have its' own Oversite Committee
comprised of individuals who resided in, and had an interest in the Village of Tequesta.
Attorney Davis further revealed that the Committee was required to operate pursuant to
the Florida Sunshine Law and Public Records Act. Village Council felt it made sense to
add this responsibility to the existing Planning and Zoning Board, instead of trying to form
a new committee.
Attorney Davis provided a copy of Resolution 11-17 which memorialized the action and
spelled out the details. He advised the Board that they would need to meet monthly or "as
often as needed" to conduct their responsibilities. He assured the Board that the
Committee was simply an advisory group, and that there was no action to be taken. He
pointed out that the Oversight Committee would provide a yearly report and would "sunset"
with the end of the 10-year period or the collection of 2.7 billion dollars in total, whichever
occurred first.
Board Member Elizabeth Schauer asked if the Village had any projects in mind for the
surtax funds. Attorney Davis revealed that there was discussion of certain projects, but
nothing had been decided as of yet. He maintained that the Counci! would provide the
Committee with a list of projects and it would need to match those up with the money being
spent.
Board Member Elizabeth Schauer asked if the County would require two financial
disclosure forms or if they could have both the Planning and Zoning Board and the
lnfrastructure Surtax Citizen Oversight Committee report on the same form. Attorney
Davis felt that it would be fine to write in the additiona! information on the one form.
Board Chair Janet Strand inquired as to the possibility of recommending infrastructure
projects to Council. Attorney Davis advised that the role of the Committee would not be to
recommend projects to Council. �

seconded by Board Member Leslee Dasher; The motion to adjourn carried unanimously 5-
0; therefore, the meeting was adjourned at 5:45 P.M.
