Leiser, Esquire DECK, HARRIS, Raynor & JONES, P.A. 790 Juno Ocean Walk, Suite 600 Juno Beach, FL 33477 RESCISSION OF VARIANCE AGREEMENT THIS RESCISSION OF VARIANCE AGREEMENT is made this day of March, 2017, by the VILLAGE OF TEQUESTA, a Florida municipal corporation (hereinafter the "Village "). WHEREAS, on October 18, 1993, the Village Board of Adjustment ranted the owners 9 J 9 of the following described real property a variance increasing the maximum allowable lot coverage for the lot under the village's zoning code: Lot 7, Block 32, Section B of Jupiter in the Pines, according to the Plat thereof as recorded in Plat Book 26, Page 18, Public Records of Palm Beach County, Florida (hereinafter the "Property "). WHEREAS, the Village Board of Adjustment granted the variance with certain conditions which were set forth in a variance agreement between the Village and the then owners of the Property. The variance agreement was recorded on November 23, 1993 in Official Records Book 7993, Page 1316 of the Public Records of Palm Beach County, Florida (hereinafter the "Variance Agreement "). WHEREAS, on March 16, 2017, the Village's Planning and Zoning Board, as successor to the former Board of Adjustment, upon holding a hearing on the current owner's application to rescind or modify the Variance Agreement, voted to rescind the Variance Agreement while leaving the variance increasing the maximum allowable lot coverage for the Property in place. NOW, THEREFORE, in consideration of the sum of TEN DOLLARS ($10.00), the recitals set forth above and other good and valuable consideration: 1. All above recitals are incorporated herein as if set forth in this Rescission of Variance Agreement. 2. Effective March 16, 2017, the Variance Agreement is hereby rescinded. {16162.05000.00301790. 1 1 IN WITNESS WHEREOF, the VILLAGE OF TEQUESTA, executed this Rescission of Variance Agreement on the day and year first above written.
