RE: �olation of Chapter 46, Article III, Section 46-74 and Chapter 78, Article X, Section 78- 693 of the Code of Ordinances of the �llage of Tequesta and IPMC Sections 303.6 (Exterior id'alds), 303.7 -ERoofs and Brainagg), -and -605.1 -�IectKical �quipment Installation), adopted through Section 14-121 of the Code of Ordinances of the �llage of Tequesta. Address: 229 Fairway West Tequesta, Florida 33469 Legal Description: TEQUESTA LT 260 PCN: 60-42-40-26-01-000-2600 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, heard testimony at the Code Compliance Hearing held on March 23, 2017. Based on the evidence and testimony presented, the following Findings of Fact, Conclusion of Law, and Order Finding Violation are hereby entered: FINDINGS OF FACT 1. Respondent was not-present at the-hearing: T-here-v�+as a finding of propernotice: 2. Code Compliance Of�icer Joe Petrick provided testimony and evidence of the violations, as contained in the Village's evidentiary case file which was accepted into evidence. 3. As of the hearing on March 23, 2017, based on testimony presented by the Code Compliance Officer, the property was in compliance with Chapter 46, Article III, Section 46-74, Chapter 78, Article X, Section 78-693, and IPMC Section 303.7 (Roofs and Drainage), but did not achieved compliance by the date in the Notice of Violation. The pro�erty was nat in compliance with IPM� �e�tions__3.Q3�6 (Exterior Walls) and 6_Q5.1 (Electrical Equipment Installation), adopted through Section 14-121 of the Code of Ordinances of the Village of Tequesta. CONCLUSION OF LAW The above-stated facts constitute a violation of Chapter 46, Article III, Section 46-74 and Chapter 78, Article X, Section 78-693 of the Code of Ordinances of the Village of Tequesta and IPMC Sections 303.6 (Exterior Walls), 303.7 (Roofs and Drainage), and 605.1 (Electrical Equipment Installation), adopted through Section 14-121 of the Code of Ordinances of the Village of Tequesta. ORDER The Respondent is hcrcby ordered to maintain compliance with Chapter 46, Article IiI, Section 46-74 and Chapter 78, Article X, Section 78-693 of the Code of Ordinances of the Village of Tequesta, and IPMC Section 303.7 (Roofs and Drainage), adopted through Section 14-121 of the Code of Ordinances of the Village of Tequesta. �Zespondent is further hereby ordered to comply with �P�VIC �ections 3U3:6 (Exterior Walls) and 605.1 (Electrical Equipment Installation), adopted through Section 14-121 of the Code of Ordinances of the Village of Tequesta, by April 19, 2017. If the Respondent fails to achieve compliance by April 19, 2017, a daily fine of One Hundred Fifty Dollars ($150.00) may be imposed for each day the violation continues to exist. Assessment of the Village's administrative costs in the amount of $197.12 incurred at the March 23, 2017 hearing is hereby ordered. Please take notice that you must appear at a Fine Assessment Hearing, which will be held on Apri[ 20, 2017 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469, unless the Code Compliance Officer certifies that you have timely brought your property into compliance. Should you violate the same Section of the Code again, you may be subject to a fine of up to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code Compliance Officer is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Upon complying in any code compliance matter, it is always the responsibility of the Respondent to contact the Code Compliance Division at (561) 768-0506 to request a reinspecNon ofthe property.
