3. STAFF REVIEW
The subject application is located at 356 Church Road in the R-1 Single Family Dwelling District. The
applicant is requesting to modify or rescind a 1993 Variance Agreement. On October 18, 1993, the
Village's Board of Adjustment approved a variance request from Mr. and Mrs. Aloe,the previous owners
of the Property, to increase the maximum allowable lot coverage from 37% to 39.45%. The Board of
Adjustment, concerned that the Aloe's second kitchen could result in the house being used as a multi-
family dwelling, required the Aloes to provide an agreement, in recordable form, that the "addition not
be converted into a rental unit." Please see attached complete application for further details.
The subject application is pursuant to Section 78-66 "In exercising the powers mentioned in section 78-
65, the planning and zoning board or the village council may, in conformity with the provisions of this
article, reverse or affirm, wholly or partly, or may modify the order, requirement, decision or
determination appealed from and may make such order, requirement, decision or determination as ought
to be made, and to that end shall have all the powers of the officer from whom the appeal is taken. The
concurring vote of three members of the planning and zoning board or the village council shall be
necessary to reverse any order, requirement, decision or determination of any such administrative official,
or to decide in favor of the applicant on any matter upon which it is required to pass under this chapter,
or to effect any variation in this chapter. Any request denied by the planning and zoning board or the
village council shall not be resubmitted for a period of 90 days after the date of denial."
4. FINAL REMARKS
The notice of hearing was advertised on March 5, 2017.The legal notice was mailed to property
owners within a 300-foot radius of the property.

I. Nature of Reqaest
Pursuant to Section 78-b6 of the Zoning Code, which permits the P&Z Board to modify
its orders and requirements, Own.er respectfully requests that the P&Z Board agree to either
modify or rescind the Variance Agreement attached as Exhibit"A". As Owner explains herein,
the Variance Agreement is no longer needed and should be rescinded ox, in the alternative,
m.odified as set forth below and on the attached Exhibit"B":
1. Deleting pazagraph 1.(b) of the Variance Agreexxaent which requires a
subsequent purchaser of the Property to apply for a renewal of the varian.ce.
2. Deleting the provision in paragraph 3 of the Variance Agreezx�ent requiring the
owner to fite an annual written statement with th.e Village confirming that the
single£amily use of the Property is continuing.
II. Background
On �ctober 18, 1993, the Village's Board of Adjusiment unanimously approved a
variance request from Mr. and Mrs. Aloe, the previous owners af the Pro�erty, increasing the
malcimum allowable lot coverage from 37°lo to 39.45%. A copy o�the minutes of that rneeting is
atta.ched as Exhibit KC". The Board of Adjustment, concerned that the Aloe's plan to install a
second kitchen could result in the house being used as a multi-farnily dwelling, reqt�ired the
Aloes to provide an agreement, in recordable form, that the "addition not be converted into a .
renta] unit." See the Village's letter to Mr, and Mrs. Aloe dated October 25, 1993, attached as

Exhibit"D". Thereafter, Mr. and Mrs. Alae provided the Village wzth the Variance Agreement
which was recorded in the Officiai Records o£Palm Beach County on November 23, 1993. Mr.
and Mxs. Aloe then completed the addition to their house, including installing a small second
kitchen.
�n August 1, 2007, Owner, in anticipation of purchasing the Property, applied for
renevval of the Variance Agreement. See the application and receipt attached as Exhibit"E".
On August 15, 2007, Owner purchased the Property as evidenced by the Warranty Deed
attached as Exhibit"F".
On August 20, 2007, the Village sent a letter, attached as Eathibit KG", to the property
owners within 300 fe�t of the Property notifying them of a Board of Adjustment meeting
regarding Owner's application for renewal of the Variance Agreezxaent. The letter incort-ectly
stated that the purpose of the nneeti.ng was to conside�r 4wner's application to renew a"Variance
Agreement for a second D�c�velling Unit with kitchen." As explained above, the varianc�was for
increasing the maximum allowable lot coverage, and the Variance Agreement was drafted for the
purpose of ensuring that the addition ta the Property would NOT be used as a second dwelling
unit.
Nevertheless, the Board of Adjushnent held its meeting on September 17, 2007. The
Baaard decided to delay its decision on the Ovvner's application to renew the Variance Agreement
despite the fact that paragraph l.b) of the Variance Agreement provides that "said renewal of
Variance sha11 not be unreasonably wxthheld by the Village." Tt►e Board delayed its decision in
order to receive a written opinion from the Village's attorney concerning the Owner's
application.
On�ctober 19, 2007,the Village's attorney provided his written opinion to the Village as
shown on the attached Exhibit "H". The Village's attorney incorrectly stated that "the new
owner did not apply for an extension af the variance ren.ewal, prior to closing on fihe sale of the
a�orernentioned �roperty." As shovc�n by Exhibit "E", the Owner did apply to extend the
Variance Agreement prior to closing on the sale of the Property.
Fallowing the Septe�m.ber 17, 2007 h.eaz�ing, Owner sent a letter to the Village manager
explaixting the situation as she saw it. A copy of this letter is attached as Exhibit "I". The
Owner wrote that the notice sent to neighbors incorrectly stated that she was seeking to use the
additional lot coverage as a "second dwelling unit with kitchen" and therefore the notice could
lead to the Board of Adjustment denying her request. She also wrote that none of the neighbors
that received the incorrect notice showed up at the Board af Adjustment m.eeting indicating that
none of them had any concerns about her application for renewal. Furthennore, she correctly
wrote thaf the prior owner's failure to file annual written statements with the town certifying
corntizaued. single family use of the home, as set forth in paragraph 3 of the Vazzance Agreement,
does not trigger removal of the kitchen as set forth in paragraphs 1 and 2 of the �ariance
Agreement. Finally, she eQrrectly wrote that she did apply to renew the Variance Ag�reement
prior to purchasing the pYoperty and by the terms of �1ie agreement the Village was nat to
unreasonably vvithhold approval.

Then, on November 19, 2007,mare than THREE MOl`�TTS after filing the application, the
Board of Adjushnent held its secornd meeting conceming the Owner's application to renew the
Varianoe Agreement. A copy of the minutes of that meeting along with the memoranduxn from
Community Development Director Hazding that is referenced in said minutes is attached as
Exhibit"J". Again, the memorandum incorrectly stated that the Owner did not apply ta renew
the Variance Agreement priar to closing on the Property. Furtherrnore, the memorandum
incorrectly characterizes the variance as apgraving the creatian af a multi-£axx�.ily dwelling. As
shown above, the variance was sixnply for increasing the permitted lot coverage fram 37% to
39.45%and did not authorize a multi-family dwelling. In fact, the entire purpose af the Variance
.Agreement was to en�ure that the Property would not be used as a mul.ti-family dwelling.
Despite all af this, the meeting went forward. Based on the minutes of the meeting, what
occurred is not entirely clear. What is clear is that the Owner stated, an the record, that she
applied ta renew the Variance Agreement BEFORE she closed on the purchase of the Property "
and that she would abide by the conditions of the Variance Agireement. There was then
discussion about the variance being unlawful because it authorized a multi-family use in a singl.e
farnily use district. Again, as set forth above, this is not what the variance authorized. The
variance very clearly authorized an increase in lot coverage only. Ultixnately, the Board of
Adjustment failed to pass a motion concerning the 4wner's application. Thereafter, in response
ko Owner asking what she could do to bring the Property into full campliance, the minutes
provide that "Ms. Harding [then Head of Community Development] responded.in order to bring
the property into full compliance that the applicant needed to get a demolition permit and then a
building permit for a sink and stove. She (meaning Mary Hester) would be coming into
cornpliance and on the record because the kitchen would go by removixa,g the stove and sink; but
she could then install a sink and stove because a secozad kitchen was permitted and that wauld be
legal."
The Owner, relying an the statements of Ms. Hardang, rnade application for the
demolitian of the existing kitchen that was part of the Variance Agreement. The Viliage's
building inspecfior signed off that the demalition was completed. Then the Owner applied for
permits for a new second kitchen an.d, after the work was coxnpleted, the Village's building
inspector closed.the permits. A copy of the permits is attached as Exhibit"K".
The Owner is now interested in selling the Property and asked the Village whether or not
the Variance Agreement was stitll in faxce and effect. In response to her request, the cuzxent
Village Attorney stated that it was his opinion that the Variance Agreement remained in place.
Correspondence with the Village Attorney is attached as Exhibit ��L". The Village's attorney
noted that the code does not prohibit a second kitchen, that the vaxiance was for increasing the�ot
coverage, and there is nothing in the record indicating that the Property has bee� used for
anything but single family use. Therefore, the Owner should be permitted to request that the
P&Z Boaxd modify the Vaxiance Agreement.

IIY. Basis for Rescinding or Modifying the Varisnce Agreement
As you can tell from the bacl�ground set forth above, this process has been long and
confusing. However, the P&Z Boa�rd can eliminate the confusion by choosing to either rescind
or modify the Variance Agreement.
A. The Variance Agreement is Unnecessary
The Variance Agreement is unnecessary because the Zaning Code already prohi�its
multi-family dweliings in the 1'roperty's zoning dxstrict and does not prohibit a single-family
dwelling from having a second lcitchen. The Property is in the R-1 single-family dwelling
district established by Section 78-173 of the Zoning Code. The only permitted use in the R-1
district is for "Single-faxnily dwellings." Furthermore the Zoning Code does not prahibit a
single-farnily dwelling from having a second lcitchen. Consequently, a single-fami�y dwelling
with a sec�nd kitchen is pernutted in the R-1 district. That is exactly what the�Property is, a
single-family dwellin.g with a second kitchen. The purpose of the Variance Agreement was to
ensure that the Property remain a single-family dwelling. However, it is unnecessary because
anything other fihan a single-fainily dwelling is prohibited in the R-1 zoning district. 'I'k�ex-e�ore,
the Village already has the authority through its code enforcement provisions to ensure that the
Owner, and any subsequent purchaser,only uses the Property as a single-family dwelling.
B. The Variance Agreement's Requirements are Cumbersome
The Variance Agreernent requires any owner of the Property to provide a statenx�.ent
annually to the Village certifying that the Property is cantinuing to be used as a single-family
dwelling. At the l�Iovember 21, 2Q07 Board of Adjustxn.en,t m�eeting, Ms. Harding sta.ted that the
Village was not in a posifion to enforce this requirement. As such, it is clear that the requirement
of sendi�g the Village an annual statement certifying the continued single�famiiy use of the
Property is cumbersome on the Village. Further, as set forth above, the requirement is
unnecessary since the Village may inspect the properiy anytime it wants to ensure compliance
with the R-1 zoning district regulation prohibiting multi-family dwellings and has the power
through code enforcement to enforce such restzictions.
In addition to the annual statement, the Variance Agreement also requires that a
purchaser of the Pro�erty apply for an extension of the Variance Agreement. The requirement
set forth in paragraph 1.b.) of the Varian►ce Agreement is ambiguous and confusing and is a
restraint on alienation of the Praperty. It is not cleaz whether a prospective purchaser has to
apply before buying the property or has to actually obtain the renewal hefore purchasing. In any
event, this condition essentially makes the �roperty unrnarketable because a prospective
purchaser will have to go through the expense and time needed in applying for a renewal o£the
Variance Agreement whicb, as evidenced above, is not only cumbersorne and time consuming
but also uncertain. As such, a prospective purchaser that is told she must apply for and obtain
approval from the P&Z Board or else face the prospect of having to not only remove a kitchen,
hut also 2.45% of the improvement,will certainly look for another property to puzchase.

IV. Conclasion
Therefore, for the reasons set forth above, the Owner respectfully requests that the P&Z
Board either rescind the Variance Agreement in its entirety because the Zoning Code already
ensures that the Property can only be used as a single-family dwelling or modi£y the Variance
Agreement by removing the annual notice requirement and the requirement that a praspective
purchaser apply for and obtain a renewal of the Variance Agreement.

Dear Catherine:
This letter is written in response to your correspondence of Sep#ember 28, �007 and in
follow-up ta our telephone canversations in this regard.
i have reviewed your letter and in the attached 4Variance Agreement" for the
aforementioned property. I note that this agreement was formed in November 1993 and
was recorded in the Public Records of PaEm Beach Couniy Official Record Book 7993,
Page 931fi. Therefore, by virtue of such recording, the p�rchaser of the aforementioned
praper#y would be on "Record Notice" of the terms of ihe Variance Agreemer�t.
As ! understand it, the aforementioned property was recently sold to a new owner and
such transaction has evidently closed. Foiiowing closing, the new awner has indicated
to the Village a desire to renew#he Varia�ce Agreement.
As I understand it, the prior owner was not in compliance with the terrns af the Variance
Agreemen#. Specifically, among other things, #he prior owner did not comply with
Paragraph 3 of #he Agreement as the prior owner did not "...send to the Village an
annual rnr�itten statement to confimn that said singie family use of the property is
continuing and there is a ne+ed for the aforesaid second kitchen." _Moreover. it is my
understandln that the new owner did not appiy for an extension of #he ' nce
renewal, prior to closing on # e e o t e a orementioned prope y.

further attempt to make any different motion to do anything dur.ing that or any other meeting. As such, the status guo
was maintained and all originally irnposed canditions of approval remain in place.
If it is your desire to have one or more approval conditions rescinded, this must be done by the board. !will not be
handled administratively. Variances are quasi-judicial praceedings which require notice and public hearing. While I am
comfortable, legally,with traveling under#he original case num6er(thereby avoiding the necessity of a new applitatian
with the accompanying new applicatian fee),there may be notice expenses and other expenses; I will leave those
administrative matters to the Community Develapment Department,with which you will need to coordinate in order to

I agree that the variance runs with the land and that the variance permitting the excess Iot coverage is still
needed. Nowever, I see the Variance Agreement as separate and distinct from the variance. The Variance Agreement
does not authorize the excess lot coverage. Rather, it is merely a document that allowed the Town some mechanism to
ensure that the lot continued to be used as a singfe family home and to take action in the event th� lot use changed. As
such, my thought is that the Variance Agreement can be eliminated without affecting the variance.
You state belaw that in 2007 the Board took no action on the agreement. However,at the bo#tom of page 3 of the
lVovember 21,2007, minutes it states that"Board Member Ward stated his motio�was to renew this variance
agreement as written. Board Member Berthoff secanded." At the top of page 4 it states the motion faiEed by a 3-2

I have again reviewed the history of this variance from its original approval in 1993 to present.

According to the 1993 records, the additivn was intended to contain a second kitchen for the use of the single family
that occupied the residence. Since the only permitted use in the zoning district in which the property is lacated is
, "single family",and since typicalfy,a single family residence would only have one full kitchen, it was the Board of
Adjustment's intent to be assured that the residence was never transfarmed into a two-family resEdence with two
kitchens, necessitating the conditions that were+mposed.
I have read and re-read the 2007 meeting minutes from that Soard of Adjustment meeting and ta be perfectly honest,
while I am grateful that I was not involved with that exercise, I am at a los�to knaw exactly what happened there. Going
through the gist of those minutes, I wauld say the following:
I disagree with the stated opinion in the minutes that the granting of the origina{variance was in conflict with the uses
permitted in the subject zoning district. As f stated above,as long as the use remains "single family" f see nothing in
Village code that technically prohibits twa kitchen areas.
Your c(ient clearly explained that the residence was used by a "singie family" and that there were NOT two separate
dwelling units despite two kitchens. There is also a comment about having the second kitchen removed,though I can't
te#I if this was ever done in actuality.

There was significant discussion about what fixtures could or sE�ould be removed in order to technically eiiminate the
"kitchen". 7here was a mation which was withdrawn prior to a vote;There was a secor►d motion thaC failed,and t�en
no further action was attempted, leaving in place the status-quo. Afthaugh there was plenty of discussion between
Baard members and Village stafF, no action was taken to in any way alter the original variance approval or conditions.
At this point in time, I am unclear on whether a second kitchen(or features thereof)exist in the residence;however, i
see nothing that tel{s me that the additian whict�caused the residence to exceed maximum lot coverage has been
eliminated. Assuming that the addition remains(regardless of what it contains inside}then the variance approval, in
some form, must also remain.
Ultimately, I cannot agree with your statement that the Board af Adjustment(in 2007)decided not to renew ti�e
Variance Agreement. First,by law,variances run with the iand,they do not need to be renewed so long as the variance
cr�ndition remains(which in this case it does�. Second,the 2Q07 meeting minutes reflect that no action was taken by the
Board af Adjustment on that item. In my opinion,what shauld have happened was that after the motion failed,there
should have been a call for a different motion and some action of some kind. Unfortunately,that is not what occurred.
Therefare, it continues to be my apinion that what was�one by the quasi-judicial board cannot simply be un-done
administratively{short of your client removing the entire addition that was the cause of the variance in the first
place�. Since this is not a new matter, however, it may be that further consideration by the Planning and Zaning Board
does not require a full blown application/fee. I would need to defer to the Community Development Department an
that paint, but f think it is something that can be explared.

J have taken a look at your request as well as the historical documentation for this variance. While I am not personally
opposed ta rev'rsiting this matter with an eye toward simplifying the apprava!conditions that were originally attached to
the variance on your client's property,we cannot revise the conditions of appro�al administratively as you suggest.
Since this variance(as all variances are)was granted at a quasi-judicial public hearing pursuant to Village code,at a
minimum,any revision to the conclitions af approval that were deemed necessary to approve the variance originally
would likewise have to be handled at a quasiyudicial public hearing. Presently,the Village's Planning&Zoning Board
handles these matters. When the variance was originally approved,the Board af Adjustment was the bady to handle
these matters; however,the Baard of Adjustment has since been dissolved and its duties have been assumed by the
Planning&Zoning Board.
It seems clear to me that at the time the variance was granted,the Board o€Adjustment was concerned that the
residence would not lose its"single family" use characteristics in violation of Village code,as a result of allowing the
house expansion and the secand kitchen. Certainly,any change to the language of the original conditions of approval
would have to continue to memorialize the assurances the Board o#Adjustment felt were needed ta address those
concerns,and simifarly,satisfy the current Planning&Zoning Board.
Should your client wish to pursue this further,they and/or you are welcome to obtain a variance application from the
Vilfage's Community Qevelopment Department(which would include payment of the current applicatian fee(s)y, and
proceed accordingly.
For your information,the applicable code provisions related to the Planning&Zoning Board,and the requirements for
variance approval,can be found at Chapter 22 and Chapter 78 of the Village Code of Ordinances.

My name is Darren Leiser and we represent the owner of 356 Church Drive, Mary Hester. Ms. Hester spoke with Ms.
Nilsa Zacarias last month regarding her home and the attached Variance Agreement that allows a second kitchen at Ms.
Hester's house.
Ms. Hester is interested in modifying the Variance Agreement. She would like to eliminate:(i)the need far subsequent
purchasers of her property to apply for an extension of the variance agreement,and (ii)tlte requirement that the owner
file an annual written statement confirming that the house is still single family and that the second kitchen is still
needed. The reason for this request is to alleviate any concerns a subsequent purchaser may have conce�ning the
Variance Agreement in the event she or her estate sells the property.

family and bona fide guests and allowing village inspectors to inspect the property should any question arise regarding
