The letter offers rationale for approving the request. Pursuant to Sec. 14 -1 of the Village Code of Ordinances, no person shall conduct the erection, demolition, alteration or repair of any building on weekdays, including Saturdays, other than between the hours of 7:00 a.m. and 6:00 p.m. Further, there shall be no contracted labor or services, excluding janitorial services, performed on any yard or building or structure in the village on Sunday or legal holidays, and on weekdays, including Saturdays, other than between the hours of 7:00 a.m. and 6:00 p.m. The above referenced activities may be carried on outside of the permitted days and timeframes in cases of urgent necessity where health or safety is involved, or with the approval of the Village Council. Rodriguez, BCA, CBO, PCO, MCO Building Official Village of Tequesta Building Department 345 Tequesta Drive Tequesta, FL 33469 Re.: Remodel of Publix Store # 1049 Request for Permission/Variance for Overnight Work Dear Mr. Rodriguez, Appreciate you taking a few moments out of your busy day to speak to us about the upcoming remodel of the Publix Store # 1049 located within your Municipality. Based upon our conversation, it is the intent of this correspondence to formally request permission to perform all remodel work associated with remodel of this store during overnight hours while the store is closed for business. Publix Supermarkets and HGR Construction customarily perform all remodels of existing Publix Grocery Stores during overnight hours for two main reasons. First and foremost for the safety of the General Public, as well as the safety of our workforce. This remodel will require us to demo certain aspects of the store, as well as cut trenches into the sales floor to re -route existing underground plumbing lines. Obviously, we do not want anyone besides our professional work force inside the building to ensure no citizen of the Village of Tequesta has the potential to get hurt by anything while the store is being remodeled. Second reason is that Publix does not want to inconvenience the Residences of the Village of Tequesta and have them travel further for their Grocery needs than their local Publix store. To give you a better understanding, all of our construction activities during the remodel will be confined to the interior of the store itself. There is no exterior work associated with this particular remodel. Customarily all remodel work takes place between store closing and store opening Sunday through Thursday nights. It is our understanding that we may be required to formally request this variance in front of City Council. Please be so kind and let us know what procedures and paperwork is required in order to get this request on docket for next City Council Hearing. This is scheduled to go before the council at the next meeting on May 11, 2017. Due to the fact, that we have received multiple complaints from residents, regarding the noise and traffic caused by the Publix trucks, after hours in the past, I feel it may be to our advantage to notify residents living near Publix.
