The Special Magistrate appointed by the Village Council to hear code compliance cases for
the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the
Code Gomplianee I�earing held on Ap�il �.0 2417, and based on the evidenee and testimony
presented, enters an Order Finding Repeat Violation and Assessing Fine. The following Findings of
Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
1. Respondent was not present at the hearing but was represented by GUADELUPE
BAR�RA-and NIATT �i1NTZ of Jupiter Tequesta Air Gondition, at-the hearir�g. T-here
was also a finding of proper notice.
2. Code Compliance Officer Joe Petrick provided testimony and evidence of the repeat
violation, as contained in the Village's evidentiary case file which was accepted into
e�idence.
3. Based upon evidence and testimony presented, the Special Magistrate finds that the
property was in violation of Section 14-152 of the Code of Ordinances of the Village of
Tequesta from April 1, 2017 through April 20, 2017, a period of twenty (20) days, and that
the violation continues to exist.
4. This is a repeat violation of the same Village Code section(s) from an "Order Finding
Violation'' dated February 2, 2017.
CONCLUSIONS OF LAW
Based on the abo�e-stated facts, Respondent is in repeat violation of Chapter 14, Article V[,
Section 14-152 ofthe Code of�Ordinances ofthe Village ofTequesta.
ORDER
It is the Order of the Special Ivlagistrate that a Fine of Ten Thousand Dollars ($10;000:00) is
hereby assessed, at Five Hundred Dollars ($500.00) per day, for the repeat violation which existed on
the property beginning April l, 2017 through April 20, 2017, a period of twenty (20) days, and the
fine amount shall continue to accrue at Five Hundred Dollars ($500.00) per day until compliance is
I achieved.
I Respondent is further assessed the Village's administrative costs in the amount of $200.94.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits
and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162,
Florida Statutes.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0506 to request a re-
inspection of the property.
