The Special Magistrate appointed by the Village Council to hear code compliance cases for
the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the
Code Compliance Hearing held on April 20, 2017, and based on the evidence and testimony
presented ente�s an Order Finding Repeat �iolation and �ssessing Fine. The fol�ovving Findings of
Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
]. Respondent was present at the hearing; there was also a finding of proper notice.
2. Code Compliance Officer Joe Petrick provided testimony and evidence of the repeat
violation, as contained-in the -Village's ewdentia -ry case file which was accepted-into
evidence.
3. Based upon evidence and testimony presented, the Special Magistrate finds that the
property was in violation of Section 14-152 of the Code of Ordinances of the Village of
Tequesta from March 31, 2017 through April 20, 2017, a period of twenty-one (21) days,
and that the violation continues to exist.
4. This is a repeat violation of the same Village Code section(s) from an "Order Finding
Violation" dated April 1 1, 2016.
CONCLUSIONS OF LAW
Based on the above-stated facts, Respondent is in repeat violation of Section 302:8 of the
International Property Maintenance Code, incorporated in Appendix B of the Code of Ordinances,
Village of Tequesta, Florida.
ORDER
It is the Order of the Special Magistrate that a Fine of Two Hundred Ten Dollars ($210.00) is
h�reby assessed, at Ten D�llars ($1fl:00) p�r ctay, for the reFeat vi6lation whici� exist�ct on tfie
property beginning March 31, 2017 through April 20, 2017, a period of twenty-one (21) days, and the
fine amount shall continue to accrue at Ten Dollars ($10.00) per day until compliance is achieved.
Respondent is further assessed the Village's administrative costs in the amount of $188.48.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and, once recorded, shall constitute a lien against the property upon which the violation e�its
and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162,
Florida Statutes.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0506 to request a re-
inspection of the property.
