CALL TO ORDER AND ROLL CALL
The meeting was called to order at 5:30 p.m. by Board Vice-Chair Michael Schmidt. A roll
call was taken by Community Development Planner, Lance Lilly. Present were: Board
Chair Janet Strand, Vice-Chair Michael Schmidt, Board Member Elizabeth Schauer, Board
Member Steve Eagen, Board Member Ashley Warren, Alternate Member Leslee Dasher
and Alternate Member Theresa Maggio. Also present were Viilage Attorney Keith Davis,
Village Attorney Amity Barnard and Community Development Director Nilsa Zacarias.
APPROVALOFAGENDA
MOT/ON: Board Vice Chair Michael Schmidt moved approval of the agenda; seconded by
Alternate Board Member Elizabeth Schauer; motion carried unanimously 5-0.
1. Reorganization of the Board Pursuant to Sec. 22-52 Tequesta Code
• Elect Chair
• Elect Vice Chair
Village Attorney Amity Barnard informed the Board that the Reorganization needed to be tabled
until the May 18, 2017 meeting due to a date provision within in the code.
2. Approval of Previous Meeting Minutes
MOT/ON: Board Member Elizabeth Schauer moved approval of the minutes; seconded by
Committee Member Ashley Warren; motion carried unanimously 5-0.
3. VAR 04-17
Application from Gerald J. and Jill C. Wenta for a variance to construct an addition onto an
existing single-family structure in the R-1A zoning district; relief from Sec. 78-143 to allow
a front setback of 20.17 feet where the code requires a minimum of 25 feet. The address
of the property is 226 Golfview Drive, Tequesta, FL 33469.
Attorney Barnard announced that Vice Chair Michael Schmidt had a voting conflict
regarding VAR 04-17 and had requested to be recused from the case. Vice Chair Schmidt
left the dais and was not part of the proceeding.
Attorney Barnard announced that the next item, VAR 04-17, was quasi-judicial and swore
in several people involved with the application. She then asked the Board for any ex-parte
communications. Board Member Ashley Warren disclosed that she had texted Vice Chair
Schmidt regarding his involvement as the architect.

Mr. Gerald Wenta introduced himself and his wife, Mrs. Jill Wenta, as owners of the
property involved in the variance.
Alternate Member Leslee Dasher felt that the variance application did not meet the special
conditions required for approval. She felt that building a second floor or adding on
towards the back of the property would be a better option.
Mr. Wenta explained that because of the way the home was situated on the lot in
relationship to the bend in the road, the addition would infringe upon the current setback by
approximately 4 feet. He noted that homes on Country Club Drive, which were located
within the same zoning district, were able to build up to 25 feet of the road's edge. He
stated that the code only specified the zone, not the particular street where this was
applicable. Mr. Wenta further explained that this application had already been approved
by the Village, back in 2003, but had to be tabled due to a family tragedy. He shared that
the only way to accomplish the addition would be to increase living space at the front of the
house.
Community Development Director, Ms. Nilsa Zacarias, urged the Board to examine only
the portion of the architectural plan which was part of the variance application.
Alternate Member Leslee Dasher asked why properties on Country Club Drive were
permitted to be built 25 feet from the edge of the pavement. Ms. Zacarias answered that
the original plat from the 1950s showed the different setback and requirements.
Board Member Ashley Warren felt that this was a common problem within the Village as
there were quite a few homes with a small footprint. Alternate Member Leslee Dasher
countered in that a small home did not necessitate a special variance. Board Member
Ashley Warren stated that it did not seem as if the homeowners were asking for much and
that they were following all of the other rules.
Mr. Wenta stressed to the Board the fact that the proposed addition would still be forty feet
from the pavement edge whereas the homes on Country Club Drive were permitted to be
as close as 25 feet from the edge of the pavement.
MOTION: Board Member Elizabeth Schauer moved to approve VAR 04-17; seconded by
Steve Eagen; motion carried 4-01 with Board Member Leslee Dasher in dissent.

ADJOURNMENT: Board Member Elizabeth Schauer moved to adjourn the meeting;
seconded by Board Member Steve Eagen; The motion to adjourn carried unanimously 5-0;
therefore, the meeting was adjourned at 5:27 P.M.
