DAVIS ATTORNEY AT LAW Board Certified in City,County and Local Government Law MEMORANDUM TO: Mayor Brennan, Vice Mayor D'Ambra, Council Members Arena, Okun and Paterno CC: Manager Couzzo, Clerk McWilliams FROM: Attorney Davis DATE: June 20, 2017 RE: FOPS 9-11 Memorial The purpose of this Memorandum is to provide a means to memorialize the Village of Tequesta's handling of all maintenance and upkeep responsibilities for the FOPS 9-11 Memorial and Fountain located on Village Hall property. As you are aware, the Friends of Public Safety (FOPS), a non-profit corporation that was created for the purpose of fundraising to assist police and fire rescue personnel and their families in times of need, was originally responsible for planning, fundraising and bringing to fruition the existence of the Village of Tequesta's 9-11 Memorial located in front of Village Hall on Tequesta Drive. The Memorial, which includes a fountain as well as artifacts from the 9-11 terrorist attack on the former World Trade Center, requires regular maintenance and upkeep. Being permanently affixed to Village of Tequesta property, in all aspects, the memorial belongs to the Village of Tequesta. However, after a diligent search by the Village records custodian, there appears to be no documentation that shows formal acceptance of the Memorial by the Village, or the assumption of maintenance and upkeep responsibilities by the Village. This Memorandum requests the Village Council to officially accept the FOPS 9-11 Memorial and direct that Village personnel assume full responsibility for its maintenance and upkeep in perpetuity.
