Project Description: The Village of Tequesta(Village)has identified Pinetree Drive for drainage improvements to reduce localized ponding that occurs following rain events. The design is anticipated to include milling and overlay limits from Tequesta Drive,North on Pinetree to the Village limits, and milling and resurfacing (grade adjustments),curb, inlets,pipe, and a connection to an existing outfalI to reduce the localized ponding. Mock-Roos will perfonn services as outlined in B.Scope of Services below: B. Scope of Services: Task 1—Preliminary Design 1. Prepare a limited topographic survey from the centerline of Tequesta drive north to 5-ft beyond the right of way line. The field survey will extend from approximately 100-If east of Pinetree Drive to approximately 200-1f west of Pine Tree Drive and will contain sufficient detail to perform the design. Task 2—Design Phase Services 1. Prepare and submit a 95-percent contract document and Engineer's Opinion of Probable Construction cost progress set for the Village's review. 2. Prepare and submit 100-percent(final)contract documents to Village staff for use in bidding the project. Provide Village with two hard copies(100%contract documents)and an electronic copy of contract documents for Village's use. L:1mk1B7019.00\1s0I ggjh.docx.doc 3. Provide services related to coordination and quality control of the project and project deliverables. These services include general coordination with the City,its consultants and internal reviews of deliverables,schedules and project progress reports as necessary. Assumptions 1. The improvements are not anticipated to require a permit. C. Additional Services: 1. Any services not included in the Scope of Services will be considered Additional Services. 2. Any design changes,schedule changes,drawing changes,or other project changes requested by Client will be considered Additional Services. 3. Additional Services can be provided upon Mock-Roos receiving signed authorization from Client. 4. Additional Services resulting from the following can be provided without Client's authorization: 1) legal and/or regulatory requirements or changes,2)delays or price increase not in Mock-Roos control,3)emergencies or acts of God,4)threatened or endangered species,5)hazardous conditions,6)or any services required to protect the health,safety,and/or welfare of the public. D. Fees and Rates: 1. Mock-Roos will complete the Scope of Services for the lump sum fee of$17,620.00. 2. Mock-Roos can provide Additional Services at the Mock-Roos rates in effect at that time,plus any reimbursable expenses,or for an agreed upon lump sum fee. E. Conditions: 1. All terms become valid upon Mock-Roos receiving one complete copy of this proposal within 60 days of its date. 2. This proposal serves as a supplement to the general agreement between Mock-Roos and Client dated May 12,2016. 3. In case of discrepancies,the terms of this proposal supersede those of previous agreements. However, other labor classifications (and fees) based on the approved Master Agreement between Mock-Roos may be used to complete certain tasks on this project. In accordance with Sec. 119.0701, Florida Statutes, CONTRACTOR must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in the Proposal or Bid. Upon request from the Village's custodian of public records, CONTRACTOR must provide the Village with copies of requested records, or allow such records to be inspected or copied, within a reasonable time in accordance with access and cost requirements of Chapter 119, Florida Statutes. A CONTRACTOR who fails to provide the public records to the Village, or fails to make them available for inspection or copying, within a reasonable time may be subject to attorney's fees and costs pursuant to Sec. 119.0701, Florida Statutes, and other penalties under Sec. 119.10, Florida Statutes. Further, CONTRACTOR shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Proposal or Bid are not disclosed except as authorized by law for the duration of the Agreement term, and following completion of the Agreement if the CONTRACTOR does not transfer the records to the Village. Finally, upon completion of the Agreement, CONTRACTOR shall transfer, at no cost to the Village, all public records in possession of the CONTRACTOR, or keep and maintain public records required by the Village. If the CONTRACTOR transfers all public records to the i Village upon completion of the Agreement, the CONTRACTOR shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the CONTRACTOR keeps and maintains public records upon completion of the Agreement, the CONTRACTOR shall meet all applicable requirements for retaining public records. Records that are stored electronically must be provided to the VILLAGE, upon request from the Village's custodian of public records, in a format that is compatible with the Village's information technology systems.
