HomeMy WebLinkAboutMinutes_Special Master_05/22/2008VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES May 22, 2008 PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick. The hearing was called to order at 10:00 A.M. Code Enforcement Special Master Donlon approved the minutes of the April 24, 2008 Special Master Hearing as submitted. The following cases were heard by the Special Master: Fine Assessment Hearings Case No. 2008-00070 Candida Martinez 395 Riverside Drive Tequesta, FL 33469 PCN: 60.42-40-25-06-016-0090 Design criteria (Safety Triangle) Chapter 78 Article VII Section 78-257 The Respondent, Candida Martinez, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. The Code Officer also testified that the property was brought into compliance on May 2, 2008 through the Village using Rood Landscape, Inc. Conclusion of law was that Respondent, Candida Martinez, was, but is no longer in violation of Chapter 78 Article VII Section 78-257 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Candida Martinez, shall continue to comply with Chapter 78 Article VII Section 78-257 of the Code of Ordinances of the Village of Tequesta. Special Master Hearing May 22, 2008 Page 2 A fine of $95.00 is hereby assessed for the Village hiring Rood Landscape, Inc., to comply with the violation that existed. This amount is to be paid immediately. Respondent shall immediately pay the administrative costs of $288.75 that were assessed at the violation hearing. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Violation Hearings Case No. 2008-00064 Christopher T. Hill Michael Prinz 194 Golf View Drive Tequesta FL 33469 PCN: 602-40-26-01-000-3080 R1A (Parking) Violation The Respondent, Christopher T. Hill, who is the owner of the property, was not present at the hearing; however, there was a finding of proper notice. Michael Prinz, who is the owner of the vehicle, was present at the hearing and there was a finding of proper notice. Mr. Prinz testified at the hearing. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Code Officer also testified that the property was in compliance on May 7, 2008. Conclusion of law was that Respondent, Christopher T. Hill, was, but is no longer in violation of Chapter 78 Article IX Section 78-644,of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Christopher T. Hill, shall continue to comply with Chapter 78 Article IX Section 78-644,of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed $183.37 for administrative costs to be paid by the 2nd day of June, 2008. Special Master Hearing May 22, 2008 Page 3 Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Case No. 2008-00049 Terry Schroeder 7 Ridgewood Circle Tequesta FL 33469 PC N : 60-42-40-25-09-000-0300 Building Permits Chapter 14 Article VI Section 14-152 The Respondent Terry Schroeder was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Conclusion of law was that Respondent, Terry Schroeder, is in violation of Chapter 14 Article VI Section 14-152,of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Teny Schroeder, shall comply with Chapter 14 Article VI Section 14-152,of the Code of Ordinances of the Village of Tequesta by the 5th day of June, 2008. If Respondent does not comply within the time specified, Respondent shall be assessed a fine of up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will be held before the Special Magistrate on the 26th day of June, 2008, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta Florida. Respondent shall be assessed $197.66 for administrative costs to be paid by the 5th day of June, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. Special Master Hearing May 22, 2008 Page 4 A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Case No. 2008-00091 Giuseppe Loduca 91 River Drive Tequesta FL 33469 PCN: 60-42-40-26-01-000-0270 R1A (Parking} Violation Chapter 78 Article IX Section 78-644 The Respondent, Giuseppe Loduca, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. He also tested that this property was brought into compliance on May 12, 2008. Conclusion of law was that Respondent Giuseppe Loduca was, but is no longer in violation of Chapter 78 Article IX Section 78-644 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent Giuseppe Loduca shall continue to comply with Chapter 78 Article IX Section 78-644 of the Code of Ordinances of the Village of Tequesta Respondent shall be assessed $209.87 for administrative costs to be paid by the 2nd day of June, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. Case No. 2008-00078 Roger Farber 207 Fairway East Special Master Hearing May 22, 2008 Page 5 Tequesta FL 33469 PCN: 60-42-40-26-01-000-2310 Repeat Violation Prohibited Property Conditions Chapter 30 Article II Section 30-33 The Respondent, Roger Farber, was present at the hearing; and there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. The Respondent was in repeat violation from May 8, 2008 to May 21, 2008. Conclusion of law was that Respondent, Roger Farber, was, but is no longer in repeat violation of Chapter 30, Article I1, Section 30-33, of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent shall continue to comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed $212.37 for administrative costs to be paid by the 2"d day of June, 2008. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 2008-00074 Estate of Daniel Robillard Patrick Cicalese Esq. 140 Country Club Drive Tequesta FL 33469 PCN : 60-42-40-25-12-005-0010 Nuisance, Abandoned, Wrecked Vehicles Chapter 30 Article IX Section 30-331 The Respondent, Estate of Daniel Robillard, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer tested to and produced photographs of the violation. He also testified that this property was brought into compliance on May 6, 2008. Special Master Hearing May 22, 2008 Page 6 Conclusion of law was that Respondent, Estate of Daniel Robillard, was, but is no longer in violation of Chapter 30 Article IX Section 30-331 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Estate of Daniel Robillard, shall continue to comply with Chapter 30 Article IX Section 30-331 of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed $247.09 for administrative costs to be paid by the 2nd day of June, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Case No. 2008-00081 Classic Furnishings Vera Tegge Tequesta Investors Frank Banko NAI, Merlin, Hunter, Codman, Inc. Christina Yates 223 US Hwy 1 (Village Square] Tequesta FL 33469 PCN: 60-43-40-30-05-000-0901 Nuisance, Abandoned, Wrecked (Vehicles] Prohibited Property Conditions Chapter 30 Article IX Section 30-331 The Respondent, Tequesta Investors, was not present at the hearing; however, there was a finding of proper notice. The tenant Classic Furnishings testified at the hearing through James Cater. NAI, Merin, Hunter, Codman, Inc., and Christian Yates were present at the hearing. The Tequesta Code Enforcement Officer tested to and produced photographs of the violation. Special Master Hearing May 22, 2008 Page 7 Conclusion of law was that Respondent, Tequesta Investors, is in violation of Chapter 30, Article IX, Section 30-331 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Tequesta Investors, shall comply with Chapter 30 Article IX Section 30-331 of the Code of Ordinances of the Village of Tequesta by the 2"d day of June, 2008. If Respondent does not comply within the time specified, Respondents shall be assessed a fine of up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will be held before the Special Master on the 26~' day of June, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed $579.04 for administrative costs to be paid by the 2"d day of June, 2008. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 2008-00080 JMZ Properties John Zuccarelli 1 Main Street Tequesta FL 33469 PC N : 60-43-40-30-47-004-0000 Nuisance, Abandoned, Wrecked Vehicles Chapter 30 Article IX Section 30-331 This case was withdrawn by the Village of Tequesta. Case No. 2008-00074 Catholic Charities Norma Antedominico Hattie Siegel Special Master Hearing May 22,2008 Page 8 498 Dover Road Tequesta FL 33469 Repeat Violation Emergency Hearing Declaration of Nuisance (infestation) Chapter 30 Article 11 Section 30-32 The Respondent, Hattie Siegel, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. Respondent brought the property into compliance on May 21, 2008. Conclusion of law was that Respondent, Hattie Siegel, was, but is no longer in violation of Chapter 30 Article II Section 30-32 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Hattie Siegel, shall continue to comply with Chapter 30 Article II Section 30-32 of the Code of Ordinances of the Village of Tequesta.
