July 1, 2017 Ms. Nilsa Zacarias,AICP Community Development Director Village of Tequesta 345 Tequesta Drive Tequesta, FL 33469 Re: Austrade Office Building: Request for Extension to Variances Granted (Application VAR-02-17) Dear Ms. Zacarias: Please accept this letter as a formal request on behalf of Bartl Real Estate, LLC (the "Applicant"), for an extension to the variances granted by the Village Council on March 10, 2017 (the "Variances") for the Austrade Office Building (the "Project") by way of the attached Order of the Village Council (the "Order') for Application VAR-02-17. The Order contains a condition that states "The variance shall expire within six (6) months from the date of grant unless a building permit based upon and incorporating the variance is issued within the six-month period and construction has begun thereafter." Based on an original approval date for the Variances of March 10, 2017, the current expiration date for the Variances is September 10, 2017. Sec. 78-68 of the Village Code of Ordinances entitled Time limitation on variances states, in part, "The planning and zoning board or the village council, as applicable, may grant one six-month extension to any variance time limit upon written request of the applicant made prior to the expiration of the original time limit." As you are aware, the Applicant and Project team have been diligently pursuing site plan approval for the Project by the Village, and the Project is expected to be heard by the Village Council for final consideration of the pending site plan application at its August 10, 2017 meeting. In order for a building permit to be issued and construction commenced on the Project, the Applicant must prepare civil and vertical construction plans and secure the requisite civil and vertical construction permits from those applicable authorities having jurisdiction. The Applicant has commenced preparation of the civil construction plans and will be submitting permit applications to the appropriate agencies in the month of July 2017. Further, the Applicant will commence preparation of the vertical construction plans for the subject building pending and immediately upon approval of the Project by the Village Council. Given the timeframes noted above, it is anticipated that the first building permit for the Project that would incorporate the Variances approved (site work permit) would be issued around October-November of 2017. Accordingly, please accept this letter as a formal request for a six (6) month extension to the aforementioned September 10, 2017 expiration date for the Variances in order to provide sufficient time for the Project team to secure the necessary permits required for construction. ORDER APPROVING VARIANCE APPLICATION This cause came on to be heard upon the above application and the Tequesta Village Council having considered the evidence presented by the applicant and other interested persons at a hearing called and properly noticed, and the Tequesta Village Council, being otherwise duly advised, THEREUPON, THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA FINDS AS FOLLOWS: Page 1 1. The subject property is located in the C-2 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances for variance review. 3. The application and all supporting documentation and presentation materials as reviewed by the Village Council at its March 9, 2017 meeting,and as kept on file by the Village, are made a part hereof and are hereby incorporated by reference as Exhibit"A". 4. According to Section 78-61,variance approval by the Village Council is required. 5. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The application for Variance, Case No. VAR-02-17 with reference to the above described property within the Village of Tequesta, Palm Beach County, Florida, to allow construction of a new four story office building with a side setback of 20 feet where the code requires a side setback of 25 feet; and a rear setback of 10 feet where the code requires a rear setback of 15 feet; and with seven of the required off-street parking spaces being a width of 9.5 feet where the code requires all off-street parking spaces to have a minimum width of 10 feet; and a loading zone located in the front drive aisle where the code requires the loading zone to be located outside of all designated drive aisles; and a one foot wide landscape buffer on a portion of the site between the parking lot and the south side of the building where the code requires a four foot wide landscape buffer in the C-2 Zoning District in accordance with Exhibit "A" is hereby APPROVED since the Village Council hereby finds that the applicants have met the standards set forth in Section 78-65 of the Tequesta Zoning Code for variance approval WITH THE FOLLOWING CONDITIONS OF APPROVAL: 1. The Applicant shall at all times comply with all off-street parking requirements in terms of the number of required off-street parking spaces provided. 2.
