L DRAFT Planning & Zoning Board Sitting as the Local Planning Agency MEETING MINUTES August 17, 2017 CALL TO ORDER AND ROLL CALL The Village of Tequesta Planning & Zoning Board sitting as the Local Planning Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, August 17, 2017. The meeting was called to order at 5:44 p.m. Lance Lilly, Community Development Planner, who noted the following were present, took a roll call: Board Chair Janet Strand, Vice Chair Steven Eagen and Board Member Elizabeth Schauer, Board Member Michael Schmidt, Board Member Ashley Warren, Alternate Board Member Leslee Dasher, and Alternate Board Member Theresa Maggio. Also present were Village Attorney Amity Barnard, and Director of Community Development Nilsa Zacarias. APPROVAL OF AGENDA MOTION Board Member Dasher moved to approve the agenda as submitted. Board Member Schauer seconded the motion, which carried by unanimous 5-0 vote. 1. APPROVAL OF PREVIOUS MEETING MINUTES: June 15, 2017 MOTION Board Member Schauer moved to approve the minutes of the June 15, 2017 meeting as submitted. Board Member Dasher seconded the motion, which carried by unanimous 5-0 vote. 2. ORDINANCE NO. 16-17 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING; AT SECTION 78-4, DEFINITIONS. TO CREATE DEFINITIONS FOR THE TERMS "MARIJUANA," "MEDICAL MARIJUANA TREATMENT CENTER," "MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITY" AND TO REVISE THE DEFINITION FOR "RETAIL SALES AND SERVICE" TO EXCLUDE MEDICAL MARIJUANA TREATMENT CENTER AND MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITY THEREFROM; AT SECTION 78- 178, C-3 GENERAL COMMERCIAL DISTRICT, SUBSECTION (B) PERMITTED USES, TO CREATE AN ENTIRELY NEW NUMBER (20) PROVIDING REGULATIONS FOR THE LOCATION OF MEDICAL MARIJUANA TREATMENT CENTERS IN THE VILLAGE; AND AT ARTICLE IX, SUPPLEMENTAL REGULATIONS TO CREATE AN ENTIRELY NEW SECTION 78-307 BANNING MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN THE VILLAGE; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERASILfTY CLAUSE • . Planning & Zoning Board Sitting as Local Planning Agency MEETING MINUTES August 17, 2017 AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Village Attorney Amity Barnard explained that Ordinance No. 16-17 is an ordinance to regulate medical marijuana facilities. There are two different facilities, medical marijuana treatment facilities and medical marijuana dispensaries. Ms. Barnard furthered medical marijuana treatment centers would be located within the C-3 General Commercial District. Board Member Dasher mentioned that there were confusion about these types of facilities. Ms. Barnard provided clarification for Board Member Dasher's questions. Board Member Maggio asked if these types of facilities could be placed or used within a pharmacy. Ms. Barnard states that the Ordinance would ban medical marijuana treatment center dispensing facilities. Board Member Schmidt questions the purchase of a medical marijuana within the Village limits under this ordinance using a prescription. MOTION Board Member Schauer made a recommendation of approval for Ordinance No. 16-17; seconded by Board Member Dasher. Motion carried by unanimous 5-D vote. PUBLIC COMMENT None. BOARD COMMENT None. STAFF COMMENT Community Development Director Zacarias commented on a potential workshop for the upcoming Local Planning Agency (LPA) meeting. This workshop would be a presentation of the Comprehensive Plan and Florida Statutes. She briefly explains the process behind the approval of the Comprehensive Plan and how it is adopted.
