Date: October 20, 2017 �� � Ref.: First Council Workshop for the Evaluation and Appraisal Review (EAR) based amendments to the Village's Comprehensive Plan The purpose of the first workshop is to present the fundamentals of the Comprehensive Plan and related Florida Statutes. The subject workshop will address the Evaluation and Appraisal Review {EAR) based amendments to the Village's Comprehensive Plan. The Village's Comprehensive Plan is a critical document that provides the foundation for the Village's Land Development Regulation (LDRs) and the overall character and identity of the community. The LDRs must be consistent with the Goals, Objectives and Policies of the Comprehensive Plan. CommunitV Development conducted a first workshop with the Local Plannin� Agency (LPA) on September 14, 2017.A second workshop with the LPA is scheduled for November 16, 2017. Per Florida Statutes (F.S.), Chapter 163.3177 "the comprehensive plan shall provide the principles, guidelines, standards, and strategies for the orderly and balanced future economic, social, physical, environmental, and fiscal development of the area that reflects community commitments to implement the plan and its elements. These principles and strategies shall guide future decisions in a consistent manner and shall contain programs and activities to ensure comprehensive plans are implemented." Pursuant to Chapter 163.3191, F.S., local governments are required to evaluate their local comprehensive plan every seven years to determine if plan amendments are necessary since the last update of the Comprehensive Plan, and notify the State Land Planning agency as to its determination. In 2016, the Village of Tequesta determined it necessary to conduct a review and evaluation of its current Comprehensive Plan to reflect chan�es in state requirements, current Village's conditions, challen�es and future communitv trends. Previous EAR-based update to the Village's Comprehensive Plan was adopted in February 2009 (see attached Ordinance No. 16-08). The existing Village's Comprehensive Plan encompasses the following nine(9)elements: • Future Land Use • Transportation • Housing • Infrastructure • Coastal Management • Conservation • Recreation and Open Space • Intergovernmental Coordination • Capitallmprovement • Public School Facilities(Per F. S. this is an optional elementJ 1 The proposed Comprehensive Plan amendment is based on in depth review of each element including required legislation, demographics data, information that reflects existing Village's conditions, and future community trends. The subject Comprehensive Plan amendment also includes an update of the following map series: � Future Land Use � Existing Land Use • Transportation Map • Coastal Soii and Conservation • Soil • Flood Zone • Hurricane Surge This subject EAR-based amendment to the Village's Comprehensive Plan is subject to the State Coardinated Review process, pursuant to Section 163.3184(4), F.S. A summary of the approval process is outlined below: 1. After initial local hearings (Local Planning Agency and Village Council) approving the proposed amendments to the Comprehensive Plan, the Village is required to transmit the complete proposed plan amendment to the State Land Planning Agency. 2. Next, within 60 days of receiving the complete amendment proposal, the State Land Planning Agency issues an Objection, Recommendation, and Comments Report (ORC} to the local government. 3. The Village is required to hold a second public hearing to adopt the amendment to the Comprehensive Plan. 4. The complete adopted Comprehensive Plan amendment must then be submitted back to the State. 5. Finally, within 45 days of receiving the complete adopted plan amendment, the State Land Planning Agency issues a Notice of Intent to find the plan in compliance or not in compliance, which is posted on their website. Communitv Development has been workin� dili�ently on updatin� the existin� Comarehensive Plan and is lookin�forward to receivin� input from the Villase Council. As part of this process, we have received feedback from the Village's Legal Counsel, other Village's Department and a number of agencies such as the Department of Economic Opportunity,Treasure Coast Regional Planning Council, Loxahatchee River District and others. Please we would like to have a second workshop to provide proposed updates in December. The current Comprehensive Plan update includes the recent FEMA map that was effective on October S,2017. 2 ORDtNANCE NO. 16-08 AN ORDfNANCE OF THE VILLAGE COUNCII. OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING . ITS COMPREHENSIVE DEVELOPMENT PLAN TO AD�PT EVALUATION AND APPRAISAL ("EAR") BASED AMENDMENTS PURSUANT TO S�CTION 163.3191, FLOR/DA STATUTES, WHICH PROVIDES FOR A COMPREHENSIVE UPDATE TO ALL ELEMENTS; AFFECTING THE PAGINATION IN EACH AMENDEQ ELEMENT AND tNCLUDINC R�VISED TEXT AND MAPS NECESSARY TO UPDATE THE DATA AND ANALYSIS OF THE COMPREHENSiVE PLAN; PROVIDING THAT THE TEXT AND MAPS, AS AMENDED OR REVISED, SHALL BE SUBSTITUTED FOR AND REPI:ACE IN FULL THE EXISTING TEXT AND MAPS IN ALL AMENDED ELEMENTS; PROVtDING FOR TRANSMITTAL TO THE STATE LAND PLANNING AGENCY; PROYIDiNG A GONFLlCTS CLAUSE AND A SEVERABILfTY CLAUSE; PROVIDING AN EFFECTNE DATE; AND FOR OTHER PURPOSES. VVHEREAS, the Sta#e Legislature of the State of Florida has mandated that all rnunicipalities draft and adopt comprehensive development plans to provide thorough and cor�sistent planning with regard to land within their corporate limits; and WHEREAS, afl amendments to fihe comprehensive development plan must be adopted in accordance with detailed procedures which must be strictly foliowed; and WHEREAS, Section 163.3'[91, Florida Statutes, requires that local govemments review the adopted comprehensive pfan, in part, to respond to changes in locat, state and regional policies along with an analysis of the major issues necessary to further the community's goals consistent with statewide minimum standards; and WHEREAS, the Village Cauncil has adopted the final version of the required "Evaivatian and Appraisal Report" and #hat report was deemed sufficient by the Ftorida Department of Community Affairs on July 23, 2007; and WHEREA,S, the ViElage of Teques#a, Fforida, has carefully prepared an amendment to its comprehensive development plan to update it pursuant to Sec.163.3199, Florida Statutes, in order to provide text and map amendments or revisions in conformance with the adopted Evaluation and Appraisat report; and WHEREAS, the Village of Tequesta has held all duly required public hearings; both prior to submission of the propased amendments of the plan to the State Department of Community Affairs and after the proposed amendments of the plan were returned to the Village of Tequesta, in accordance with Chapter 163.3184, Flo►ida Statutes; and WHEREAS, the Village Council desires to adopt the amendments to the current comprehensive develapment plan to guide and control the fu#ure development of fihe Viilage, and to preserve, promote and protect the public health, safe#y and welfare. NOW, THEREFORE, BE IT ORDAfNED BY THE VILLAGE COUNCIL OF THE VILLAGE QF TEQUESTA, FLORtDA, THAT: Section 1: The �flage of Tequesta Comprehensive Plan is hereby amended by adopting these amendment to its current Comprehensive Development P{an; which amendments consists of 85 pages which are attached hereto as Exhibit �A" and made a patt hereof and of the current Comprehensive Develapment Plan. These amendments spec�cally provide comprehensive amendments to al! elemenfs of the Comprehensive Plan in conformance with the adopted Evaluation and Appraisat Report described therein. These amendments also affect the pagination of every amended element; a(i as specificalty set forth on Fxhibit"An. The text and maps adopted in Exhibit °A°shait be substituted for and replace in total the pceviously adopted text and maps in the amended elements. Section 2: A copy of the comprehensive development plan, as amended, shal! bs kept on file in the office of the�Ilage Clerk, Viliage of Tequesta, Flarida. Section 3: The Village Manager is hereby di�ected to transmit#hree (3) copies of the amendment to the current comprehensive development plan to the State Land Planning Agency, along with a copy to the Treasure Coast Regional Planning Council, and to any other unit of tocal gavernment who has filed a written request for a copy, within ten (10) working days after adoption, in accordance with Sec#ion 963.3184(7), Florida Statutes. Section 4: All ordinances or parts of ordinances in conflict be and the same are hereby repeated. Section 5: Should any sec#ion or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction #o be invalid, such decision shail not affect the Validity of the remainder of this Ordinance. Section 6: The effective date of this plan amendment shall be the date a final order is issued by the Department of Community Affairs or Administration Commission finding the amendment in compfiance in accordance with Se�tion 163.3184(1)(b), Florida Statutes, whichever occurs eariier. No development orders, development permits, or land uses dependent on this amendmer�t may be issued or commenc� before it has become effective. If a flnal order of noncomptiance is issued by the Administration Commission, this amendment may nevertheiess be made effective by adoption of a resalution affirming its effective status, a copy of which resolution sha11 be sent to the Department of Community Affairs, Divisian of Community Planning, Plan Processing Team. -3- Upon First Reading this 9t" day of October 2008, the foregoing Ordinance was offered by Council Member Humpage who moved its adoption.
