We have recently received notification his active military duty has been extended through September 30, 2018. Therefore, he will not be returning to the Village of Tequesta as Police Chief before its expiration. Chief Elg has requested that the Village of Tequesta afford him the difference between his two salaries until the expiration of his contract for personal reasons (see attached emails). Chief Elg has estimated the cost to be $22,000.00. I have asked our Finance Director Chris Quirk to identify the Village of Tequesta contractual obligation costs through the end of#he employment contract as it exists today (see-attached email). I feel it would be in the best interest of the Village of Tequesta to approve the $22,000.00 request contingent on signing of an early separation agreement. This will afford us the opportunity to correct the current Police Department administrative arrangements. At present we have several key staff positions working in acting roles and i feel that administrative decisions are being made tentatively. I was not surprised when I found out you were being asked to fill in for Mr. Couzzo to keep the Village running smoothly during his absence. One only has to look what you did as Fire Chief for the Village of Tequesta. I was about to reach out to Mr. Couzzo with a request when I was advised of his sudden medical incident and subsequent absence. I then contacted Merlene Reid and she suggested to wait until the Council decided what they were going to do with the temporary appointment. I wanted to give you at least week before reaching out to you. I have a request that I would respectfully ask for you to consider. While I did not anticipate having to make this request I find that two things have occurred that necessitate it at this time. I have been extended for at least one more year on active duty through September 30, 2018. The Coast Guard decided they would move my position from Florida to DC efFective October 1st which means I lose a significant amount of per diem as I am not considered to be on temporary duty any longer (this was not expected). The government would pay to move my family to DC for the year but that makes no sense for several reasons. The main reasons bein� the following: 1. It is only a one year assignment (and I have no intention of remaining in the DC area). 2. Our three children currently attend some great schools in Florida which can't be replicated here. 3. All of Langley's doctors and treatments are there in Florida. I find myself making the fallnwing request based on these circumstances and in particu{ar Langley's current medical condition. Tequesta has been a very strong supporter of the military which has been extremely evident during my almost five years with the Village. I would like to ask the Village of Tequesta for consideration of continuing my salary for the remaining 3 1/2 months until my contract expires (February 3, 2018) minus the difference of my military pay. This would allow my family to have the necessary support to 2 remain in Florida and continue with Langley's treatments. Our original plan was to allow Rose ta go back to work part time but that was before Langley was diagnosed with cancer. While we are praying for a great outcome and a ciean bill of health, the doctors are saying it will not be until after the first of the year at the earliest that he may be permitted to go back ta school (which would allow Rose to seek employment). After checking with several police chiefs in Palm Beach County it seems to be a pretty common practice to continue an officer's salary while away on military duty (in some cases their full salary). T am only requesting consideration for the difference in my salary and what the military pays me and only until my contract ends with the Vilfage. I never expected fo make this request (and wish I didn't need to) but then I never imagined that one of my children would be undergoing the treatment that he is either. T hope what I have been able to accomplish for the Village of Tequesta since coming aboard in February 2013 has earned me the opportunity to at least make this request on behalf of my family. The question has now arisen as to whether or not Chief Elg continues to accrue leave while on active military service. Secs. 115.09 and 115.14 F.S. provide for leave of absence for municipal employees for "active military service" (which includes active duty with any branch of the Armed Forces, including the Coast Guard). The first 30 days of this leave are with full pay. In addition,the statutes provide that the employing authority shall continue to provide all health insurance and other existing benefits to such employees as required by the federal Uniformed Services Employment and Reemployment Rights Act. The above referenced federal law defines "benefit" as "terms, privileges or conditions of employment, including any interest that accrues by reason of an employment contract or an employer's policy or practice." Based on the above, it is my opinion that IF the Chief would be accruing leave if he was still here as opposed to being on active military service, THEN yes, it still accrues. The question is that since the Chief has advised that his service with the Village will conclude on February 3, 2018 (the conclusion of the term of his current contract), would there still be leave accrual happening despite the upcoming conclusion of the contract (either based on the contract itself, or a personnel policy or a practice that has been imposed in the past? The bottom line is that the accrual of leave should be handled as though the Chief was still here at the Village. The fact of the active military service does not work to stop accrual of leave that would otherwise accrue. Keith W. Elg and the Village of Tequesta, Florida, Christopher L. Elg hereby makes his electian regarding participation in the Village's health insurance program: I hereby elect to participate in the Village's health insurance program which includes hospitalization, life, major medical and other related inswrauce for me and my dependants as may be provided by the Village for its employees in accordance with Village of Tequesta persannel policies. � I hereby elect to opt out of participation in the Village's heal#h insurance program as described above and in Section 8 of the Employment Agreement, and instead accept a $500.00 monthly insurance allowance with which I agree to obtain my own health insurance coverage. It is agreed and understood that this etection also affects Section 3A of the Employment Agreement by providing for an insw�nce allowance in accordance with the terms of this election,as opposed to praviding actuaI insurance coverage, until I am re-ernployed,or up to a maximum of six months imcnediatety following termination,whichever occurs first.
