Chief Elg & Assistant Chief McGrew,
Please accept this letter as my formal notice of resignation from the Tequesta Police
Department. My last day wiil be November 1 1, 2017 as the current payroll ends that
night. I appreciate your support during my tenure here. I take with me the valuable
experiences i have gained over the last six years. It has been a pieasure working with
you and ail the remaining officers. I wish the Tequesta Police Department all the best. If t
can be of any help during the transition, please don't hesitate to ask.
In closing, I would ask that my partner, K9 Boss, be retired out of service with me on
November 1 1, 2017. Over the last four years, K9 Boss has been a dedicated officer to
this agency and has helped out on several different occurrences. However, with that
cornes several concerning issues. For the last four years, K9 Boss has been assigned to
me and has become comfortable in his own ways. K9 Boss is used to living with a single
handier without a family or pets. K9 Boss can be very aggressive at times as he is trained
in bite work. K9 Boss has shown this extreme aggression by biting me in the face which
required several stitches and apprehending other resisting suspects who aiso required
medical attention. Most recently, i have had to relocate boarding to a new facility
where K9 Boss doesn't come in contact with peopie due to his aggression. I believe
there are extreme risks of danger putting K9 Boss with a new handier this late in his
career / life. I respectfuily request to remain with K9 Boss as I am the only one familiar
with him and am the only one who can handle him.

Subject: Retirement of K9 Boss
Tequesta Police Department's current K-9 officer, Corporal Michael
Valerio, has accepted a patrol officer position with the Palm Beach
Gardens Police Department. Corporal Valerio's final day of
empioyment with the Tequesta Police Department will be November
11, 2017.
In Corporal Valerio's resignation letter, he requested his K-9 partner,
Boss, to be retired. K-9 Boss has only lived with Corporal Valerio and
Corporal Valerio has been K-9 Boss' only handler. After K-9 Boss'
retirement, I suggest donating K-9 Boss to Corporal Valerio.

To Whom it May concern.
Re: K-9 Boss of Tequesta Police Department
I, Irene Howcroft, am a certified Master Trainer,and owner/operator of Ruidoso Malinois,specializing in Belgian
Malinois and have 35 years experience with working dogs.
I have been apprised of K-9 8oss and his handier Officer Michael Valerio. K-9 Boss and Officer Valerio are a strong
and committed team who have successfu!!y completed many missions including 2 apprehensions of vioient
suspects.
Belgian Malinois,as a breed, deveiop exceptionally strong relationships with their handlers, more so than any other
working dog breed and generally do not transition well to new handlers. In addition, K-9 Boss is now 5 and a half
years old thus having only 2 and a half more years of service. He would lose 6 months of this 2 and a half years as
he would need to bond with a new handler and also go through another handler schooi. No law enforcement
agency will want such an old dog as he will then be 6 years of age. Furthermore K-9 Boss is NOT social,he does not
accept other people into his"pack", in his mind his pack is himself and officer Valero only. K-9 Boss has a history of
being significantly aggressive to others, he cannot even be boarded in a normal manner but needs to be housed at
a facitity with a remote door so that he can go in and outs+de with no direct contact with the boarding facility staff.
He is siill suspitious of Officer Valerio's room-mate whom he has known for some time. K-9 Boss has a very
experienced and competent handler(single, no wife or children)who understands him,whom he trusts and to
whom he is exceptionally loyal. K-9 Boss is not a candidate for, and does not qualify as a K-9 for transition to
another handler or another agency. He would be a strong liability. No Agency would want a K-91ike this by virue of "
both age and especially because of his temperament,even if donated.
K-9 Boss does have a very strong,stable and calm relationship with officer Valerio and it is in the interests of both
K-9 Boss and Officer Valerio that K-9 Boss is retired and lives out his retirement years with Officer Valerio. K-9 Boss
has served his agency with hard and sutcessful work as a narcotics detector dog and great courage as a patroi dog.
He has earned his retirement.

VILLAGE OF TEQUESTA
HOLD HARMLESS AND INDEMNIFICATION AGREEMENT
FOR TRANSFER OF OWNERSHIP OF K-9 OFFICER "BOSS" FROM
THE VILLAGE OF TEQUESTA TO CORPORAL MICHAEL VALERIO
THIS HOLD HARMLESS AND INDEMNIFICATION AGREEMENT FOR
TRANSFER OF OWNERSHIP OF K-9 OFFICER "BOSS" FROM THE VILLAGE
OF TEQUESTA TO CORPORAL MICHAEL VALERIO, hereinafter the "AgreemenY',
is entered into and effective this _ day of November 2017, by and between the VILLAGE
OF TEQUESTA, a Florida municipal corporation with offices located at 345 Tequesta Drive,
Tequesta, Florida 33469, hereinafter "the Village"; and CORPORAL MICHAEL ANTHONY
VALERIO, an individual and a Corporal with the Village of Tequesta Police Deparhnent, whose
address is 1014 Sanctuary Cove Drive, West Palm Beach, Florida 33410, hereinafter
"Valerio"; and who are collectively referred to herein as "the Parties".
WITNESSETH
The Parties, in consideration of the mutual covenants contained herein and for other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the
Parties, hereby agree as follows:
1. TRANSFER OF OWNERSHIP: The Village Council has previously taken action by the
adoption of Resolution 55-17 (attached hereto as Exhibit "A") to declare the Village's
police K-9 Officer "Boss" as surplus property and to authorize the Village Manager to
proceed accordingly. As such, the Village hereby transfers ownership of K-9 Officer"Boss"
to Valerio as of the effective date of this Agreement. Likewise, Valerio hereby accepts
ownership of K-9 Officer"Boss" as of the effective date of this Agreement.
2. RESPONSIBILITY FOR CARE: Valerio accepts full responsibility for all daily care as
well as long term care for K-9 Officer "Boss." This shall include, but not be limited to:
bathing, grooming, exercise, feeding, veterinary care, medications and kennel maintenance,
all as needed, as well as future arrangements for euthanization, funeral and burial; and
including all expense and cost associated with all of the above responsibilities.
HOLD HARMLESS AND INDEMNIFICATION AGREEMENT FOR K-9 OFFICER BOSS
3. HOLD HARMLESS AND INDEMNIFICATION: Valerio hereby agrees to and in fact
does release, waive, and discharge the Village, including the Village's officers, employees
and agents; and covenant not to take any action in law or equity against the Village,
including the Village's officers, employees and agents, regarding any and all known and
unknown issues, medical or otherwise, related directly or indirectly to the condition of K-9
Officer "Boss." Further, Valerio hereby agrees to and in fact does indemnify and hold
harmless the Village, including the Village's officers, employees and agents, from any and
all liability for any loss or damage to property, and for any personal injury or death, and for
any claims for same which may be made by Valerio or by any third party, that may arise
directly or indirectly out of Valerio's ownership of K-9 Officer "Boss" or that may arise
directly or indirectly from the actions of K-9 Officer "Boss" or that may arise directly or
indirectly from the intentional or negligent actions of Valerio related to his ownership and
care of K-9 Officer "Boss." Valerio hereby agrees to and in fact does assume full
responsibility for any risk of bodily injury, death or property damage to himself and his
properiy, due to the actions of K-9 Officer "Boss" and/or the intentional or negligent actions
of Valerio related to his ownership and care of K-9 Officer "Boss." It is agreed and
understood by the parties that upon the effective date of this Agreement, the Village shall
have no further responsibility whatsoever related to the care or the actions of K-9 Officer
"Boss" and that all responsibility therefor which the Village may have previously had shall
be solely that of Valerio.
4. TERM; TERMINATION: This Agreement shall remain in full force and effect for the
entire remaining lifespan of K-9 Officer "Boss" and until the death and interment of K-9
Officer "Boss." Upon the death and interment of K-9 Officer "Boss," this Agreement shall
automatically terminate. The Parties further agree that this Agreement shall remain in full
force and effect until the death and interment of K-9 Officer "Boss" even if Valerio
subsequently transfers ownership of K-9 Officer "Boss" to a third party while K-9 Officer
"Boss" is still alive. The Parties further agree that this Agreement shall not be subject to any
form of early termination.
5. BINDING AGREEMENT: This Agreement shall be deemed to constitute a contract made
and entered into under the laws of the State of Florida, and not a mere recital. This

Agreement shall not be filed with a court unless it is necessary to enforce any term or
condition of this Agreement.
6. AMENDMENTS & ASSIGNMENTS: This Agreement, and all E�ibits attached hereto,
constitutes the entire agreement and understanding between the Parties; no modifications
shall be made to this Agreement unless in writing, agreed to by the Parties, and attached
hereto as an addendum to this Agreement.
IN WITNESS WHEREOF, the Parties hereto have executed this Agreement the date and
year first above written.

Subject: Resolution . to Declare K-9 Boss surplus
This memo is in reference to Resolution 56-17,for the Village Council of the Village of Tequesta,
to declare certain property surplus. It is recommended that the Tequesta Village Council
declare K-9 Boss surplus. It is also recommended to donate the surplus property to Michael
Valerio in a manner consistent with the Village's adopted procedures.
RESOLUTION NO 55-17
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, DECLARING CERTAIN PROPERTY TO BE
SURPLUS AND DIRECTING THE VILLAGE MANAGER TO DONATE OF
SURPLUS PROPERTY IN ACCORDANCE WITH THE VILLAGE'S
ADOPTED PROCEDURES; PROVIDING FOR SEVERABILITY;PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Village Council of the Village of Tequesta, Florida, established
procedures for disposing of surplus Village property; and
WHEREAS,the Village of Tequesta owns K9-Boss dog;
WHEREAS, the Village Council declares the property to be surplus and the Village
Manager to donate of the surplus property to Michael A. Valerio in accordance with the
Village's adopted procedures; and
WHEREAS,the Village finds that this Resolution will promote the health, safety and
welfare of the Village
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta, Florida, hereby declares
K9-Boss dog to be surplus and directs the Village Manager to donate of the surplus property
to Michael A. Valerio in a manner consistent with the Village's adopted procedures.
Section 2: All resolutions or parts of resolutions in conflict herewith shall be and
hereby are repealed.
Section 3: This Resolution shall talce effect immediately upon passage.
