The purpose of this memorandum is to briefly review legal services furnished by Jones,
Foster, Johnston & Stubbs, P.A. in July 2007.
The following matters were generally addressed in July:
1. Dallack litigation. Review limited communications related to status of this
matter before the appellate court and possible appeal by Mr. Dallack to the US
Supreme Court.
2. Utility ordinance review. Meeting and phone discussions with special utility
counsel John Jenkins regarding his review of legal questions associated with a 1999
ordinance relative to residential water service. Review of draft report by Mr. Jenkins'
law firm and related legal issues. Limited discussions with Village Council Members
regarding the review. Limited discussions with Village staff.
3. Code enforcement. There have been limited communications regarding a code
enforcement proceeding which is the subject of a scheduled Executive Session.
Litigation was initiated by the property owner and such matter is temporarily on hold.
4. Jupiter / Teguesta Emergency Interconnect Agreement. There have been
limited communications relative to the terms and conditions of a final interconnection
agreement with Jupiter relative to potable water service. The agreement was approved
by Tequesta in June and was just approved by Jupiter in early July. The final
agreement is now being circulated for final signatures.
5. Ongoing matters. During July this Firm attended to various ongoing issues
including:
a. Preparation for and attendance at July Village Council meeting;
b. Research issues re Council, public records law;
c. Multiple communications;
d. Preparation and attendance at meetings re utility ordinance review;
e. Review multiple draft personnel policies prepared by staff.
6. Charter Review. John C. Randolph of the Firm has participated in preliminary
discussions relative to the Charter Review which the Village Council previously
voted to undertake. This effort is ongoing.
