Canine Contract & Warranty
1. Tequesta Police Department (FL) agrees to purchase and High Drive K-9, Inc. agrees to sell
one (1) Police Service Dog for the agreed price of $10,500. In addition, Tequesta Police
Department and High Drive K-9 agree, that the buyer will attend the High Drive K-9/ FDLE
Patrol Academy (480 hours) and Narcotics Academy (240 Hours), totaling 720 Hours. Both
parties agree, that the cost of the Patrol Academy will be $5,000 and Narcotics Academy will
be $3,000, totaling $8,000. Costs totals $18,500. Both parties agree that $10,500 will be Due
with signed contract immediately and remaining balance of$8,000 DUE upon receipt of Dog.
2. The purchasing party has five (5) days to have the canine medically evaluated by a licensed
veterinarian. All dogs sold by High Drive K-9, Inc. have been examined prior to shipping and are
found to be in healthy and free of hip and elbow dysplasia. We guarantee the canine will be
able to obtain an OFA normal hip and elbow rating at the time of purchase. If a quality
radiograph taken by qualified veterinarian was submitted to OFA and the dog fails to obtain an
OFA passing rating, High Drive K-9 will replace the canine. Any injury, illness or death, including
but not limited to heat stroke, broken teeth or bones or adverse reactions to drugs, vaccines or
anesthesia given by your veterinarian during your time of ownership WILL NOT be covered in
this contract and will void the warranty. Any surgeries or medical procedures performed by a
veterinarian without notification to High Drive K-9, Inc. in writing will void the warranty.
3. If the canine does not pass examination, High Drive K-9, Inc. reserves the right to have the
canine examined by an independent third party licensed veterinarian. If the veterinarian
determines injury or illness as the cause, or the canine does pass on re-examination, this sale
will stand.
4. High Drive K-9, Inc. offers a 6 month health guarantee on the canine. Health is defined into
two categories, skeletal and genetic. Skeletal: Hips, Elbows and Spine Genetic: Any genetic
disease that precludes the canine from performing the tasks of a Police Service Dog. Illness or
Injury to the dog while in your care is not covered by this warranty.
5. We also offer a One (1) Year workability guarantee on Police Service Dogs. To clarify, if the
canine is found not to possess the drives or temperament for police service work, or if there is a
problem that cannot be corrected by our staff, then the canine will be replaced. This DOES
NOT apply if the canine has been abused or neglected while under the care of your agency as
determined by High Drive K-9, Inc. No dog will be replaced that are found to be handler
aggressive. High Drive K-9, Inc. reserves the right to have the canine evaluated by an
independent canine trainer or licensed veterinarian to validate all claims.

6. If replacement becomes necessary for health or workability, High Drive K-9, Inc. has sixty (60)
days to acquire a suitable canine for your needs. After forty-five days, if we are unable to
locate and replace, you may request a full refund of the original purchase price. Any and all
shipping costs is at the buyers' expense.
7. This contract contains the entire agreement between parties, governed by the laws of
Broward County, FL. All terms and conditions to this contract shall be binding on the heirs,
administrators, personal representatives and assigns of the owner. Any controversy or claim
arising out of or relating to this contract, or the breach thereof, or as the result of any claim or
controversy, involving the alleged negligence by any party to this agreement, shall be settled by
arbitration. The arbitrator shall as part of his/her reward, determine an award to the prevailing
party of the costs of such arbitration and reasonable attorney's fees of the prevailing party.
"Guarantee is VOID if the veterinarian examination is not complete within five (5) days of
purchase"
"Guarantee is VOID if payment is not received within 5 days in receipt of Dog"
8. The buyer, handler and agency shall assume any and all civil and criminal liability that may be
incurred due to the actions of the canine.
9. There will be no replacements on replacement dogs.
10. This warranty is binding by signatures below.
11. Upon the delivery of the canine, the buyer, to the best of his ability, will examine the dog
clearing him from obvious signs of illness or injury, I.E. lameness or broken teeth.
12. Any medical or workability issues must be submitted in writing.
13. If the Handler fails the MILE Patrol Academy or Narcotics Academy due to inappropriate
behavior, disrespectful behavior, failure of policies and rules, failure of handler's respective
agency general orders or operating procedures, criminal behavior, mistreatment of canine
partner, handler quits or upon the recommendation from the High Drive K-9 Head Trainer, the
agency will not be reimbursed for any training costs.
14. High Drive K-9 Owner Fx Head Trainer will finalize and maintain all K-9 Academy start dates E!
times. As always, High Drive K-9 will work diligently to accommodate the needs and schedules of
the Tequesto Police Department.

1. INSPECTOR GENERAL: Pursuant to Article XII of the Palm Beach County Charter,
the Office of the Inspector General has jurisdiction to investigate municipal matters, review
and audit municipal contracts and other transactions, and make reports and recommendations
to municipal governing bodies based on such audits, reviews, or investigations. All parties
doing business with the Village shall fully cooperate with the inspector general in the exercise
of the inspector general's functions, authority, and power. The inspector general has the power
to take sworn statements, require the production of records, and to audit, monitor, investigate
and inspect the activities of the Village, as well as contractors and lobbyists of the Village in
order to detect, deter, prevent, and eradicate fraud, waste, mismanagement, misconduct, and
abuses.
2. PUBLIC RECORDS: In accordance with Sec. 119.0701, Florida Statutes, High Drive K-
9, Inc. (the Contractor) must keep and maintain this Agreement and any other records
associated therewith and that are associated with the performance of the work described in the
Proposal or Bid. Upon request from the Village's custodian of public records, the Contractor
must provide the Village with copies of requested records,or allow such records to be inspected
or copied,within a reasonable time in accordance with access and cost requirements of Chapter
119, Florida Statutes. A Contractor who fails to provide the public records to the Village, or
fails to make them available for inspection or copying,within a reasonable time may be subject
to attorney's fees and costs pursuant to Sec. 119.0701, Florida Statutes, and other penalties
under Sec. 119.10, Florida Statutes. Further, the Contractor shall ensure that any exempt or
confidential records associated with this Agreement or associated with the performance of the
work described in the Proposal or Bid are not disclosed except as authorized by law for the
duration of the Agreement term, and following completion of the Agreement if the Contractor
does not transfer the records to the Village. Finally, upon completion of the Agreement, the
Contractor shall transfer, at no cost to the Village, all public records in possession of the
Contractor, or keep and maintain public records required by the Village. If the Contractor
transfers all public records to the Village upon completion of the Agreement, the Contractor
shall destroy any duplicate public records that are exempt or confidential and exempt from
public records disclosure requirements. If the Contractor keeps and maintains public records
upon completion of the Agreement, the Contractor shall meet all applicable requirements for
retaining public records. Records that are stored electronically must be provided to the Village,
upon request from the Village's custodian of public records,in a format that is compatible with
the Village's information technology systems.
