The Viilage has an adopted policy which sets out the prflcess and requirement� for
abandonment of a Viliage right-ofi-way. The policy is attached as back up far your

The owner of the lan� adjacent to the aliey assaciated with tl�e propc�sed "Pelican
S�uare" development has applied for aban�onment of a portian t�f t�e alley�ray within
the area of the proposed deveioprnent. For yr�ur review is attached #he February 9,
2018 formal r�quest firom AEec Dickerson, albio tt�e prc�perty owner, as weli as }etters
from reievant utility praviders that have an interest in the alley fior utiiity purposes.
Finally, a letter from #he owner c�f the praperty proposed for the c#eveloprnent dated
Febr�.�ary 22, 2098, which further discusses the alley abandonment request, is included
for your review.
Should the ViNage Council be of a mind to approve the request, the appropriate resalu-
tion and advance advertising can be completed for final Council action at the Ap�il 12,
2018 Village Council meeting.

TITLE: Procedures for Appticarion for Abandonment of dedicated Pt�blic
Property Within the Village of Tequesta.
OBJECTIVF,: This policy supersedes and amends Administrative Poticy No. 1 —
90/91, adopted 1Vovember 1, 1990. To establish clear
regulations and written procedures for the processing of
applications for the abandonment of dedicated public property
within the Village of Tequesta.
RESP4NS16ILI1'Y: The Dixector of Community DevelopmenE shall be responsible for
the administraEion of Ehis Procedure. The Village Attorney shall
, be responsible for the legal acivertising of the Public Hearing, the
preparation of the appropriate Resolution for the Village Council
and necessary follow-up based on CounciL action as set forth in
Ehe Procedures. The Vilfage Clerk shall be responsible for
providing a copy of the Resofution lo the appropriate officials as
set forth in the f'roceciures. The Director of Finance shall be
responsible for proper handling of aII fees.
PROCEUURE: I. In itiation
A. Meeting before formal filing of application with Department
of Public Wocks, Department of Community Development
and others, as necessary,to answer questions and/or identify
are�s of concern.
B. Letter of application to the Director of Comrnunity
Development by applicant(s) or authocized representative
(Power of Attorney required, if repi�esentative), which
includes the following:
l. Complete reason for abandonment request to be
stated.
2. Check made payable to the Village of'Fequesta in the
amount of $500.00 to eover direct costs and
processing by the Viilage.
C. Exhibits legibly drawn ko scale and documentation sufficient
in scope to show:

I. Area to be abandoned (plus complete legal
description). '
2. Abutting property owners (names and addresses}.

request your revie���of the appticant's proposal to abandon an existing altey that runs between the properties
located at 691 US 1, 19626 US 1,3486 Canal Ct,3471 Inlet Ct. Ali of t.he mentioned properties are located in
the Village of Tequesta.
As you are aware,the applicant is proposing a small scale infitl mixed use development that will aid in buffering
the adjacent residents, in addition to providing the Village nf Tequesta a dypamic project that will �rovide
consistency with the surrounding uses,and the opportunity to promote pedes�rian walkability. The applicant's
complete development proposal is provided below:
]}a small scale land use i7�ap amendmenl to Nfixed Use;
2}a zoning map amendment to Mixed Use;
3}a site plan for 19 multifaznily units,and 6,SOOsf of uffice;
4}a request for an alley aba�ldonment.
Ln order to bring the above development program into fruition, the applicant wi!] first need approval from the
Village Council for the alley abandonment. Please note, this discussion was tl�e topic of a conceptual
presentatiai hearing on December 14, 2417, aud the generai consensus of the Village Council was of positive
support for the applicant's proposal(inclusive of the aliey abandanment).
Jus#ification for Alley Abandonment:
Over the last few years, the applicant has diligentIy researched the housing market in tlze Village of Tequesta,
and has determined that the current market trends are ripe ta offer a well-designecf mixed use product that
provides a modest approach to growth zn the area. As 'I'eyuesta continues to distinguish itsetf as a premier
destination in northem Paim Beach County for locals aud visitors alike, the applicant zs excited to bring this
project to into consideration'for the Village Council's approval. However, before a site plan is ftuther
developed,the applicant needs approval on the existing aliey that runs through the property.
Currently,the pc��ion ofthe"alley"subject to the abandonmeni request isn't functioning,as it is barricaded on
both the north and south sides(CanaI Ct.and Inlet Ct.) of the property preventing any type of access tluough
the site. Additionally the constructed "functioning"portions of the aliey to the narth and south of the subject
properties are being used far overtlow parking, and don't necessarily protect the public interesk in terms af
safety.
