AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING CHAPTER 74. UTILITIES. AT
ARTICLE II. WATER SERVICE. AT DIVISION 2. RATES AND CHARGES.
BY AMENDING SECTIONS 74-68, 74-72, 74-73, 74-74 AND 74-79 TO
PROVIDE FOR UPDATED LANGUAGE REGARDNG UTILITY SECURITY
DEPOSITS, CPI INCREASES, WATER RESTRICTION SURCHARGES
AND SURCHARGES OUTSIDE CORPORATE BOUNDARIES; PROVIDING
THAT EACH AND EVERY OTHER SECTION AND SUB-SECTION OF
CHAPTER 74. UTILITIES. SHALL REMAIN IN FULL FORCE AND EFFECT
AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A
SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Village Council desires to update its utility regulations in orderto be
consistent with changes in the law and for consistency with its rate resolution; and
WHEREAS, the Village Council believes this ordinance to be in the best interests of
the Village of Tequesta.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: Chapter 74. Utilities. of the Code of Ordinances of the Village of
Tequesta is hereby amended at Article II. Water Service. by revising Sections 74-68, 74-
72, 74-73, 74-74 and 74-79; providing that Sections 74-68, 74-72, 74-73, 74-74 and 74-79
shall hereafter read as follows:
DIVISION 2. RATES AND CHARGES
Sec. 74-68. Security deposit.
There shall be a security deposit as established by resolution of the Village Council and on
file in the Village Clerk's office for each account, to be paid at the time of application for
water service. The security deposit is intended as security for payment of any final bill prior
to disconnection. The security deposits may be credited to the accounts of customers with
good navment records by policy established by the Villaae from time to time, or otherwise
shall be credited to the account when it is closed In computing the final bill for an account,
any outstanding teeter security deposit shall be credited to that account and the remaining

balance, if anv. after being credited toward the final bill shall be returned to the customer.
The deposit will get bear interest at the prevailing rate and shall be credited to each
account at regular intervals. all as determined by the Village
Sec. 74-72. Automatic annual rate adjustment.
The Village adopts annually, effective with bills rendered on and after October 1, 2010, and
each year thereafter, an automatic annual index rate adjustment to be applied to all of the
rates, fees and charges as contained in this division- including the minimum monthly
service charge and quantity charge which are immediately in
effect prior to the application of such annual index rate adiustment

The rates, fees, and charges which are adjusted for the
application of the annual index adjustment shall be rounded to the nearest

Price Index =The index adiustment factor to be applied to the monthly rates, fees and

OC = The Fiscal Year operating expenses for the most recently completed Fiscal Year
PW = The cost of water purchased during such fiscal vear
CPIF = The CPI Factor defined as the percentage change in the Consumer Price
Index published by the Bureau of Labor Statistics Southeastern Regional Office as of Mav
of each and every vear.
RRF =5.0% to allow for increased costs associated with funding renewal and
replacements.
MOR = The Fiscal Year revenues derived from the monthly service charaes, which
includes the Base Facilities Charges and the Quantity Charge for the most recently
completed Fiscal Year.
Sec. 74-74. Water restriction surcharge adjustment.
If the South Florida Water Management District or other authority having jurisdiction
declares a water shortage requiring mandatory curtailment or imposes guidelines to be
followed which result in +^ ~~° °~*^^~ ^f a 15 percent reduction in water usage at minimum,
the consumption charges listed in this division shall be increased 18 percent. If a reduction
of water use in excess of 15 percent is required or such a guideline is imposed, the Village
Council may establish by use resolution an appropriate surcharge based upon a
recommendation of the village manager as to the revenue required to comply with debt
service covenants or to meet other requirements of the water system.

Sec. 74-79. Surcharge for consumers outside village.
(a) .The schedule of rates and charges for water services furnished
to consumers outside the corporate limits of the village

improvements and maintenance costs, as authorized by the state legislature. T~+S

Section 2: All Ordinances or parts of Ordinances in conflict be and the same are
hereby repealed.
Section 3: Should any Section or provision of this Ordinance or any portion
thereof, any paragraph, sentence orword be declared by a Court of competent jurisdiction
to be invalid, such decision shalt not affect the validity of the remainder of this Ordinance.
Section 4: Specific authority is hereby granted to codify this Ordinance.
Section 5: This Ordinance shall become effective immediately upon passage.

RESOLUTION NO. 19-08
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, ADOPTING A SCHEDULE OF FEES AND
CHARGES FOR THE PROVISION OF WATER SERVICES RENDERED BY
THE VILLAGE OF TEQUESTA FOR ITS CITIZENS AND OTHER
MEMBERS OF THE PUBLIC; PROVIDING THAT THIS SCHEDULE OF
FEES AND CHARGES SHALL BE AVAILABLE FOR INSPECTION AT ALL
TIMES AT THE VILLAGE HALL DURING REGULAR BUSINESS HOURS;
PROVIDING AND EFFECTIVE DATE; AN FOR OTHER PURPOSES.
WHEREAS, the Village Council of the Village of Tequesta, Florida, desires to adopt
a schedule of fees and charges relating to the provision of water and wastewater services
rendered by the Village for the citizens of the Village of Tequesta and for other members
of the public; and
WHEREAS, the Village Council desires to incorporate all such fees and charges
assessed in accordance with Section 74-61. of the Code of Ordinances into one
comprehensive fee schedule; and
WHEREAS, the Village Council desires to make certain the schedule of fees and
charges is available for inspection such that any member of the public maybe aware of the
cost of each and every service provided by the Village Department of Utilities.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta, Florida, hereby officially
adopts the Schedule of Fees and Charges attached hereto as AExhibit A@ and made part
hereof as if fully set forth herein.
Section 2: This duly adopted Schedule of Fees and Charges shall be available at
the Village Hall for inspection by the public during normal business hours.
Section 3: This Resolution shall take effect July 1, 2008.

B. Metering of Multi-family Buildings (M.F.I - Where a single meter is installed in a
water connection serving amulti-family structure, the minimum monthly service
charge shall be not less than an amount equal to the number of dwelling units
multiplied by the minimum charge fora 5/8 inch meter or installed meter size as
expressed for Non-Residential service, whichever is greater.
In the event there is a single meter measuring quantities of water for two (2) or more

residential units, the gallons measured and charged pursuant to the terms of this
section shall be prorated by dividing the total number of gallons metered by the
number of units included on the single meter.
C. Metering of Multi-Unit Buildings -Non-Residential - In the case of any non-
residential multi-unit building housing more than one (1) business or entity, each
business or entity therein shall be metered individually. Monthly minimum service
charges shall be based on the established charge by meter size for each business or
entity therein. Where an existing single meter is installed in a water connection
serving two (2) or more businesses or entities, the minimum monthly service charge
shall also be based on the established charge by meter size. Fire protection charges
for fire lines shall be separately included; see paragraph number 3 hereinbelow.

Subject: Water System Financial Forecast
Dear Mike:
As you know, Public Resources Management Group, Inc. (PRMG) has been working with the
Village of Tequesta (the "Village") in the development of a financial forecast for the water utility
system (the "System"). The purpose of the forecast was to evaluate trends and the overall
sufficiency of rates to determine if any rate adjustments were needed to meet the overall revenue
requirements of the System. This evaluation, which was last performed by PRMG in 2005, was
prompted by such events as the general water use restrictions being imposed by the South
Florida Water Management District (SFWMD), the need to finance certain capital improvements
to the System which are required to meet the long-term capacity needs of the System service
area, changes in finished water sources (changes in production, expiration of Town of Jupiter
service agreement, etc.) and the continued inflationary effects on the overall operations of the
System.
On April 10, 2008 PRMG made a presentation to the Village Council to discuss our preliminary
findings and overall recommendations as to the sufficiency of rates to meet the projected
expenditure needs (revenue requirements) of the System. Our initial findings were to implement
a 20.0% rate adjustment beginning with Fiscal Year 2009 and increase rates thereafter based on
inflationary allowances. Subsequent to that meeting and at the overall direction of the Village,
we have re-evaluated the capital plan (a primary revenue requirement funded from System rates)
and the overall level of rates to be charged and have modified the recommended rate increase.
Although we are still recommending a rate adjustment, we are now recommending the following
rate adjustments be implemented by the Village:

It should be noted that the Village, absent the annual application of a price index to recover an
inflationary allowance on the cost of providing services, has not raised rates in approximately 10
years. The primary reasons for the increase are as follows:
1. The continued cost of inflation on the cost of operations in addition to what is being captured
by the application of the annual rate index adjustment. For example, just in the last twelve
months the cost of a barrel of oil has increased from approximately $65 to $130; this change
will affect the cost of utilities, transportation, repairs and maintenance (cost of PVC pipe) and
chemicals. Another example, in January 2006 the cost of electricity increased by
approximately 30% (billed by FP&L) due to increasing fuel and purchased power costs;
additional cost increases from this supplier are anticipated. Over the past several years, and
because of these issues, a net reduction in revenue margins has occurred which needs to be
corrected /adjusted.
2. A primary contributor to the rate adjustment is to recover the "lost revenue" resulting in the
general water use restrictions being imposed by the SFWMD. Since the implementation of
such water use restrictions, water use has declined by almost 20% and water revenues have
declined by approximately. l2%. It is our understanding that permanent water restrictions (2
day a week irrigation which essentially is a Phase II restriction level) are being seriously
considered by SFWMD and have been assumed in our financial forecast. Because of the
material decline in revenues, the Village needs to correct rates to meet the current water
demand relationships to assure the continued ability to meet its financial commitments.
3. The Village has identified approximately $6,353,200 in capital needs over the next 5 years.
A significant amount of the improvements is for the correction of the reject water disposal
from the Reverse Osmosis (RO) Water Treatment Plant as mandated by the Florida
Department of Environmental Protection (FDEP) and the construction of a third 1.20 million
gallon per day RO Treatment Train to provide additional capacity and redundancy to meet
peak day demands (especially since the bulk service agreement with the Town of Jupiter is
now expired). Although the majority of the capital plan can be funded from operations /
available reserves, we have assumed the issuance of debt to fund the expansion of the RO
Water Treatment Plant. We believe this is prudent since i) the plant not only benefits
existing customers, but benefits future customers as well and the payments will be made over
time; ii) will reduce the immediate rate impact by leveraging the rate revenues and allow the
Village to collect future impact fees to pay for the plant; and iii) allows the Village to
maintain adequate working capital reserves.
4. We are recommending that the Village establish a capital funding program from rates to fund
future capital costs for the renewal, replacement, upgrade and betterment of its utility assets.
As the system ages, the need for such expenditures will increase. We are recommending that
the Village set aside up to 7.5% of its rate revenues for future capital needs. This will result

in long-term stable rates and avoid the issuance of debt for such costs which may be costly
over time.
Even with the proposed rate adjustments, the Village's water rates are competitive with rates
charged by other neighboring utilities. This can be seen on Figure I attached to this letter.
It should be noted that the Village has done an excellent job controlling rates over the past
several years. The proposed rate adjustments are considered by PRMG as a proactive /
corrective adjustment to allow the System to meet the needs of its customers and maintain the
creditworthiness of such System. As such, PRMG considers the rate adjustments to be prudent
and in keeping with the long-term objectives of providing high quality service at a competitive
cost.
