A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, VACATING AND ABANDONING A TWENTY
FOOT WIDE, TWO HUNDRED FORTY FOOT LONG ALLEY LOCATED
IN THE JUPITER HEIGHTS SUBDIVISION; LYING IN BLOCK 3 AND
ADJACENT TO THE EAST OF PARCELS 1 AND 4 ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT BOOK 23, PAGE 69 OF
THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA;
PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, a petition has been made to abandon a platted alley right-of-way,
240 feet in length and 20 feet wide, located in the Jupiter Heights subdivision in the
Village of Tequesta, lying in Block 3 and adjacent to the east of parcels 1 and 4,
according to the Plat of Jupiter Heights in Plat Book 23, Page 69 of the public records of
Palm Beach County; and
WHEREAS, all utilities using or intending to use said alley right-of-way for utility
purposes have agreed to the abandonment with certain conditions which the applicant
has agreed to accommodate; and
WHEREAS, the Village Council of the Village of Tequesta does hereby find and
determine that the above referenced alley right-of-way as described herein is no longer
necessary and does not serve any public purpose, and is not necessary for public use,
so long as the aforesaid conditions, and other conditions set forth in the application
itself, are met; and
WHEREAS, it has been determined that substitute public and utility access will
be provided to the Village through site planning and development approval processes
associated with the property currently adjacent to the alley right-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: That certain alley right-of-way, 240 feet in length and 20 feet wide,
located in the Village of Tequesta, lying in Block 3 and adjacent to the east of parcels 1
and 4, according to the Plat of Jupiter Heights in Plat Book 23, Page 69 of the public

records of Palm Beach Count, as more particularly described in Exhibit "A" attached
hereto, be, and the same is, hereby vacated and abandoned.
Section 2: The above referenced alley right-of-way as described herein is no
longer necessary and does not serve any public purpose, and is not necessary for
public use so long as the conditions stated by utility companies, and as provided in the
abandonment application, are met.
Section 3: The Village Manager is directed to do all things necessary to
effectuate this abandonment.
Section 4: This Resolution shall be effective immediately upon adoption.

1. Background
The applicant is proposing a small-scale infill mixed use development for the subject site.The
proposed development will require the following initiatives:
1) Abandonment of an existing alley;
2) small scale future land use map amendment from Commercial to Mixed Use
designation;
3) zoning map amendment f r o m C o m m e r c i a l to Mixed Use zoning district; and,
4) replat and site plan review for 13 multifamily units, and 5,800 sf of office/retail.
On December 14,2017, the applicant conducted a conceptual presentation of the subject
development to the Village Council. The alley abandonment application request is the first step
of this proposed development.
On Apri!12, 2018, the applicant was heard by the Village Council. Unincorporated neighbors
from Palm Beach County area attended the meeting to voice their questions and concerns. The
application was voted to be postponed to a future Council meeting.
On April 19, 2018, Mr. Michael Couzzo, Village Manager, met with surrounding unincorporated
neighbors. On May 3, 2018 the applicant, Mr. Troy Holloway and Mr. Rob Stainer held a
community meeting to present and explain the proposed project. The meeting was conducted at
the site and was attended by surrounding neighbors.
2. Development Review Committee (DRC)
The Development Review Committee (DRC) met on February 28, 2018. For this application, the DRC
included community development, engineering (civil and traffic), public utility, fire safety and law
enforcement professionals.
A review of exiting utilities was conducted as part of the DRC. The application included letters from
the following utility providers:
- Loxahatchee River District
- Comcast
- AT&T
- FPL
The utility providers consent letters were contingent to the developer relocating the subject utility,
providing a new easement and assuming the related financial costs (please see attached letters).
With regard to engineering review, Mr. Spencer Schroeder, P.E. provided his review input on the
attached letter. Mr. Schroeder indicated, "We suggest abandonment be contingent upon the creation
of permeant utility and ingress/egress easements across the re-platted granting equivalent rights
currently held by the Village in the existing alley'.
With regard to traffic review, Mr.William Grieve, P.E. provided his review input on the attached letter.
Mr.Grieve indicated, "No traffic issues have been identified with the proposed alley abandonment. The
abandonment does not, and will not, prevent access to adjacent properties or the general area".

Fire Chief Joel Medina and Acting Police Chief Jim McGrew reviewed the subject application and did
not identified constraints with the proposed alley abandonment. At the site plan phase, the applicant
will provide further information and the Villape will conduct an in-depth review indudinq zoninq
buildinq, drainape, water, landscapinq, traffic, fire safety and law enforcement.
3. FINAL REMARKS
The subject application was reviewed in accordance with Policy No. 1-99/00 which provides procedures
for Application for Abandonment of dedicated Public Property within the Village of Tequesta.
On April 12, 2018, the applicant was heard by the Village Council. Unincorporated neighbors from
Palm eeach County area attended the meeting to voice their questions and concerns. The
application was voted to be postponed to a future Council meeting. On April 19, 2018, Mr. Michael

Alley Abandonment Proposal
Dear Ms. Galvez:
This letter is provided in response to your request that the Loxahatchee R.iver Environmental
Control District (District)provide a letter of consent for the abandonment of an alley within the
subject property.
As discussed in recent emails, the District currently operates a low-pressure sewer force main
within the subject alley.
Based upon the current site plan provided to the District the proposed development would
require the abandonment and relocation of the subject force main.
Therefore, the District can only consent to abandonment of the alley, contingent upon:
1. The developer relocating and abandoning the subject force main, and
2. Providing a new easement for the relocated force main,
3.
in accordance with District Standards and approved engineering plans.

Mock•Roos has completed o�u•review of the Request for Alley Abandonment and supporting
documentation for tha proposed Pelican Square development,submitted by Gentile Glas Holloway
O'Mahoney&Associxtes on February 9,2018. While the submitted information is conceptual in nature,
we see no reason the Village should take exception to abandonment of this platted but unimproved service
alley. However,we suggest abandonment be contingent upon the creation of permeant utility and
ingress/egress easements across the re-platted pai�cel granting equivalent rights currently heid by the
Village in the existing alley. We also note tl�at the Letters of Consent provided by the affected Utility
owners also carry the requirement that the Applicant relocate any existing utilities at their own cost. The
conceptual nature of tl�e submitted information does not address utility relocation,but the subsequent
Application for Site Plat� Review will need to contain engineering design information for the relocation of
utilities.

Dear Nilsa:
On behalf of the owner,691 Tequesta LLC,Gentile Glas Holloway O'Mahoney&Associates,Inc.respectfully
request your review of the applicant's proposal to abandon an existing alley that runs between the properties
located at 691 US 1, 19626 US l, 3486 Canal Ct,3471 Inlet Ct. All of the mentioned properties are located in
the Village of Tequesta.
As you are aware,the applicant is proposing a small scale infill mixed use development that will aid in bufferi.ng
the adjacent residents, in addition to providing the Village of Tequesta a dynamic project that will provide
consistency with the surrounding uses,and the opportunity to promote pedestrian walkability. The applicant's
complete development praposal is provided below:
1)a small scale land use map amendment to Mixed Use;
2)a zoning map amendment to Mixed Use;
3)a site plan for 19 multifamily units,and 6,SOOsf of office;
4}a request for an alley abandonment.
In order to bring the above development program into fruition,the applicant will f�rst need approval from the
Village Council for the alley abandonment. Please note, this discussion was the topic of a conceptual
presentation hearing on December 14,2017,and the general consensus of the Village Council was of positive
support for the applicant's proposal(inclusive of the alley abandonment).
Justificntiou for Alley Abandonment:
Over the last few years,the applicant has diligently researched the housing market in the Village of Tequesta,
and has determined that the cuirent market trends are ripe to offer a well-designed mixed use product that
provides a modest approach to growth in the area. As Tequesta continues to distinguish itself as a premier
destination in northern Palm Beach County for locals and visitors ali.ke, the applicant is excited to bring this
project to into consideration'for the Village Council's approval. However, before a site plan is further
developed,the applicant needs approval on the existing a11ey that runs through the property.
Currently,the portion of the"a11ey"subject to the abandonment request isn't functioning,as it is barricaded on
both the north and south sides (Canal Ct.and Inlet Ct.)of the property preventing any type of access through
the site. Additionally the constructed"functioning"portions of the alley to the north and south of the subject
properties are being used for overflow parking, and don't necessarily protect the public interest in terms of
safety.

Benefits to the Village of'1'equcsta:
The applicant stresses that the benefit to the Village of Tequesta is paramount,as it will
1)Offer a safer altemative allowing the opporiunity for the applicant to provide a development that features a
safe mechanism for pedestrians and vehicular traffic to move across the site;
2) Provide for the just compensation of the portion of the alley requested to be abandoned,as the applicant is
proposing to pay the Village a price comparable to the parcels recently purchased directly abutEing the alley
purchased in December,2017;
3)Improvement of a non-function.i.ng alley at no cost to the Village of Tequesta;
Conclusion:
The applicant is requesting an alley abandonment in order to develop the subject property, based on the
aforementioned development program. 'The request for the alley abandonment will not cause any detriment to
the public interest; on the contrary it will provide a safer mechanism for pedestrian and vehicular access,thus
furthering public safety and welfare.
With this letter, and based on staff direction, we have provided a list of the surrounding property owners that
abut the property, as well as a list of property owners in a 300' radius of the property. Additionally, a survey
of the area to be abandoned with a complete legal description has been included in addition to the conceptual
site plan. The engineering consultant for this project is currently in the process of getting consent forms from
the applicable utility companies, which will be forwarded to the Community Development Department upon
receipt. For entities with existing infrastructure in the subject alley,the owner will work with the utility entities
on a formidable plan to relocate the easements elsewhere on site. On behalf of the applicant, Gentile Glas

Dear Niisa:
Based on the direction given by the Village Manager and Mayor of Tequesta at our February 20,2018 meeting,please
accept this letter as our formal request of the Aliey Ahandonment for the properties referenced above.
We are proposing a small scale inflll mixed use development for the subject site,and in order to provide the proper
framework to foster thls dynamic project,we are requesCing consideration and approval from the Viliage Council for
the alley abandonment. It is important to note,that we initially brought this proposal in front of the Viilage Council
on December 14,2017,and the general consensus was that of posltive support.
Currently,the portton of the"alley"subject to the abandonment request isn't functfoning,as It Is barricaded on both
the.north and south sides(Canat G't.and tnlet Ct.)of the property preventing any type of access through the site.
Additionally the constructed"functioning"porttons of the a�ley to the north and south of the subject properties are
being used for overflow parking,and does not further the public Interest in terms of safety.
We would like to stress that our request for the alley abandonment will provide desirable benefits to the Village of
Tequesta by accomplishing the following:
• Purchase of alley for the amount of$83,320. The proposad purchasa price of the alley ts based on$17.15,
whtch Is the price/per square foot for the 4,�0 square foot poftlon of the alley consistent with the price
of the parcels directiy abutdng the alley recently purchssed in December,Z017;
• � ConstructEon of north—south access on site at no cost to the Village of Tequesta;
• Provide a safe mechanlsm for pedestrians and vehicular trafflc to move across the site,through the granting
of an access easement over the alley;
• Relocation of the affected utility easements, and granting of new easements to the applicable service
providers at our expense;
• Property Tax beneflt to the Vftlage of Tequesta
