HomeMy WebLinkAboutDocumentation_Regular_Tab 08_05/10/2018 RESOLUTION NO. 13-18 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, VACATING AND ABANDONING A TWENTY FOOT WIDE, TWO HUNDRED FORTY FOOT LONG ALLEY LOCATED IN THE JUPITER HEIGHTS SUBDIVISION; LYING IN BLOCK 3 AND ADJACENT TO THE EAST OF PARCELS 1 AND 4 ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 23, PAGE 69 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, a petition has been made to abandon a platted alley right-of-way, 240 feet in length and 20 feet wide, located in the Jupiter Heights subdivision in the Village of Tequesta, lying in Block 3 and adjacent to the east of parcels 1 and 4, according to the Plat of Jupiter Heights in Plat Book 23, Page 69 of the public records of Palm Beach County; and WHEREAS, all utilities using or intending to use said alley right-of-way for utility purposes have agreed to the abandonment with certain conditions which the applicant has agreed to accommodate; and WHEREAS, the Village Council of the Village of Tequesta does hereby find and determine that the above referenced alley right-of-way as described herein is no longer necessary and does not serve any public purpose, and is not necessary for public use, so long as the aforesaid conditions, and other conditions set forth in the application itself, are met; and WHEREAS, it has been determined that substitute public and utility access will be provided to the Village through site planning and development approval processes associated with the property currently adjacent to the alley right-of-way. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: That certain alley right-of-way, 240 feet in length and 20 feet wide, located in the Village of Tequesta, lying in Block 3 and adjacent to the east of parcels 1 and 4, according to the Plat of Jupiter Heights in Plat Book 23, Page 69 of the public 1 records of Palm Beach Count, as more particularly described in Exhibit "A" attached hereto, be, and the same is, hereby vacated and abandoned. Section 2: The above referenced alley right-of-way as described herein is no longer necessary and does not serve any public purpose, and is not necessary for public use so long as the conditions stated by utility companies, and as provided in the abandonment application, are met. Section 3: The Village Manager is directed to do all things necessary to effectuate this abandonment. Background The applicant is proposing a small-scale infill mixed use development for the subject site.The proposed development will require the following initiatives: 1) Abandonment of an existing alley; 2) small scale future land use map amendment from Commercial to Mixed Use designation; 3) zoning map amendment f r o m C o m m e r c i a l to Mixed Use zoning district; and, 4) replat and site plan review for 13 multifamily units, and 5,800 sf of office/retail. On December 14,2017, the applicant conducted a conceptual presentation of the subject development to the Village Council. The alley abandonment application request is the first step of this proposed development. On Apri!12, 2018, the applicant was heard by the Village Council. Unincorporated neighbors from Palm Beach County area attended the meeting to voice their questions and concerns. The application was voted to be postponed to a future Council meeting. On April 19, 2018, Mr. Michael Couzzo, Village Manager, met with surrounding unincorporated neighbors. On May 3, 2018 the applicant, Mr. Troy Holloway and Mr. Rob Stainer held a community meeting to present and explain the proposed project. The meeting was conducted at the site and was attended by surrounding neighbors. 2. Development Review Committee (DRC) The Development Review Committee (DRC) met on February 28, 2018. For this application, the DRC included community development, engineering (civil and traffic), public utility, fire safety and law enforcement professionals. A review of exiting utilities was conducted as part of the DRC. The application included letters from the following utility providers: - Loxahatchee River District - Comcast - AT&T - FPL The utility providers consent letters were contingent to the developer relocating the subject utility, providing a new easement and assuming the related financial costs (please see attached letters). With regard to engineering review, Mr. Spencer Schroeder, P.E. provided his review input on the attached letter. Mr. Schroeder indicated, "We suggest abandonment be contingent upon the creation of permeant utility and ingress/egress easements across the re-platted granting equivalent rights currently held by the Village in the existing alley'. With regard to traffic review, Mr.William Grieve, P.E. provided his review input on the attached letter. Mr.Grieve indicated, "No traffic issues have been identified with the proposed alley abandonment. The abandonment does not, and will not, prevent access to adjacent properties or the general area". 2 Department of Community Development-Staff Report—Alley Abandonment Fire Chief Joel Medina and Acting Police Chief Jim McGrew reviewed the subject application and did not identified constraints with the proposed alley abandonment. At the site plan phase, the applicant will provide further information and the Villape will conduct an in-depth review indudinq zoninq buildinq, drainape, water, landscapinq, traffic, fire safety and law enforcement. 3. FINAL REMARKS The subject application was reviewed in accordance with Policy No. 1-99/00 which provides procedures for Application for Abandonment of dedicated Public Property within the Village of Tequesta. On April 12, 2018, the applicant was heard by the Village Council. Unincorporated neighbors from Palm eeach County area attended the meeting to voice their questions and concerns. As discussed in recent emails, the District currently operates a low-pressure sewer force main within the subject alley. Justificntiou for Alley Abandonment: Over the last few years,the applicant has diligently researched the housing market in the Village of Tequesta, and has determined that the cuirent market trends are ripe to offer a well-designed mixed use product that provides a modest approach to growth in the area. As Tequesta continues to distinguish itself as a premier destination in northern Palm Beach County for locals and visitors ali.ke, the applicant is excited to bring this project to into consideration'for the Village Council's approval. However, before a site plan is further developed,the applicant needs approval on the existing a11ey that runs through the property. Currently,the portion of the"a11ey"subject to the abandonment request isn't functioning,as it is barricaded on both the north and south sides (Canal Ct.and Inlet Ct.)of the property preventing any type of access through the site. Additionally the constructed"functioning"portions of the alley to the north and south of the subject properties are being used for overflow parking, and don't necessarily protect the public interest in terms of safety. With this letter, and based on staff direction, we have provided a list of the surrounding property owners that abut the property, as well as a list of property owners in a 300' radius of the property. Additionally, a survey of the area to be abandoned with a complete legal description has been included in addition to the conceptual site plan. The engineering consultant for this project is currently in the process of getting consent forms from the applicable utility companies, which will be forwarded to the Community Development Department upon receipt. For entities with existing infrastructure in the subject alley,the owner will work with the utility entities on a formidable plan to relocate the easements elsewhere on site.
