TEQUE�STA REPL OF PT LT 604 PCN: 60-42-40-26-02-000-6040 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on April 24, 2018, and based on the evidence and testimony presented, enters an Order Finding Repeat Violation and Assessing Fine. The following Findings of Faet, Conclusions of Lavv, and Order are hereby entered: FINDINGS OF FACT l. Respondents were represented at the hearing by Michael McCarthy; there was also a finding of proper notice. 2. Code Compliance Officer Joe Petrick provided testimony and evidence of the repeat �iolation, as contained-in the Uillage's euidentiar-y case file which was accepted into evidence. 3. Based upon the evidence and testimony presented, the Special Magistrate finds that the property was in violation of Section 78-747 of the Code of Ordinances of the Village of Tequesta. 4. This is a repeat violation of the same Village Code section(s) from an "Order Finding Violation" dated June 21, 2017. CONCLUSIONS OF LAW Based on the above-stated facts, Respondents are in repeat violation of Chapter 78, Article XI, Section 78-7�7 ofthe Code ofOrdinances ofthe Village of Tequesta. ORDER It is the Order of the Special Magistrate that a Fine of Three Hundred Fifty Dollars ($350.00) is hereby assessed, at Fifty Dollars ($50.00) per day, for the repeat violations which existed on the property beginning from March 22, 2018 through March 28, 2018, a total of seven (7) days. Respondents are further assessed the Village's administrative costs in the amount of$183.48. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes. Upon comptying in any code compliance matter, it is always the responsi6ility of the Respondents to contact the Code Compliance Division at (561) 768-0506 to request a re- inspection of the property.
