RE: Violation of Chapter 30, Article 1I, Section 30-33 of the Code of Ordinances of the Village of Tequesta. Address: 109 Beechwood Trail Tequesta, Florida 33469 Legal Description: TEQUESTA PINES LOT 134 PCN: 60-42-40-25-25-000-1340 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on April 24, 2018, and based on the evidence and testimony presented, enters an Order Finding Repeat Violation and Assessing Fine. The following Findings of Fact, C�nclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. Respondents were represented at the hearing by Clifford Gilbert; there was also a finding of proper notice. 2. Code Compliance Officer Joe Petrick provided testimony and evidence of the repeat violation, as contained in the Village's evidentiary case file which was accepted into evidence. 3. $ased upon the evidence and testimony presented; the 5pecial �bfagistrate fnds that the property was in violation of Section 30-33 of the Code of Ordinances of the Village of Tequesta. 4. This is a repeat violation of the same Village Code section(s) from an "Order Finding Repeat Violation and Assessing Fine" dated October 2, 2014. CONCLUSIONS OF LAW Based on the above-stated facts, Respondents are in repeat violation of Chapter 30, Article II, S�etion 30-33 of the Coae of Orainances of the�illage of Tequesta: ORDER It is the Order of the Special Magistrate that a Fine of Seven Thousand Dollars ($7,000.00) is hereby assessed, at Two Hundred Fifty Dollars ($250.00) per day, for the repeat violations which existed on the property beginning from March 28, 2018 through Apri124, 2018, a total of twenty-eight (28) days; and the fine amount shall continue to accrue at Two Hundred Fifty Dollars ($250.00) per day until compliance is achieved. Respondents are further assessed the Village's administrative costs in the amount of$l 87.93. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Flor-ida Statutes.
