Address: 415 Cypress Drive#8 Tequesta, Florida 33469 Legal Description: WENDIMERE VILLAS PHASE II CONDtTNIT 8-E PCN: 60-43-40-30-]9-000-0080 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on April 24, 2018, and based on the evidence and testimony presented, enters an Order �inding �tepeat Violation and Assessing �ine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. Respondents were not present at the hearing; however, there was a finding of proper notice. 2. Code Compliance Officer Joe Petrick provided testimony and evidence of the repeat violation, as contained in the Village's evidentiary case file wnich was aceepted into evidence. Additionally, neighbor complainant Tracy O'Daniel offered testimony concerning the specifc dates of repeat violation: 3. Based upon the evidence and testimony presented, the Special Magistrate finds that the property was in violation of Section 10-34 of the Code of Ordinances of the Village of Tequesta on March 3 and 5, 2018, a total of two (2) days. 4. This is a repeat violation of the same Village Code section(s) from an "Order Finding Violation" dated October 24, 2017. CONCLUSIONS OF LAW Based on che above-stated facts, Respondents are in repeat violation of Chapter 10, Article II, Section 10-34 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Magistrate that a Fine of Two Hundred Dollars ($200.00) is hereby assessed, at One Hundred Dollars ($100.00)per day, for the repeat violations which existed on the pro�_eriy nn March 3_and_�,2018,_a tatal of two(2) days. Respondents are further assessed the Village's administrative costs in the amount of$187.96. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes.
