I. The Tequesta Village Council held a workshop meeting at the
Village Hall, 357 Tequesta Drive, Tequesta, Florida, on
Tuesday, October 30, 1990. The meeting was called to order
at 7:00 P.M. by Mayor Joseph N. Capretta. A roll call was
taken by the Recording Secretary, Fran Bitters.
Councilmembers present were: Mayor Joseph N. Capretta, Vice
Mayor Ron T. Mackail, Earl L. Collings, Edward Howell and
William Burckart. Village Manager, Thomas G. Bradford, and
Village Attorney, John C. Randolph were also in attendance.
II. APPROVAL OF AGENDA
Councilmember Collings moved that the Agenda be approved as
submitted. Vice Mayor Mackail seconded the motion. The vote
was:

the motion was therefore passed and the Agenda was approved
as submitted.

III. OVERVIEW OF REFERENDUM LANGUAGE REQUIREMENTS BY T8E VILLAGE
ATTORNEY
Attorney Randolph explained, for the benefit of those in
attendance, the requirements of the Referendum language:
~~Pursuant to Florida Statutes, there are certain criteria that
are set forth. It needs to be kept in mind that this is not
necessarily a strict Referendum, and there is some question
as to whether it is necessary to specifically follow the
dictates of the law. I recommend it be followed to the extent
possible, in case a question arises. Pursuant to Chapter
101.161, Florida Statutes, the question should be worded in
a manner that can be voted on by a simple ~~yes~~ or ~~no~~ vote.
The substance of a straw ballot shall be explained in a
Statement of 75 words or less, and the ballot Title shall
consist of a caption not exceedi.nq 15 words.
Once the language is decided upon, Council would adopt a
Resolution which would include the wording of the ballot
language. That Resolution then would be sent to the
Supervisor of Elections, who would put it on the ballot.
The Referendum question is art opportunity for the commission
to hear from the electorate in regard to the electorates
desires in regards to what they want to do in regard to the
question that is stated. It is not something that would be
binding. The only binding would be with a Charter Amendment
that was voted on by the people. A Referendum can be amended
or rescinded at a later time, i.e., a straw ballot.

IV DISCUSSION AND CONSIDERATION OF CITIZEN-SUGGESTED REFERENDUM
BALLOT LANGUAGE.
The following citizens read their submissions of suggestions
for ballot language:
o Dottie Campbell
o Harold Hutchinson
o Mary 8eay
o Glen Rloiber
o Pert Towne
o Dr. Stanley Jacobs
o Revin Larkin
There was much discussion as to which language was best for
the Referendum. Mayor Capretta reminded the citizens that the
Referendum question has to be one that can simply be voted on
by a "yes" or "no" vote; it cannot be multiple choice;
specifics cannot be included; and it should be simply stated.
Attorney Randolph suggested a simple statement wherein the
first sentence would state:
o What is being done now;
o What is being considered; and
o A "yes" or "no" choice.
V. VILLAGE COUNCIL DISCUSSION OF REFERENDUM BALLOT LANGUAGE
PROPOSED FOR FORMAL APPROVAL AT THE NOVEMBER 8TH COUNCIL
MEETING.
Councilmember Burckart suggested that will all the comments
for suggestions for language received, the Village Attorney
should try to put something together that would cover
everyone's thoughts, and bring it back to Council in a
Resolution for consideration.

Vice Mayor Mackail moved that Attorney Randolph take the
suggested language heard before Council this evening and
present to Council a Resolution containing Referendum Ballot
language for Council's review. Councilmember Collings
seconded the motion. The vote was:

Edward Howell - for
the motion was therefore passed and adopted.

Vice Mayor Mackail moved to adjourn the meeting.
Councilmember Collings seconded the motion. The vote was:

the motion was therefore passed and adopted and the meeting
was adjourned at 8:20 P.M.
