Vice Mayor Watkins asked if the Village was in any conflict with
FEMA as far as having accepted FEMA money to clear a portion of
the park. The Village Manager responded no, and advised that Joe
Negron had $350,000 more in the State budget to clean up the
property. Council Member Paterno asked who would control the
irrigation. Mayor Humpage responded that would be Jupiter Hills
Club, on the berm, and they would be paying for the water, and when
the berm was done the Village would require language to assure they
would install the berm and would maintain it so there would be no
additional financial burden on the Village. Council Member Paterno
commented the berm would potentially cover parts of the trail, which
was heavily used. Village Manager Couzzo explained that there
would be plenty of time to look at that berm and an agreement
regarding the trail could be done at a later date, and that was not
before the Council at this time. Mayor Humpage clarified there were
no stipulations tied to the $45,000, and he had talked to the president
and the superintendent at Jupiter Hills, and they had both said the trail
would remain and if it had to be modified they would do that.
Council Member Paterno asked about the fence location, which
Mayor Humpage clarified would be on the berm and on the property
line.

REGULAR VILLAGE COUNCIL MEETING
THURSDAY, NOVEMBER 9, 2006
Mr. Taylor commented it was not a safe condition. He asked what
responsibility the Village had regarding Tequesta Park. He stated he
knew the Village leased it from the State. He pointed out at one time
the fence was where the center of the brim was but now the fence was
20 feet inside the park. He asked if that was apart of the agreement
between the Village or Jupiter Hills with the State. He pointed out a
length of 700 feet with a width of 20 feet would be taken out of
Tequesta Park. He commented it seemed like a strange place to put
the fence and from a practical perspective he could see why they did it
because they did the landscaping and if they put the brim of the fence
on their side they would not be able to get to their landscaping but in
the mean time it looked strange to place the fence there with out any
Mayor Humpage stated yes they could do that. He explained the criteria was
set with Jupiter Hills and he helped to negotiate that deal and the Village
would fill the holes tomorrow. He stated they had a survey from the State
and Jupiter Hills was supposed to put the fence back at the original location.
Mr. Taylor pointed out that would be at the center of the burm; he doubted
they could do that because if they did that would leave some of their
landscaping especially their Palm Trees on the other side of the fence.
Mayor Humpage stated the agreement was Jupiter Hills would go over and
maintain the property even on the other side of the fence. He stated it didn't
make a difference and he would connect with them tomorrow
