or to other wholesalers, or acting as agents or
brokers and buying merchandise for, or selling
merchandise to, such individuals or companies.
Yacht club means a building or other facility,
including dockage, used for the organized gather-
ing of members and guests for the purpose of
furthering their interest in small sailing or me-
chanically propelled vessels used for pleasure
cruises or racing.
Yard means the unoccupied and unobstructed
open spaces on the same lot with the main build-
ing which extend from the ground upward.
(1) Front yard means the open space extend-
ing the full width of the lot, the depth of
which is the minimum horizontal dis-
tance between the rear lot line and the
nearest line of the main building.
(2) Rear yard means the open space extend-
ing the full width of the lot, the depth of
which is the minimum horizontal dis-
tance between the rear lot line and the
nearest line of the main building.
(3) Side yard means the open space between
the main building and the side lot line,
extending from the front yard to the rear
yard, the width of which is the horizontal
distance from the nearest point of the side
lot line to the nearest point of the main
building.
Zero lot line means a development approach
allowable only as part of an approved planned
unit development in which a building is sited on
one or more lot lines with no yard. Conceivably,
three of the four sides of the building could be on
the lot lines. The intent is to allow more flexibility
in site design and to increase the amount of
usable open space on the lot.
Zone means the area within which certain uses
of land and buildings are permitted and certain
others are prohibited, yards, and other open spaces
are required, lot areas, building height limits, and
other requirements are established, all of the
foregoing being identical for the zone in which
they apply (see also District).

Zoning ordinance refers to the Village of
Tequesta, Florida, Comprehensive Zoning Ordi-
nance printed in this chapter, further known by
short title as the Official Zoning Ordinance of the
Village of Tequesta, Florida.

Sec. 78-5. Effect on existing easements, cov-
enants and agreements; conflict-
ing regulations.
It is not intended by this chapter to interfere
with nor abrogate nor annul any easements, cov-
enants or other agreements between parties; pro-
vided, however, that where this chapter imposes a
greater restriction of any kind upon the use of
buildings or premises, or upon the height of
buildings, or requires larger open spaces than are
imposed or required by other ordinances, rules, or
regulations, or by easements, covenants, or agree-
ments, the provisions of this chapter shall control.

(a) Violations; penalties.
(1) Violation of the provisions of this chapter
or failure to comply with any of its require-
ments (including violation of conditions
and safeguards established in connection
with grants of variances or special excep-
tions), after notice by a village official,
shall constitute a violation. An_y person
upon conviction of a violation shall be
punished as provided in section 1-14, and
in addition shall pay all costs and ex-
penses involved in the case.
(2) The owner or tenant of any building,
structure, premises, or part thereof and
any architect, building contractor, agent,
or other person who commits, participates
in, assists in, or maintains such violation

GENERAL PROVISIONS
Sec. i-1. How Code designated and cited
The ordinances embraced in the following chap-
ters and sections shall constitute and be desig-
nated the "Code of Ordinances, Village of Tequesta,
Florida," and may be so cited.

Sec. 1-2. llefinitions and rules of construc-
tion.
In the construction of this Code, and of all
ordinances, the following rules shall be observed,
unless such construction would be inconsistent
with the manifest intent of the village council:
Boards, committees, commissions, officers, em-
ployees, departments. All references to boards,
committees, commissions, officers, employees or
departments mean those boards, committees, com-
missions, officers, employees and departments of
the Village of Tequesta, Florida.
Charter The term "Charter" means and refers
to the Charter of the Village of Tequesta printed
in part I of this volume.
Code. The term "Code" means and refers to the
Code of Ordinances printed in part II of this

Computation of time. Whenever a notice is
required to be given or an act to be done a certain
length of time before any proceeding shall be had,
unless specifically provided otherwise, the day on
which such notice is given, or such act is done,
shall not be counted in computing the time, but
the day on which such proceeding is to be had
shall be counted.

Procedure, rule 1.099.
County. The tern? "county" means the County
of Pahn Beach, Florida.
Delegation of ¢uthority. Whenever a provision
appears requiring the head of a department or
some other village officer or employee to do some
act or perform some duty, it shall be construed to
authorize the head of the department or other
officer or employee to designate, delegate and
authorize subordinates to perform the required
act or perform the duty unless the terms of the
provision or section specify otherwise.

Gender. A word importing either the masculine
or feminine gender shall extend and be applied to
both the masculine and feminine genders, and to
firms, partnerships and corporations.
I~iglzway. The term "highway" includes any
street, alley, highway, avenue or public place or
square, bridge, viaduct, tunnel, underpass, over-
pass or causeway in the village dedicated or
devoted to public use.
Keeper and proprietor. The terms "keeper" and
"proprietor" mean and include persons, firms,
associations, corporations, clubs and copartner-
ships, whether acting by themselves or through a
servant, agent or employee.
Number. A word importing the singular may
extend and be applied to the plural, and vice
versa.
Oath.. The term "oath" includes an affirmation
in all cases in which, by law, an affirmation may
be substituted for an oath, and in such cases the
words "swear" and "sworn" shall be equivalent co
the words "affirm" and "affirmed."
Or, and The term "or" may be read "and," and
the term "and" may be read "or," if the sense
requires it.
Otuner. The term "owner," applied t.o a building
or land, includes any part owner, joint owner,

tenant or tenant by the entirety, of the whole or of
apart of such building or land.
Person. The term "person" shall extend and be
applied to associations, clubs, societies, firms,
partnerships and bodies politic and corporate as
well as to individuals.
Personal property. The term "personal proper-
ty" includes every species of property except real
property.
Property. The term "property" includes real,
personal and mixed property.
Public place. The term "public place" means
any place subject to the primary control of any
public agency, including but not limited to any
park, street, public way, cemetery, schoolyard or
open space adjacent thereto and any lake or
stream.

cial, institzrtional, or professional business users,
or to other wholesalers, or acting as agents or
brokers and buying merchandise for, or selling
merchandise to, such individuals or companies.
Yacht club means a building or other facility,
including dockage, used for the organized gather-
ing of members and guests for the purpose of
furthering their interest in small sailing or me-
chanically propelled vessels used for pleasure
cruises or racing.
Yard means the unoccupied and unobstructed
open spaces on the same lot with the main build-
ing which extend from the ground upward.
(1) Front yard means the open space extend-
ing the full width of the lot, the depth of
which is the minimum horizontal dis-
tance between the rear lot line and the
~~ nearest line of the main building.
(2) Rear yard means the open space extend-
ing the full width of the lot, the depth of
~` which is the minimum horizontal dis-
1 tance between the rear lot line and the
nearest line of the main building.
(3) Side yard means the open space between
the main building and the side loti line,
extending from the front yard to the rear
yard, the width of which is the horizontal
distance from the nearest point of the side
lot line to the nearest point of the main
building.
Zero lot line means a development approach
allowable only as part of an approved planned
unit development in which a building is sited on
one or more lot lines with no yard. Conceivably,
three of the four sides of the building could be on
the lot lines. The intent is to allow more flexibility
in site design and to increase the amount of
usable open space on the lot.
Zorte means the area within which certain uses
of land and buildings are permitted and certain
others are prohibited, yards, and other open spaces
are required, lot areas, building height limits, and
other requirements are established, all of the
foregoing being identical for the zone in which
they apply (see also District).

Zoning ordinance refers to the Village of
Tequesta, Florida, Comprehensive Zoning Ordi-
nance printed in this chapter, further known by
short title as the Official Zoning Ordinance of the
Village of Tequesta, Florida.

Sec. 78-5. Effect on existing easements, cov-
enants and agreements; conflict-
ing regulations.
It is not intended by this chapter to interfere
with nor abrogate nor annul an_y easements, cov-
enants or other agreements between parties; pro-
vided, however, that where this chapter imposes a
greater restriction of any kind upon the use of
buildings or premises, or upon the height of
buildings, or requires larger open spaces than are
imposed or required by other ordinances, rules, or
regulations, or by easements, covenants, or agree-
ments, the provisions of this chapter shall control.

Sec. 78-6. Enforcement officer; violations;
penalties.
Enforcement officer. The village manager or his
designate is hereby authorized and directed to
enforce this chapter.
(a) Violations; penalties.
(1) Violation of the provisions of this chapter
or failure to comply with any of its require-
ments (including violation of conditions
and safeguards established in connection
with grants of variances or special excep-
tions), after notice by a village official,
shall constitute a violation. Any person
upon conviction of a violation shall be
punished as provided in section I-14, and
in addition shall pay all costs and ex-
penses involved in the case.
(2) The owner or tenant of any building,
structure, premises, or part thereof and
any architect,. building contractor, agent,
or other person who commits, participates
in, assists in, or maintains such violation
may each be found guilty of a separate
offense and suffer the penalties provided
in this section.

ZONING
(7) No major repairs or overhaul work on
such equipment which constitutes either
a public or private nuisance shall be made
or performed on the site.
(8) When parked on the site, such equipment
shall not be used for living or sleeping
quarters or for housekeeping or storage
purposes and shall not have attached
thereto any service connection lines, ex-
cept as may periodically be required to
maintain the equipment and appliances.
(9) None of the vehicles or equipment de-
scribed in this section may be parked in
the area between the street lot line and
the structure or in the right-of-way in
front of the structure; however, one of the
vehicles described in this section may be
parked in the front yard driveway for a
cumulative period not exceeding- four hours
in any one 24-hour period.

Sec. 78-645. Waivers.
Any part or the whole of this division may be
waived by the village council on the filing of a
written application for such action setting forth
the reasons for the request. Such application
must set forth a hardship on the part of the
applicant, and granting of the request by the

of transportation andlor the village consulting
engineers as may be appropriate for the type and
roadway classification of the subject roadway.
Minimum width of an access drive shall be ten
feet for K-1 and R-lA districts. For all other
districts, the minimum width of each aisle de-
signed and intended for the maneuvering of a
motor vehicle into a parking space shall be deter-
mined by the angle of parking as shown in the
parking lot dimension table of this division. The
parking plan shall be so arranged. that each motor
vehicle may be placed and removed from the
parking space assigned thereto and taken to and
from the property without necessity of moving
any other motor vehicle to complete the maneu-
ver. Each lot, parcel, or property subject to a
development or redevelopment proposal shall be
allowed to design its off-street parking space
areas utilizing a maximum of 25 percent of the
minimum required parking spaces to be identified
as "compact spaces" with minimum dimensions of
eight feet in width by 16 feet in length, subject to
the review and approval of the village consulting
engineers, the village development review staff
and the village council.

Sec. 78-692. Location of parking areas in

Required yards and setbacks may be used for
off-street parking, provided that access drives or
aisles and turning spaces shall be located within
the lot lines. In computing off-street require-
ments, street or sidewalk areas shall not be used
for off-street parking purposes.

Sec. 78-691. Minimum standards.
For the purpose of this chapter, an off-street
parking space shall consist of a parking space
having minimum dimensions of nine feet in width
by 18 feet in length for the parking of each motor
vehicle, exclusive of access drives or aisles thereto.
An on-street parking space shall consist of a
curbside parking space having minimum dimen-
