As you are aware, we recently completed the drainage, streetlight conduit, and water main improvements to South Cypress Drive. This is the final phase of the project. I received four (4) quotes for this and the lowest quote was from Terracon Services, Inc in the amount of $19,973.50. We have $40,124.09 in account # 001-210563.600 (Public Works Miscellaneous Projects) to pay for this project, with reimbursement from the property owners going back into this account once completed. Please place this item on the June 14, 2007 agenda for Council consideration. Should you require additional information, please let me know. RESOLUTION 51-06/07 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AWARDING A LANDSCAPE AND IRRIGATION PROPOSAL TO TERRACON SERVICES, INC OF JUPITER FLORIDA, IN THE AMOUNT OF $19,973.50, WITH FUNDING FROM ACCOUNT # 001-210 563.600 HAVING A FY 06/07 BALANCE OF $40,124.09 AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE ON BEHALF OF THE VILLAGE. Those materials in questionable condition at the end of the wattattty period will be extended for 30 days. if any plant material should die within the warranty period for any reason except those not coverod by the guarantee, the Landscape Contractor will replace the dead material 1 time (and 1 time only} at no charge, or at our option, refund the purchase price. Any subsequent replacement will be charged to the Purchaser. Conditions that will void this guarantee are a lack of available fresh portable water supply for planting within l50 feet of planting areas; absence of automatic imgation system; failure of Owner to follow an approved maintenance program; damages by other trades; vandalism; poor drainage; natural acts of God (ie, IIood, wind is excess of40 mph, freeze, drought, water restrictions, humcanes, etc.) or materials transplanted on site. The guarantee is void if payment schedule is not strictly adhered to, or if written notice is given as provided herein. 3 Transplants, sod and annuals are not guaranteed under this contract. 4 Due to the high mortality rate of newly planted, 5eld grown materials .from insufficient watering, we cannot guarantee these materials unless a bubbler or soaker line system is installed at time of planting as designated by Landscape Contractor. If bubblers or soakers are installed and set on a time clock at said time, our guarantce will be honored 90 days, according to the conditions stated about. 5 All plants are subject to availability at the time of job. If material is not available, a suitable substitute approved by bath the Landscape Architect and the Landscape Contractor wit! be used. d We cannot assume responsibility for any "natura! peril" which may prove detrimental to plant material or postpone completion of job, such as drought, water restrictions, high winds, excessive hooding, freeze or frost, etc. 7 No &tl or rough grading is included in this contract, unless so specified. A finished grade acecptable to the Landscape Contractor, plus or minus 2°%, will be furnished by the Purchaser or his Agent. "Hand raking" only is included in this contract. Aay additional grading or trash removal, including equipment work, is extra. 8 Removal of shell, road, rock or other objectionable materials and replacing with topsoil is not included in this proposal. 9 Pride includes I planting only. Any payment to unions will be paid by the Owner/Contractor Damages caused by strikes or threats to strike will be paid by the Owner/Contractor. 13 in the event that the Landscape Contractor is unable to continue due to construction delays andlor civil or natural occurrences, it shall be the Owners responsibility to provide proper maintenance, payment is due for alt work completed to that date. The Owners responsibility begins the day after the Landscape Contractor has been forced to withdraw. If remobilization is required, additional costs may be incurred by the Owner/Purchaser. 14 We well exercise all precautions in performing our work; however, if tive run into any underground utilities while performing this contract which were not previously marked by Owner or Owners Representative, repair costs will be Owners responsibility. IS if any substantial change (20% or more) in this contract is necessary, the Landscape Contractor reserves the right to re-negotiate unit prices. Ib All charges unpaid for 30 days from date of service are subject to 1.5% monthly service charge. Hood Landscape, Inc. will utilize the right to lien the Owners property in case of non-payment.
