Ordinance # 54-2 governs the landing of aircraft with in the Village limits. As provided within Ordinance # 54-2, we are asking for Council Approval to land and fly a Helicopter at and above Tequesta County Club for purposes of the Golden Ball Drop following the Tequesta's Golden Tribute Golf Tournament on June 4, 2007. Page 1 of 2 (a) The village does hereby adopt the laws of the state presently in existence, and as they are amended, added to, deleted or changed hereafter, relating to misdemeanors as valid and existing ordinances of the village. (b) It shall be unlawful to commit within the corporate limits of the village any act which is or shall be recognized by the laws of the state and this section as a misdemeanor. (c) Any person violating any of the provisions of this section shall, upon conviction thereof, be punished as set forth by the laws of the state relating to misdemeanors and as set forth in section 1-14. (Code 1977, § 13-1) Case law annotations--A municipality may enact an ordinance creating an offense against municipal law for the same act that constitutes an offense in state Iaw.Jaramillo v. City of Homestead , 322 So.2d 496(1975). A municipality by ordinance may adopt state misdemeanor statutes by specific or general reference. Adoption of state law misdemeanors by reference includes laws both in existence at the time and those later adopted by the state Iegislature.State v. Smith , 189 So.2d 846. Fines and forfeitures in county court payable to municipality, F.S. § 34.191. Sec. 54-2. Landing aircraft, parachuting or skydiving. (a) Except in case of emergency, no person shall land any aircraft, parachute or skydive within the village limits. (b) The term "aircraft," as used in subsection (a) of this section, means any airplane, flying machine, balloon, or helicopter or any contrivance now known or hereafter invented, used or designed for navigation of or flight in the air, except a parachute or other contrivance used primarily as safety equipment. (c) This section shall not prohibit the landing of aircraft, parachuting or skydiving within the village limits on municipal property, subject to the prior approval of the village council.
