PRESENT: Special Master Paulette Torcivia; Code Enforcement Officer Police Sgt. John

Meeting was called to order at 10:00 A.M.
A. Code Enforcement Special Master Torcivia approved the minutes of the
September 24 , 1998 hearing as submitted.

Respondent Robert F. Cromwell et al was present and was represented by
Attorney William Shannon. Donaldson Hearing, Landscape Architect for the
Respondent, testified to the process involved in resolving landscaping approval
by the Community Appearance Board. Code Enforcement Officer Sgt. John
Irovando testified to the violation. Director of Community Development Scott D.
Ladd testified to the procedures and time line in the Respondent's process
toward approval of a landscape plan.
Conclusion of law was that Respondent is in violation of the Tequesta Code of
Ordinances, Appendix A -Zoning, Section X, Supplemental Regulations
Applying To A Specific, To Several Or To All Districts, (H), Landscaping; General
Requirements, Pages No. 1174-1178.8.1.
Code Enforcement Special Master Torcivia ordered that Respondent Robert F.
Cromvn~ell, Et AI, shall complete the landscape plan approval process in a timely
manner. A status hearing shall be held on January 28, 1999, at 10:00 a.m., at
the Tequesta Village Council Chambers, 357 Teques#a Drive, Tequesta, Florida
33469.

Respondent Sylvia P. Smith was present at the hearing. Code Enforcement
Officer Sgt. John Irovando testified to the code violation.
Conclusion of law was that Respondent Sylvia P. Smith is in violation bf
Tequesta Code of Ordinances, Appendix A -Zoning, Sec#ion X, Supplemental
Regulations, (L}(2), Commercial Vehicles and Trucks on Private Lots, Page No.
1184 and 1185.
Code Enforcement Special Master Torcivia ordered that Respondent Sylvia P.
Smith shall comply with Tequesta Code of Ordinances, Appendix A -Zoning,
Section X, Supplemental Regulations, (L)(2), Commercial Vehicles and Trucks
on Private Lots, Page No. 1184 and 1185 by October 30, 1998, and if
Respondent does not comply by the deadline a fine of up to Fifty Dollars
($50.00) per day shall be assessed for each day the violations continue to exist.

authorization be con#inued to next month. Cade Enforcement Officer Police Sgt.
John Irovando testified that Attorney John Mariani had called that morning to
request a continuance.
Code Enforcement Special Master Torcivia ordered that an additional hearing
will be held before the Special Master on the 19th day of November, 1998, at
10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive,
Tequesta, Florida 33469.

was a finding of proper notice. Tequesta Code Enforcement Officer Police Sgt.
John Irovando testified to the repeat violations which occurred on September 16,
1998 and September 23, 1998.
Conclusion of law was that Respondent Stephen Burlington is in repeat violation
of the Code of Ordinances of the Village of Tequesta, Appendix A -Zoning,
Section X, Supplemental Regulations, (L)(2), Commercial Vehicles and Trucks
on Private Lots, Page No. 1184 and 1185.

Code Enforcement Special Master Torcivia ordered that a fine of Fifty Dollars
($50.00) shall be assessed for each violation, the total fine of One Hundred
Dollars ($100.00) is to be paid by November 13, 1998, or an additional fine
assessment hearing shall be held on November 19, X998, at 10:00 a.m., at the
Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida
33469. A certified copy of the Special Master's Order shall be recorded in the
Public Records of Palm Beach County, Florida, and once recorded, shall
constitute a lien against the real or personal property owned by the Respondent,
pursuant to Chapter 162, Florida Statutes, for the original amount.
