Jupiter Petition for Administrative
Now that all legal issues relative to the Rate Dispute and RO
Challenge between the Village and the Town of Jupiter are over, the
only remaining legal matter between the two communities is the
above-referenced Administrative Hearing relative to Jupiter's
desired consumptive use permit. Clearly, the three legal issues
are unrelated.
In the Administrative Hearing, Tequesta has sought to challenge the
amount of water that Jupiter is seeking to be permitted from the
Surficial and Floridan Aquifers. Other tangential issues are also
entailed in this Administrative Hearing.
The Village Council is scheduled to consider refund procedures
associated with the rate dispute at your meeting on December 10,
1998. Thereafter, if I correctly understood your position at the
last Village Council Meeting relative to the outstanding
Administrative Petition, Tequesta is now in a position to consider
dropping this challenge so that both communities can once again
return to our historically friendly relations.
