RESOLUTION NO. 3-98/99
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, APPROVING ENGINEERING SERVICES
PROPOSALS FOR PERMITTING AND DEVELOPMENT OF
CONSTRUCTION PLANS FROM GEE & JENSON IN
THE AMOUNT OF $29,750 FOR TEQUESTA COUNTRY
CLUB DRAINAGE IMPROVEMENTS, AND AUTHORIZING
THE VILLAGE MANAGER TO EXECUTE THE SAME ON
BEHALF OF THE VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Engineering Services Proposals for
Permitting and Development of Construction Plans from Gee and
Jenson of West Palm Beach, Florida in the amount of $29,750 for
Tequesta Country Club Drainage Improvements, Attached Hereto as
Exhibit "A" and as Exhibit "B", and Incorporated by Reference
as Part of this Resolution are Hereby Approved and the Village
Manager of the Village of Tequesta is Authorized to Execute the
Same on Behalf of the Village.

Please find attached, the following support documents for

Permitting Scope of Services for the Tequesta Country Club
Drainage Improvement in the amount of $16,000.
• A letter dated October 23, 1998 from Mr. Harry T. Benoit, Jr.,
Project Manager, Gee & Jenson, providing Development of
Construction Drawing Scope of Services for the Tequesta
Country Club Drainage Improvement in the amount of $13,750.
• A letter dated October 23, 1998 from Mr. Joseph B. Frost
advising of the preliminary comments and concerns from the
Permitting Agencies.
This drainage improvement project is anticipated to cost in
excess of $400,000. Officials from the State of Florida
Department of Community Affairs recently visited Tequesta and
inspect the construction site and have advised that Federal and
State funding may be available for this project.
Please place this item on the November 12, 1998 Village Council
Meeting Agenda for Councilmembers' consideration.

Please accept this letter as our formal proposal for professional services to acquire environmental
permits for the above referenced construction project. It should be noted that while this scope is
based on years of permitting experience with all agencies involved, there can be no assurances
that additional information, study or revised engineering will not be required to obtain the
permit. All information for this process is based upon design data contained in a report entitled,
"Village of Tequesta, Country Club Community Drainage Study", dated April 1998, prepared by
Cherie Sova, P.E.
Scope of Services
1. Field review existing facilities.
2. Review of the Sova Study.
3. Project review meeting with the_Village of Tequesta.
4. Pre-application meetings with South Florida Water Management District and U.S.
Army Corps of Engineers.
5. Prepare SFWMD ERP application.
6. Prepare COE Nationwide permit application.
7. Provide responses to one request for additional information from regulatory
agencies.
8. Field meetings with regulatory and commenting agencies, including the U.S. Fish
& Wildlife Service, Florida Game & Fresh Water Fish Commission, Loxahatchee
River Coordinating Council, Corps of Engineers, South Florida Water
Management District.
It should be noted that the scope does not include surveying, wetland delineations, surface water
management design, or additional engineering if required. Should additional surface water
management review, design or engineering be required, they would be considered additional
services.

The cost of the above referenced tasks will be a lump sum fee of Sixteen Thousand Dollars
($16,000.00), including reimbursables. This proposal is intended to serve as a supplemental
agreement to the original contract dated September 16, 1993 and all terms and conditions of the
contract, unless specifically modified herein, shall remain the same. Should you agree to the
conditions and scope of this proposal, please execute in the location provided.

We are pleased to submit the following proposal for professional services in connection with drainage
improvements within the Tequesta Country Club community. The following is an itemized list of the services
required to prepare construction plans for this project.
1. Prepare construction drawings based upon design data contained in a report entitled: Village of Tequesta,
Country Club Community e Study, dated April 1998, prepared by Cherie Sova, P.E., 4070 Okeechobee Blvd.,
Suite 221, West Palm Beach, FL 33409;
2. Develop a cost estimate;
3. Prepare construction plans and specifications.
The cost of these services will be a lump sum fee of $13,750.00, including reimbursables.
It is possible that permitting agencies may require changes to the design prepared by Cherie Sova, P.E. Design
changes are note included in the above fee quotation and will be separately negotiated, if necessary.
This proposal is intended to serve as a supplemental agreement to the original contract dated September 16, 1993
and all terms and conditions of the contract unless specifically modified herein, shall remain the same. Should you
agree with the conditions and scope of this proposal, please execute in the location provided.

Per the direction of Allen Oslund, Gee & Jenson was tasked with initial investigations and
contacts with regulatory and commenting agencies regarding the above referenced project.
Specifically, we were asked to write letters to the U.S. Army Corps of Engineers (COE), the
South Florida Water Management District (SFWMD), the U.S. Fish & Wildlife Service
(USFWS), and the National Marine Fisheries Service (NMFS). The intent of these letters was to
advise them of the proposed project as studied and designed by Cherie Sova, P.E., and request
any initial comments or concerns. In addition, we were requested to have a preliminary meeting
with the COE and the SFWMD to determine potential permitting concerns.
As a result of these letter solicitations and the meeting with the District and COE, we offer the
following observations:
• In response to the letter request, the USFWS reviewed the proposed modifications and
determined that "any potential impacts upon fish and wildlife resources which may occur as a
result of this project, as described in your letter, appear to be insignificant". The USFWS
response letter is attached for your file.
• The NMFS, Southeast Regional Office, indicated that "cumulatively, increases in peak
discharges throughout the water shed can result in adverse impacts to these estuarine
resources". Based on the preliminary information, it was difficult for them to determine the
overall impact and suggested that we contact the COE and the SFWMD. The NMFS
response letter is attached for your file.
The SFWMD offered three primary comments: first, although they recognized that the
proposed plan will decrease the total discharge volume to the Loxahatchee River, they are
concerned that the proposed peak discharge volume is higher than the current rate, and that
the fast influx of fresh water into the River may cause adverse impacts to the estuarine
ecosystem. Secondly, the District issued a concern regarding septic tanks in the area, and the
potential that a septic system failure could cause increased fecal coliform discharges into the

Loxahatchee River. Thirdly, the District indicated that a presentation to the Loxahatchee
River Coordinating Council (LRCC), an advisory oversight committee for this region, might
be considered. A copy of SFWMD's response letter is attached.
• The COE has not issued any response to our letter request, but in our joint meeting with the
SFWMD, they indicated that based on our explanation of the project, they anticipated that a
Nationwide permit would be required.
As indicated above, we did have a joint meeting with the COE and SFWMD on September 30,
1998. Representing those two agencies were Don Medellin (SFWMD) and Tori Agramonte
(COE). No substantial additional information wras uncovered. The District's position was still
one of concern with respect to the proposed increase in peak discharge volumes. Their desire is
to continue to reduce the total and peak volume discharges to the River. The District was advised
of a previous study prepared for the Village of Tequesta that indicated outfall from these systems
into the Loxahatchee River did not indicate that fecal coliform discharges were an issue. The
District indicated that if we copied them on the report, this issue would be resolved. The District
again suggested we present our proposed project to the LRCC, and incorporate any practical
positive suggestions. The COE's comments were as noted above, and did not suggest that that
agency would play a substantial role in the permitting of the project.
With respect to permitting in general, we offer the following observations:
It is anticipated because of the Outstanding Florida Water designation of the Loxahatchee
River, that special emphasis will be placed on the discharges from this system. This
emphasis was clearly at the forefront of permitting of the Dover Ditch outfall. While a
preliminary review of the Sova study indicated a reasonable approach to stormwater
engineering and design, additional study and design may ultimately be required as a result of
the permitting process. Conceivably, additional detention may be achievable within the total
system and reduce or eliminate the increase in peak discharge volumes. This single element
within the study design would appear to be the weak link and offer the highest potential for
permitting controversy.
We have been contacted by Mr. Woody VanVoorhees of the SFWMD regarding a
presentation to the LRCC. Mr. VanVoorhees is the District liaison for this Council and was
copied by the District on our initial information request letter. The Council is not a
regulatory body, but an advisory and oversight committee on issues that impact this
environmentally sensitive area. While it is not mandatory that ire present the project to the
Council, it is our opinion that an informational presentation, particularly if we could indicate
that we can reduce discharges to the River, could grease the permitting process from the
District's perspective. By way of this letter, I am requesting direction from the Village
regarding this matter.
