Bradford, Village Manager From: Joann Manganiello, Assistant Village Manager/Village Clerk ~ , Date: 11/12/1998 Subject: Consideration of Request from Youngquist Brothers to Work Extended Work Hours and on Sundays and Holidays In preliminary talks with Reese, MaCOn and Associates, Ina, our R.O. Consultants, Youngquist Brothers, Inc., apparent low bidder for the R.O. Well No. 2 Construction and R.O. Well No. 1 DevelopmentlTesting Project, discussed the need for extending their working hours beyond the normal working day (7:00 a.m. ~ 6:00 p.m -Monday through Saturday -per Village Ordinance) during critical operations, as well as, the possibility of working on Sundays and Holidays, as warranted, upon request and approval of the same, if the Project is awarded to them. Approval of extended working hours and working on Sundays and Holidays is granted by the Village Council upon request in advance of the anticipated work. To expedite the construction and development/testing of the R.O. Wells, which is starting later than anticipated due to the need to rebid the same, it is respectfully requested that the Village Council give consideration to authorizing you as the Village Manager to approve or deny any requests from Youngquist Brothers to work on a Sunday or Village recognized Holiday. This authorization will preclude the need to wait for the next regularly scheduled Village Council Meeting, which may be untimely, to request Village Council approval. Construction time for the R.O. Wells Project is 120 days. During this time period,. the Village recognizes the following holidays: Thanksgiving Day, the day after Thanksgiving, Christmas Eve, Christmas Day, New Year's Eve, New Year's Day, and Presidents' Day. Permission to work on any of the above referenced Holidays, on a Sunday, or after hours on any weekday would be granted at the discretion of the Village Manager upon request from Youngquist Brothers and recommendation of Reese, Macon and Associates for the need for the same. Bill Reese has indicated to me that an accelerated construction schedule for construction and development/testing of R.O. Wells No. i and 2 would be beneficial in that completion of this phase of the RO. Facility Construction Project has a direct bearing on the progress and timeliness of the Project as a whole. WeU Na 1 Development/Tesling; Agenda Item Enclosed, please find an Engineering Services Proposal from Reese, Macon and Associates, Inc. of Lake Worth, Florida, our RO. Engineering Consultants, in the amount of 548,500. This proposal is for the provision of engineering services during the constxuction/developmendtesting of the above referenced RO. WeUs. This proposal does not include full-time representation on site. However, daily on site visits for a few hours are anticipated to observe operations end pull water samples when necessary. Full-time representation is anticipated during key events, such as, setting of casings, development, and pump tests. Funding for these engineering services will be provided by the Water Enterprise Fund, Bond Construction Accourrt, having a FY 1998/99 budget allocation of $48,500. Please places the Engineering Services Proposal on the November 12, 1998, Village Council Meeting Agenda. for consideration by the Village Council. Thank you. Additionally, the Bid Award for the R.O. Well No. 2 Construction and RO. Well No. 1 Development/Testing will also be presented to the Village Council for consideration on the same agenda. Well No. 1 and 2 Construction Services Gentlemen: We are pleased to submit this proposal for engineering services during construction in connection with the development/testing of R.O. Well No. 1 and the construction of R O. Well No. 2. REESE, MACON and ASSOCIATES, INC., hereinafter referred to as the Engineer, shall perform the services as documented below for the Village of Tequesta, hereinafter referred to as the Client. SCOPE The following specific tasks will be performed by the Engineer::• 1. Perform construction contract administration services to include engineering duties as set forth in the General Conditions and Supplementary General Conditions. 2. Provide part-time resident project representatives on site to observe the work. Note that this work will be done with RMA and ARCADIS Geraghty & Miller representatives. The above scope is predicated on the assumption that the Client shall furnish, at no cost to the Engineer, all available pertinent information including previous reports, plans, specifications, permits and other data relevant to the performance of the above services for the project. In addition, the Client shall designate, in writing, a person to act as the representative for services performed under this agreement. The following specific information and/or items shall be furnished at no cost to the Engineer: 1. TIIVIE OF PERFORMANCE The Engineer will commence work upon of receipt of an executed authorization and the award of the project to a well drilling contractor. The Engineer acknowledges that the time frame for this project is critical. Items 1 and 2 of the Scope of Services will be completed commensurate with the construction contract which will be 120 days except for delays beyond the control of the Engineer. FEES For Scope Items 1 - 2 the Engineer shall be paid a lump sum fee of Forty Eight Thousand, Five Hundred dollars ($48,500.00). It is noted that this fee is predicated on the assumption that the construction contract will be completed within the contract stipulated time. If services aze required in the performance of the above scope, beyond those normally provided by the Engineer, which must be sublet, the Engineer shall order the work after obtaining the written authorization of the Client. The subcontractor shall bill the work directly to the Client. If the Engineer is requested to subcontract the work directly, a ] 0% handling charge will be added to the subcontractors invoice. Invoices for services rendered are issued on a monthly basis and are due within thirty (30) days of the invoice date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due statements. Interest shall be computed on past due statements from the date of the invoice. TERMINATION This agreement may be terminated by either party by giving thirty (30} days written notice. The Engineer shall be paid for all services rendered prior to the termination date. -2- ACCEPTANCE Acceptance of this proposal may be indicated by executing this document in the space provided below. This contract shall be considered void if not executed within thirty (30) days from the above date. Upon execution of this agreement the Client shall return one copy to the Engineer.
