Bradford, Village Manager ~ ~r / Date: January 8, 1999 Subject: Consideration of Request for Installation of Parking Lot Curb Cut/Driveway Entrance to Existing Paved Parking Area at 195 Tequesta Drive; Agenda Item This development matter request is somewhat unique. Therefore, I felt I should provide a statement regarding the same for your consideration. Between the former Alex Webster's Restaurant and the new McCarthy's Restaurant and Pub, is a finger of land owned by the Dorner Trust which is a part of the larger undeveloped parcel from Tequesta Drive to the new Post Office currently under construction. It is our understanding that McCarthy's has reached an agreement with the Dorner Trust to purchase this finger of land in order to expand its parking area. The current parking area available to McCarthy's exceeds the Tequesta Parking Code requirements. However, the McCarthy's desire to provide for additional parking to serve their thriving business. The parking lot that exists on this finger of land formerly served as overflow parking to Alex Webster's Restaurant. However, according to Scott Ladd, there are no records of this parking lot ever having been reviewed by the Village Council in the past. Tequesta does not allow stand-alone parking lots as a permitted use. Nevertheless, the reason this matter is before you is that the McCarthy's wish to have access to the parking lot during this winter season by allowing them to have a curb cut/driveway installed at this time. This is acceptable to the Village Staff provided that 1. Approval of modification of the McCarthy's site plan is received from the Village Council within four months' time. Therefore, the revised site plan must be submitted to the Village in a timely fashion. r i 2. No rights of access inure to the benefit of the Dorner Trust by virtue of the temporary approval of a curb cut/driveway or approval of the site plan modification for McCarthy's. 3. In the event that the sale between the Dorner Trust and the McCarthy's falls through or a site plan is not submitted in four months, Tequesta maintains the right to re-install the curb and eliminate the driveway. 4. Other conditions referenced in the attached staff report. The primary concern of the Village Staff is that the Dorner Trust wishes to have ingress and egress from this finger of land to Tequesta Drive . The problem is that at this time, no one knows what type of facilities will be proposed for the current vacant Dorner Trust land. The Village Council needs to reserve the right to deny or control ingress and egress over the McCarthy's newly purchased parking lot, depending upon what type of land use is proposed for the current Dorner Trust vacant land in the future. Hopefully, if these conditions are imposed, the McCarthy's can purchase their property now, use it as a parking lot this winter season, come back within four months for site plan modification to address such things as Ordinance No. 377, and ingress and egress over this property to Tequesta Drive by future projects to be developed on the Dorner Trust land can stand on its own merits based upon the specifics of a future development proposal and the traffic generated therefrom. The proposed project will include a curb cut and driveway entrance onto Tequesta Drive. 'Plus proposed project will temporarily serve as additional parking for McCarthy's Restaurant and Pub, until such time as agreed upon far applicant to return for required review of modification to existing McCarthy's Restaurant ~ Pub site plan. The DRC reviewed the proposed project on January 6, 1999; therefore, we now need t0 schedule the project for review by the Village Council. Please schedule the review of the proposed Parking Lot Curb Cut /Driveway Entrance onto Tequesta Drive on the upcoming January 14, 1999 Village Council Meeting. Thanks. VILLAGE OF TEQUESTA VILLAGE COUNCIL January 12, 1999 Staff Report and Recommendations for Development Review Committee (DRC) and Site Plan Review (SPR) Back rg ound: Application for review per Village of Tequesta Right-of--Way Procedures have been submitted for aroad-cut and driveway entrance for 195 Tequesta Drive. The proposed parking addition is currently a vacant unimproved lot facing Tequesta Drive. This project is to be done to allow McCarthy's Restaurant and Pub additional parking. Upon completion of the project, the property will be sold to the McCarthy Family. The road cut / driveway entrance must meet all FDOT requirements for curb cuts and proximity to existing curb cuts. Once the driveway is done, the McCarthy family will have four. months to complete the existing site improvements. The application was submitted by Captec. Engineering, Inc., Captec is the authorized agent for Mr. Gary Van Brock, agent for Beneficiaries of First Union National Bank as Trustee U/T 400. Staff Report and Comments: An informal Development Review Committee process was performed on January 6, 1999. Chief Steve Allison, Chief Jim Weinand, Gary Preston, Russell White, Scott Ladd, and Kara Irwin were all represented in the review. Staffs review, comments and requests are outlined below: Comments by Scott D. Ladd, Director of Community Develoament: • The plan must include stop bars and stop sign, which shall be the responsibility of the applicant. • The applicant must take responsibility to locate and mitigate any other utilities in the area. • The applicant must also provide a FDOT approved `Right Turn Only' sign for the Tequesta Drive access from the parking lot. • Upon completion of the project, the applicant must submit, in addition to items set forth in the January 5,19991etter from Mr. Gary Van Brock (copy attached), an irrigation plan and an appropriate site lighting plan. • The applicant must also take responsibility for the relocated trees, should they not survive the process. • In the event that the anticipated sale of parking area to the McCarthy's does not close, The Village of Tequesta reserves the right to close off the curb cut /driveway entrance. Comments by Kara L. Irwin, Planner • The representative from McCarthy's Restaurant must provide separate letter of intent pertaining to site improvements for the parking lot. Comments by Chief James M. Weinand, Fyre Chief • I have reviewed the application for the curb cut and I do not see any problems with this. Comments by Russell K. White, Facilities Supervisor • After review of the above referenced plan, I have some concern as to the exact location of the proposed entrance. It dos not pose a problem at this time, but upon review of the site plan, there is a possibility that the water service currently feeding 209 Tequesta Drive will have to be relocated. If in fact the service does have to be relocated, it would be at the expense of the contractor. Comments by Garv Preston, Director of Public Works & Recreation • After review of the above referenced plan, I have no objections to the proposed work at this time. Comments by Chief Steve Allison, Police • The police department has the following concerns about this project. Some of these items maybe more applicable for the site plan review of the parking lot itself. • On this short notice, we have not been able to locate FDOT regulations on distances between curb cuts. Permission should not be granted until this is determined. • Traffic exiting this parking lot must be required to make a right turn. Applicant should install signs and pavement marking. This is a very important safety issue. Does the applicant know that the painted safety zone on Tequesta Drive will probably become a raised median at some point in the future? • After visiting the site and reviewing the drawing, I was unable to determine if the proposed location of the moved trees will block the view of exiting motorists. This should be deternned before the trees are moved. • Contractors doing the curb modifications must provide a maintenance of traffic plan (MOT} for approval by the police department. Staff Recommendation: Staff recommends approval subject to conditions of DRC Review set forth above.
