Bradford, Village Manager ~~~j December 2, 1998 Discussion of Annexation Area VI For March 1999 Referendum; Agenda Item The pursuit of an annexation referendum during calendar year 1998 within one annexation area was an objective given to the Village Manager. A Finance and Administration Committee Meeting was held on June 24, 1998 to discuss annexation plans. The Committee recommended to the Village Council that area VI, south of Tequesta Park be considered for an annexation referendum in March of 1999, if persons in support of the same are located and Village Councilmembers are interested in bearing the flag on this issue in that area. Attached hereto, please find a listing of all registered voters residing within annexation area VI for your review in this regard. Area VI had the highest vote for annexation (38%) in the 1995 referendum. It includes the Tequesta Hills subdivision whose residents, we believe, are desirous of greater police presence and protection and quicker response time provided by both the Tequesta Police and Fire-Rescue departments. This area may still be strongly supportive of annexation for the reasons so stated. On the other hand, Village Council should consider the ramifications of holding a referendum in area VI when at the same time they are urging Representative Warner and others to sponsor special legislation to annex Anchorage Point. This matter has been placed before you at this time in order to secure your direction in the event you wish to pursue a referendum in March of 1999. Time is critical in this regard and an ordinance considered by the Village Council at your meeting in January, 1999, if you wish to pursue annexation of area VI in March of 1999. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, ANNEXING INTO THE VILLAGE CERTAIN AREAS OF LAND; PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY PROPOSED TO BE ANNEXED; REDEFINING THE BOUNDARIES OF THE VILLAGE TO INCLUDE SAID REAL PROPERTY; PROVIDING FOR A REFERENDUM ELECTION IN THE VILLAGE AND WITHIN THE AREA PROPOSED TO BE ANNEXED; DIRECTING THE CLERK OF THE VILLAGE TO PUBLISH THE NOTICE OF THE REFERENDUM; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. Section 2. The boundaries of the Village of Tequesta, Florida, are hereby redefined and shall include the above-described real property, and said property is hereby declared to be within the corporate limits of the Village of Tequesta, Florida. Section 3. A referendum election shall be held on the Stn day of March, 1999, within the Village of Tequesta, Florida, and within the lands described above, which are proposed to be annexed hereby, for approval of the proposed annexation. The referendum shall be worded on the ballot as follows: "FOR ANNEXATION OF ORDINANCE NO. _ TEQUESTA, FLORIDA" THE PROPERTY DESCRIBED IN OF THE VILLAGE OF "AGAINST ANNEXATION IN ORDINANCE NO. TEQUESTA, FLORIDA". OF THE PROPERTY DESCRIBED OF THE VILLAGE OF Section 4. The Village Clerk is hereby authorized and directed to publish the notice of referendum election at least once each week for two consecutive weeks immediately preceding the date of the referendum in a newspaper of general circulation in the area in which the referendum is to be held, and to otherwise comply with the requirements of Section 171.0413, Florida Statutes, and all other Florida Statutes pertaining to the conduct of elections and annexations. Section 5. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can. be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 6. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 7. Codification. This Ordinance shall be codified end made a part of the official Code of Ordinances of the Village ~f Tequesta. Page 2 of 3 Section 8. Effective Date. This Ordinance shall become effective upon date of passage; and the annexation of the aforesaid-described property shall be effective on the lst day of June, 1999, and only upon approval in the referendum election by a separate majority vote of electors voting within the Village and electors voting within the lands proposed to be annexed.
