Ladd, Director of Community Development ~~ DATE: December 1, 1998 SUBJECT: Adoption of latest Construction Codes and Countywide Amendments thereto, as Recommended by the Building Code Advisory Board of Palm Beach County and As mandated by the State of Florida. Tom, attached is a draft ordinance to adopt the latest construction codes as mandated by the State and the countywide amendments to those codes as recommended by the Code Advisory Board of Palm Beach County. This is a housekeeping item in that the State of Florida requires each County and Municipality to adopt the latest edition that has been adopted by the State as the minimum codes governing the construction industry within the State of Florida. The State of Florida has adopted the 1997 Standazd Building, Gas, and Mechanical Codes and the 1994 Standazd Plumbing Code as the minimum Codes for use in Florida. A copy of the draft ordinance has been sent to the Village Attorney for review for legal form and sufficiency. Please place the draft ordinance on the December 10, 1998 Council Meeting for first reading Thanks. Copies of the proposed codes for adoption aze available for Public inspection at the Department of Community Development. It is not required that this item be in the form of a legal advertisement and the readings of the ordinance and subsequent adoption are not quasi judicial public hearings. Codes98 ORDINANCE NO. AN ORDINANCE OF THE VH.LAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, BUILDINGS AND BUIIDING REGULATIONS, AT SECTIONS 6-21, 6-22, 6-61, 6-62, 6-101, 6-102, 6-121, AND 6-122, TO PROVIDE FOR THE ADOPTION OF THE 1997 STANDARD BUILDING, GAS AND MECHANICAL CODES, AND THE 1994 STANDARD PLUMBING CODE, AND THE 1997, 5-19-98 EDITIONS OF THE UNIFORM COUNTYWIDE AMENDMENTS TO THE STANDARD BUILDING, GAS AND MECHANICAL CODES, AND THE 1994, 8-19-98 EDITION OF THE UNIF01tM COUNTYWIDE AMENDMENTS TO THE STANDARD PLUMBING CODE; PROVIDING FOR PREVAILING STANDARDS IN THE EVENT OF CONFLICT; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABII.ITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village of Tequesta, Florida has adopted uniform building codes together with certain amendments to the codes which are intended to address specific local conditions within Palm Beach County, Florida; and, WHEREAS, new model codes have now been published in the several categories relating to building and construction, and the same have been updated and revised, including administrative changes, as recommended by the Palm .Beach County Building Code Advisory Board; and, WHEREAS, the Village Council of the Village of Tequesta has determined that the 1997 editions of the Standard Building, Gas and Mechanical, and the 1994 edition of the Standard Plumbing Code, and the Uniform Countywide Amendments thereto, are consistent with the adopted Comprehensive Development Plan of the Village of Tequesta, Florida, as required by Section 163.3194(2), Florida Statutes; and, WHEREAS, the Village Council of the Village of Tequesta, Florida, deems it necessary and advisable to amend its building and construction codes by adopting the 1997 Building, Gas and Mechanical Codes, and the 1994 Plumbing Code, and amendments as set forth herein, NOW, THEREFORE, BE IT ORDAINED BY THE VII.LAGE COUNCIL OF THE VII,LAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. Section 6-21 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Standard Building Code, 1997 Edition, as fully as if set forth at length herein as the Building Code of the Village of Tequesta. Section 2. Section 6-22 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Uniform, Minimum Countywide Amendment to the Standard Building Code, 1997, 8-19-98 Edition, as fully as if set forth at length herein. Section 3. Section 6-61 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Standard Gas Code, 1997 Edition, as fully as if set forth at length herein as the Gas Code of the Village of Tequesta. Section 4. Section 6-62 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Uniform, Minimum Countywide Amendment to the Standard Gas Code, 1997, 8-19-98 Edition as fully as if set forth at length herein. Section 5. Section 6-101 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Standard Mechanical Code, 1997 Edition, as fully as if set forth at length herein as the Mechanical Code of the Village of Tequesta. Section 6. Section 6-102 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Uniform, Minunum Countywide Amendment to the Standazd Mechanical Code, 1997, 8-19 98 Edition, as fully as if set forth at length herein. Section 7. Section 6-121 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Standard Plumbing Code, 1994 Edition, as fully as if set forth at length herein as the Plumbing. Code of the Village of Tequesta. Section S. Section 6-122 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Uniform, Minimum Countywide Amendment to the Standard Plumbing Code, 1994, 8-19-98 Edition, as fully as if set forth at length herein. Sech_on 9. Prevailing standazds in the Event of Conflict. It is the intent of this Ordinance to maintain the highest standards for building and construction in the Village of Tequesta. Therefore, in the event of a conflict between the standards and requirements of the several codes hereby adopted, the more stringent provisions shall prevail. Section 10. Repeal of Ordinances in Conflict. All other Ordinances of the Village of Tequesta, Florida, or parts thereof, which conflict with this or am other part of this Ordinance are hereby repealed. Section 11. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. .~ Section 12. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Sech_on 13. Effective Date.
