RESOLUTION NO. 1-98/99
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, SUPPORTING
REVISION NO. 7 TO THE FLORIDA CONSTITUTION, AUTHORIZING
THE SUBMITTAL OF A COPY OF THIS RESOLUTION TO THE FLORIDA
LEGISLATIVE DELEGATION AND THE PALM BEACH COUNTY
LEGISLATIVE DELEGATION, PROVIDING AN EFFECTIVE DATE.
WHEREAS, the voters of the State of Florida adopted Article V of the Florida Constitution in 1972;
and
WHEREAS, the intent of the framers and voters in 1972 was to create a uniform state court system
funded in large part by the state and not solely by the counties; and
WHEREAS, Florida's counties now pay well over half of the cost of the state court system; and
WHEREAS, the counties of Florida annually spend in excess of $650 million to fund Article V
costs; and
WHEREAS, the Village Council of the Village of Tequesta supports Revision No. 7 to Article V
which, if approved by the voters, would require the state to fund all costs of the state court system,
the public defenders, the state attorneys, and the court-related functions of the clerk of the circuit and
county courts, with the exception of communications services, radios, existing criminal justice
information systems, the construction, maintenance, utilities and security of facilities, and local
requirements for the state courts; and
WHEREAS, the proposed revision to Article V would save counties in excess of $220 million
annually; and
WHEREAS, the passage of Revision No. 7 would result in enhanced local revenues that can be used
to provide much needed local services such as transportation, law enforcement, and health care, and
may ultimately provide property tax relief.
;NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA AS FOLLOWS:
Section 1. That the Village Council of the Village of Tequesta does hereby endorse passage of
Revision No. 7 to the Florida Constitution.
Section 2. That copies of this Resolution shall be forwarded to The Florida Legislative Delegation
and The Palm Beach County Legislative Delegation.

who moved its adoption. The motion was seconded by Councilmember ,and upon
being put to a vote, the vote was as follows:

On November 3 the voters of your municipality will be voting on 13
Constitutional Revisions selected by the Constitution Revision
Commission (CRC ). The CRC is an appointed citizens committee
convened every 20 years to recommend changes to the State Const~tuti911. - ---
One of the most important proposals put forth by the Conunission is
Revision 7 -THE LOCAL OPTION FOR SELECTION OF JUDGES
AND FUNDING OF THE STATE COURTS.
Revision 7 proposes several issues. The first will allow counties to vote
whether or not their judges should be elected or appointed - it does not
determine the issue, but lets the voters of each county decide on their own
beginning in the year 2000.
Another proposal, which is very important, requires the state to take its
assigned responsibility for funding our state court system. The state hasn't
kept up with the increased demand to fight crime and its related court
costs, so counties now pay more than one-half of these expenses.
The passage of Revision 7 would free up to $16 million in court costs now
being paid by local county taxpayers each year. Funding for the state
court system should be through state revenue sources, such as the sales tax
because it is fair -everyone, including tourists, will contribute to the
system.
Revision 7 is about letting each county determine through local option
whether or not they want elected or appointed judges. It's about fairness
and getting the state to keep its promise - a promise made 26 years ago.

Attached are copies of Resolutions adopted by the Florida League of
Cities and the Palm Beach County Municipal League endorsing Revision
7 and urging its members to work for its passage. I am requesting that you
consider adopting a similar resolution and forwarding to me before
October 6, 1998. If you are unable to process the resolution by this date
please forward it as socn as possible.
Additionally, we are sending similar information to homeowners
associations and civic groups in your area and you maybe hearing further
from your District Commissioner about this issue. Any assistance you can
provide in educating the voters about Revision 7 is greatly appreciated and
vital to our success.

A RESOLUTION OF THE PALM BEACH COUNTY MUNICIPAL LEAGUE,
INC, SUPPORTING REVISION #7 TO THE FLORIDA CONSTITUTION AND
ENCOURAGING ALL MUNICIPALITIES TO EDUCATE THEIR CITIZENRY
ON THE IlVIPORTANCE OF AND NEED FOR THIS REVISION;
AUTHORIZING THE SUBMITTAL OF A COPY OF THIS RESOLUTION TO
THE FLORIDA LEGISLATNE DELEGATION, THE PALM BEACH COUNTY
LEGISLATIVE DELEGATION, AND ALL MUNICIPALITIES IN PALM
BEACH COUNTY; PROVIDING AN EFFECTNE DATE; AND FOR OTHER

passage of Revision #7 to the Florida Constitution and urges its members to work for passage of
this amendment.
Section 2. That copies of this resolution shall be forwarded to The Florida Legislative
Delegation, The Palm Beach County Legislative Delegation, and all Municipalities in Palm Beach
County.
Section 3. This Resolution shall take effect immediately upon adoption.
