Tom, attached are 18 packets and plans for the above subject project which were
reviewed by the Community Appearance Board, on October 23, 1996 and November 18,
1998.
These plans were originally submitted for review by the Community Appearance Board on
October 23, 1996. The Board discussed the four waivers listed on the application and
added a fifth waiver for native percentage (22% provided) which had not been listed. A
good portion of the discussion centered around the size of the parking spaces with the
applicant stating that the 10' spaces were needed because "60% of the buildings
population was older than sixty and it was a real problem". The application was tabled so
that the applicant could take afl of the ideas back to the owner for consideration of the
overall cost and practicality and possibly return with a revision to the plan.
Plans revised in accordance with the CAB recommendations from the October 23, 1996,
meeting were finally submitted on October 20, 1998, and went back to the Board for
review on November 19, 1998. The Board had the following comments/concerns:
o The Board was advised that space for parking was very limited on this site and
there was concern with making the parking spaces smaller because there were
so many elderly residents who typically needed larger parking spaces; however,
the sizes had been reduced to 9.5' X 20'.
~ The Board discussed the use of mahogany trees in the four new landscape
islands being added along Fiesta Avenue. They were told that the mahogany
trees thrived much better than oaks in confined locations and would grow much
quicker than oaks in this location.
~ The Board noted that Ilex Shilling was shown on the plan at the south end of the
building but was not listed on the plant list. They requested that some. of the
flex Shilling be relocated to the new landscape islands.

CAB Project Recommendation
Motion to approve the proposed landscaping and waivers as submitted with the following
modifications:
1. That a number of the Ilex Shilling currently shown on the south end of the
property be relocated onto the terminal parking islands along the west side of
the property, the number to be determined by the Landscape Architect and his
contractor (probably ten to twelve);
2. That the approval shall include the original dumpster plan or Alternative A, as
shown on the landscape plan.
Vote on the motion: 5-0 to approve.
Parking for this property is calculated at two parking spaces per unit: 110 parking spaces
required / 90 parking spaces provided.
Existing % of property devoted to landscaping: 29%
Proposed % of property devoted to landscaping: 29.6 % (Adding 4 6' X 20' landscape
islands = 480 square feet of additional landscaping.)
Staff recommends approval subject to the Community Appearance Board requested
modifications.

Dear Scott:
In response to your letter dated December 3, 1998, please find enclosed 23 sets of
Landscape Plans for the Village Apartments that have been revised in accordance with
the Community Appearance Board's recommendation for approval. The modification to
the plans includes the relocation of Ilex vomitoria from the south end of the property to
the four parking islands along Fiesta Avenue.
It is my understanding that upon receipt of the requested documents this matter will be
placed on the Village Council agenda for approval of the landscape plan. Should you
have any questions or need any additional information please do not hesitate to contact
me. I look forward to receiving your notice of the Villager Apartments placement on the
Village Council's agenda. For scheduling purposes I will be out of town from January
16th through 23rd, 1999.

Dear Mr. Hearing:
This letter is to confirm the action of the Village of Tequesta Community- Appearance Board at
their November 18, 1998, meeting approving as submitted your application for The Villager
Apartments located at 360 Fiesta Avenue with the following modification:
Relocate from the. south end of the property to the two parking islands along the west side
of the property, ten (10) to twelve (12) Ilex Schilling plants per each terminal parking
island.
This approval is also subject to the inclusion of the original dumpster plan or the alternative "A"
dumpster plan.
As you are aware, these projects must be reviewed by the Village Council for approval of the
requested landscape waivers and will be placed upon the agenda of a Council meeting upon
receipt of 23 revised plans as approved by the Community Appearance Board.

Mr. William Shannon, Attorney for the applicant,
explained that Landscape Architect Donaldson Hearing was
on his way and that this matter had been tabled at the
October 26, 1996 meeting for revisions to the landscape
plan. Attorney Shannon reported those revisions and
additional revisions as requested had been submitted by
the applicant. Mr. Hearing arrived at 9:42 a.m. Mr.
Hearing reviewed the additional revisions which had
recently been made to the plans, and explained that space
far parking was very limited on this site and commented
there had been concern with making parking spaces smaller
because there were so many elderly residents who
typically needed larger parking spaces; however, the
sizes had been reduced. Mr. Hearing explained that four
new landscape islands had been added along Fiesta Avenue
with mahogany trees planted in each island. Alternative
arrangements had also been provided on the plans for the
dumpster. Mr. Hearing advised the Board that as plant
materials required replacement they would be replaced
with native plants. In response to a question regarding
why mahogany trees had been used, Mr. Hearing explained
that mahogany trees thrived much better than oaks in a
confined location adjacent to lime rock and would grow
much quicker than oaks in this location. The mahogany
trees were to be installed at 12'-14' with a 6' spread
which would reach a 20' to 40' canopy over time. Sod was
proposed for the base planting. Chair Cook suggested a
larger tree height at planting. Mr. Hearing explained
that would increase the cost, which was a concern to the
owners. Boardmember Coben expressed his opinion that
this plan represented a significant improvement and
addressed the October 1996 Board requests. During
discussion of ficus at the rear of the building, Mr.
Hearing explained .those had been removed. Vice Chair
Strahan pointed out that Ilex shown on the south end of
the building was not listed. Mr. Hearing wrote in on two

sets of plans the following addition: Ilex Schilling in
No. 3 pots 12" x 18" overall, with spacing of 2~.
Vice Chair Strahan requested some of the Ilex Schilling
which was to be planted on the south end of the building
be relocated to the islands. During ensuing discussion,
Boardmember Walker requested the Ilex not interfere with
opening of car doors. Mr. Hearing explained there would
be a sod strip next to the island edge.
Vice Chair Strahan questioned what should be done about
the alternative plan for the dumpster, to which Mr. Ladd
responded the Board could approve either way and that the
alternative to be used depended on the actions taken by
the adjacent property owner.
Vice Chair Strahan made a motion to approve the
application from Cotleur & Hearing, inc., for landscape
plans for Ordinance #377 compliance for The Villages
Apartments, 360 Fiesta Avenue, as submaitted pith the
modification that a number of the Ilex Schilling plants
currently shopn in the south end of the property be
relocated onto the terminal parking islands along the
pest side of the property, the number to be determined by
the Landscape Architect and his contractors and that
approval shall include the original dumpster plan or
alternative A. Boardmember Cobea seconded the motion.
During discussion of the motion Vice Chair Strahan
comdmeated to abr. Hearing to move just enough of the Ilex
Schilling pleats to the islands to make a significant
difference, to phich ate. Hearing responded that probably
ten to tpelve vrould be moved to each island. The vote oa
the motion was:

On behalf of Robert F. Cromwell we are pleased to submit to you 15 copies of the
proposed Landscape Plans for the Villager Apartments. The plans have been revised in
accordance with our meeting earlier this month. We have incorporated all of the
requested modifications as outlined in your May 28. 19981etter regarding the same.
Based on our meeting it is our understanding that you will be recommending that this
plan be adopted by the Beautification Committee and the Village Council.
As you are aware the Villager Apartment matter has been forwarded to the Code
Enforcement Board and is scheduled to be heard by the Special Master on October 29,
1998. While it is our understanding that we have an agreement on the proposed
improvements to satisfy the requirements of Village Ordinance 377 we would like to go
on record with the Special Master that you will be recommending our plan to the Village
for final approval. If you could provide correspondence in this regard we would be
greatly appreciative.
In reviewing the plans you will note that we have provided an alternative configuration
for the northeast corner of the property. It is my understanding that you have had some
conversations with the property owner concerning the potential of relocating the existing
dumpster into the alley. If this is possible, it would enable us to provide an additional 3
parking spaces on the site and assist in further mitigating the parking problems that exist.
We are aware that the Village is currently discussing this area with the adjacent property
owner. We thought that it would be more efficient to provide an alternative configuration

Boardmember Nielson made a motion to modify the landscape
plans for The BRITT Building to remove the existing
oleander and replace it with a native hedge such as
cocoplum; to change the driveway opening from 28' to 24'
to eliminate one waiver, and to extend the landscaping
into the 4' that would become available. Boardmember
McCormick seconded the motion. The vote on the motion
was:

5. An application frgm Cotleur Hearing, Inc., for review of
landscape plans for Ordinance #377 compliance for The
Villager Apartments, 360 Fiesta Avenue. (Rescheduled
from September 11, 1996 meeting)
Donaldson Hearing, agent, introduced Mr. Robert Cromwell,
owner; Mr. John Pearson, building manager; and the
owner's representative, Mr. William Shannon, Esquire.
Mr. Hearing commented that Code required 110 parking
spaces, and that only ninety 10' x 20' spaces were
provided, which were existing. Mr. Hearing explained
that smaller spaces had not been used because most of the
residents were elderly and needed to use the front spaces
because the rear parking was a dead end with potholes
where water stood for several days after a rain. Mr.
Hearing reviewed the requested waivers which he indicated
were requested because of lack of room for the required
plantings:
1. 10' Landscape buffer required on front and rear
property lines, 0 proposed.

3. 22 trees required in rear, 20 trees required in
front, 0 proposed.
4. Terminal islands required, none proposed.
Mr. Hearing explained that the fourth waiver for relief
from providing terminal islands, was requested because
of the need to provide as many parking spaces as possible
in an area already short of the number required by Code,
and therefore would not be practical or reasonable with
the elderly population of the building. Mr. Hearing
commented that the plan proposed addition of 28 trees and
several shrubs, and addressed areas visible from the
streets. Mr. Hearing explained that power .lines in the
rear also were a problem.
Acting Chairman Coben questioned the percentage of native
plants, to which Mr. Hearing responded that the plants
which were proposed to be planted included in excess of
60% native plant material; however, because of existing
oleander and viburnum hedges, the total native
requirement would not be met; however, the native tree
requirement would be met. The net percentage would be
approximately 20% native. Mr. Hearing explained that all
trees proposed to be added would be native with the
exception of one tabebuia to be used for accent, which
was a xeriscape plant.
Acting Chairman Coben pointed out that the native
percentage had not been listed as a waiver, and would be
a fifth waiver.
Boardmember Nielson commented that existing landscaping
was not consistent. Mr. Hearing explained how
consistency would be achieved with the additional trees
proposed.
Acting Chairman Coben commented on the 10' x 2Q' parking
spaces, and suggested that changing only 1!3 of the

spaces to 9-1/2' width could provide room for islands; or
giving up an average of 3" per space could provide room
for two or three islands--which would be a small price to
pay to provide some green space within the expanse of
asphalt. Acting Chairman Coben explained that the Board
was not trying to impose rigid standards, but that the
intent of Ordinance 377 had been to correct things just
like this parking lot, to get some green in the lot. Mr.
Hearing responded that economics was not the concern,
but that 60~ of the buildings' population was older than
sixty and it was a real problem. Boardmember Dalack
questioned what the problem was with the population being
elderly. During ensuing discussion,. Acting Chairman
Coben commented that only some of the cars were large,
and that the Board was not proposing 9' wide spaces, even
though that was the new standard, but that if each space
was changed from 10' to 9'8", no one could tell the
difference, and there would be space for three islands.
Clerk of the Board Scott D. Ladd commented that double
striping 9' spaces helped, since people would center on
double lined spaces, but would cross-park on single
lines. It was pointed out that the spaces on the Publix
parking lot were less than 10', were double lined, and
were ample. Mr. Ladd suggested that if 60°s of the
population was elderly, then the lot could be restriped
to make 600 of the spaces 10' wide. Mr. Hearing
explained that when it rained all of the elderly people
needed to park in front, and there was not room.
Boardmember McCormick questioned who was responsible to
correct the drainage problem. Mr. Ladd commented that
the drainage would be addressed by the Village through
the new Stormwater Utility. Mr. Hearing explained that
the younger people parked in the rear.
Acting Chairman Coben suggested that islands could be
placed in line with existing water lines; that he did not
feel it appropriate to coerce the applicant into
adjusting the size on all of the parking spaces, but that
he believed it was insulting to the residents to say
that some of them could not handle 9-1/2' parking spaces.
Boardmember Parker recommended that islands be placed
right across from the buildings to provide a buffer.

Attorney Shannon, representing the owner, Commented that
the ideas offered had not been considered by the
applicant and that he would like to take all of the ideas
back to the owner for consideration of the overall cost
and practicality. Attorney Shannon stated that the
applicant's position was that 10' wide parking spaces
were the minimum practical; however, perhaps 9'8" would
be possible, and that the fire wall must be considered in
making any changes. Attorney Shannon requested that this
application be continued to the next meeting so that the
applicant could possibly return with a revision to the
plan.
Boardmember Nielson made a motion to table the
application from The Villager Apartments until the next
meeting. Boardmember Dalack seconded the motion. The
vote on the. motion was:

The motion was therefore passed and adopted.
Boardmember Parker recommended that islands within the
north and south parking lots be centered in front of some
of the buildings and contain palms and oak trees, which
would grow to be large. This would break up the parking
lot as well as soften the buildings.
6. An application from Cotleur Hearing, Inc., for rQview of
a revised landscape plan for the McCarthy's Restaurant
portion of the Tequesta Oaks Development, 187 Tequesta
Drive, Tequesta.
Rick Green, employee of the DiVosta organization and
agent for Tequesta Oaks Development, explained that when
the Community Appearance Board had approved the Tequesta
Oaks landscape plan that they had made eight suggestions
for the applicant's consideration. Mr. Green stated that
