Staff Report and Recommendations
Site Plan Review (SPR)
Background:
Robert Shaw submitted application for modified Site Plan Review for an 4,839 sq. ft.
addition to the rear parking area at Plaza 222, 222 U. S. Highway One, Tequesta, Florida.
The applicant proposes to buy the property from the Village of Tequesta once the site plan
is approved. The property is small and parking seems to be inadequate for the needs
required for the building, necessitating the additional parking. The landscaping
requirements also create a hardship for the property due to the size and area required for
parking. The applicant has done an adequate job landscaping at the front of the property
and is requesting landscape waivers for the rear addition in order to maximize the parking
area.
Staff Report and Comments:
Staff has worked closely with Mr. Shaw on this application and recommends that
conditions are placed upon the approval of the site Plan Review such as;
• Replacement of all dead and dying plants on the site.
• The applicant must properly screen the dumpster on his property.
• Double parallel painted lines shall mark the parking spaces.
• The applicant must purchase the land from the Village of Tequesta for the agreed
upon price in order for approval to be valid.
• Permit shall not be issued for the proposed work until after the land purchase deal
is closed.
Staff Recommendation:
Staff recognizes the constraints put upon the property to necessitate the request of the
landscape waivers, but has recommended alternatives to the applicant, which the applicant
has chosen, not to use. The applicant has decided to use the original submittal with no
changes.

approval from the Tequesta Village Council which involves the strip of land you intend to

Dear Mr. Shaw:
Please find enclosed, a copy of Resolution No. 23-97/98,
authorizing the Village of Tequesta•to sell 4,839 square feet, in
the amount of $16,937.00.
The Village Council has authorized this sale to you with all
associated charges and fees to be borne by Shaw Properties, Inc.
Please prepare a purchase contract indicating the purchase, amount
with the stipulation that Shaw Properties, Inc., shall bear all
associated charges and fees relative to the closing of this sale.
Please forward this contract to us for review and .submittal to the
Village Attorney for approval.
As you are aware, any changes to the site pursuant to the
acquisition of the additional property indicated, will require the
proper site plan review, and conformance with all Village of
Tequesta Codes and Ordinances.

RESOLUTION NO. 23-97/98
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, APPROVING THE SALE OF VILLAGE LAND
TO SHAW PROPERTIES, INC. IN THE AMOUNT OF
$16,742.
WHEREAS, Shaw Properties, Inc. previously leased land from
the Village; and
WHEREAS, the Village of Tequesta no longer desires to lease
property to Shaw Properties, Inc.; and
WHEREAS, representatives of Shaw Properties, Inc. requested
to purchase property from the Village of Tequesta; and
WHEREAS, the Village secured the services of Callaway &
Price, Inc. to conduct an appraisal to determine the fair
market value of the land in question, identified as Parcel
No. 2 in the Callaway & Price, Inc. Appraisal Report dated
February 23, 1998; and
WHEREAS, Callaway & Price, Inc. appraised the land in
question to have a market value of $13,600.
NOW, THEREFORE, HE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby ratified and
confirmed.
Section 2. The Village Manager is hereby authorized to sell
the appraised parcel, plus the additional land requested by
Shaw Properties, Inc. totaling 4,839 square feet to Shaw
Properties, Inc. in the amount of $16,937 with all
associated charges and fees to be borne by Shaw Properties,
Inc. and to do all things necessary to close the sale.
THE FOREGOING RESOLUTION WAS OFFERED by Councilmember
Cameron who moved its adoption. The motion was seconded by
Councilmember MackaiT and upon being put to a vote, the
vote was as follows:
