A. .Code Enforcement Special Master Torcivia approved the minutes of the November 19 , 1998 hearing as submitted. B. Fine Imposition Hearings: Case No. 9800000612 Brian G. Wayne 128 Fairview East Tequesta, Florida 33469 Legal Description: TEQUESTA LT 472. (60-42-40-26-01-00-4720) Nature of Violation: Violation of Tequesta Code of Ordinances, Chapter 6, Buildings and Building Regulations, Article V, Housing, Sec. 6-81. Code-Adopted., Sec. 6-82. Same-Amendments, Pages 365, 366. Respondent Brian G. Wayne was present at the hearing and testified that he was working toward completion. Tequesta Code Enforcement Officer Irovando agreed with Respondent's testimony. Conclusion of law was that Respondent Brian G. Wayne is in violation of Chapter 6, Buildings and Building Regulations, Article V, Housing, Sec. 6-81. Code-Adopted., Sec. 6-82. Same Amendments, Pages 365, 366. (101.6 Maintenance; 305.2 Exterior Walls; 305.3 Roofs; 305.14 Protective Treatment; 305.15 Accessory Structures), of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that. Respondent, Brian G. Wayne, shall comply with Chapter 6, Buildings and Building Regulations, Article V, -Housing, Sec. 6-81. Code-Adopted., Sec. 6-82. Same-Amendments, Pages 365, 366. (101.6 Maintenance; 305.2 Exterior Walls; 305.3 Roofs; 305.14 Protective Treatment; 305.15 Accessory Structures), of the Code of Ordinances of the Village of Tequesta, by the 25th day of February, 1999. If Respondent does not comply within the time specified, a fine of up to two hundred fifty dollars ($250.00) per day, five hundred dollars ($500.00) per day for repeat violations, may be assessed for each day the violation continues to exist. If Respondent does not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 25th day of February, 1999, at 10 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Dogs and Cats., Sec. 4-13, Running at Large prohibited, Page No. 259. Respondent Victoria Peaper was present at the hearing and testified to the measures taken to keep her dog in her yard. Tequesta Code Enforcement Officer Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Sec. 4-13, Running at Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta. • Special Master Paulette Torcivia ordered that Respondents, Brian and Victoria Peaper, shall comply with Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Sec. 4-13, Running at Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta, by the 29th day of January, 1999. If Respondents do not comply within the time specified, a fine of fifty dollars per day ($50.00) will be assessed for each day the violation continues to exist. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 25th day of February, 1999, at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Respondent Melissa M. Miller was present at the hearing and testified that the dogs had had throat surgery so that they could not bark. Tequesta Code Enforcement Officer Irovando testified and requested that a violation be found for the past occurrences. Conclusion of law was that Respondents are in violation of Tequesta Code of Ordinances, Chapter 4, Animals and Fowl, Article , IN GENERAL, Sec. 4-7, Animals creating nuisances, Page 257. Special Master Paulette Torcivia ordered that Respondents, Robert M. And Melissa M. Miller, shall comply with Chapter 4, Animals and Fowl, Article , IN GENERAL, Sec. 4-7, Animals creating nuisances, Page 257 of the Code of Ordinances of the Village of Tequesta, by the 29th day of January, 1999. If Respondents do not comply within the time specified, a fine of fifty dollars per day ($50.00) will be assessed for each day the violation continues to exist. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 25th day of February, 1999, at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. O'Brien, shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying To A Specific, To Several Or To All Districts, (L), Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3) Page No. 1185 of the Code of Ordinances of the Village of Tequesta, by the 29th day of January, 1999. If Respondents do not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Dogs and Cats., Sec. 4-13, Running at Large prohibited, Page No. 259. Respondent Shelley Reggio was not present at the hearing; however, there was a finding of proper notice. Tequesta Code Enforcement Officer Irovando testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Sec. 4-13, Running at Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Shelley Reggio, shall comply with Chapter 4, Animals and Fowl, Article I1, Dogs and Cats, Sec. 4-13, Running at Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta, by the 29th day of January, 1999. If Respondent does not comply within the time specified, a fine of fifty dollars per day ($50.00) will be assessed for each day the violation continues to exist. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 25th day of February, 1999, at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Pages No. 1174-1178.8.1. 'Respondents Robert F. Cromwell, et al, were not present at the hearing. Tequesta Code Enforcement Officer Irovando testified that the Respondents have received Community Appearance Board approval and must be approved by the Village Council. Conclusion of law was that Respondents are in violation of Appendix A-Zoning, Section X, Supplemental Regulations Applying To A Specific, To Several Or To All Districts, (H), Landscaping: General Requirements, Pages No. 1174-1178.8.1 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Robert F. Cromwell, et al, shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying To A Specific, To Several Or To All Districts, (H), Landscaping: General Requirements, Pages No. 1174-1178.8.1 of the Code of Ordinances of the Village of Tequesta. A Status Hearing will be held before the Special Master on the 25th day of February, 1999, at 10 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469.
