Ladd, Director of Community Development f~~- DATE: February 16, 1999 SUBJECT: Public Hearing for Special Exception Use Amendment Classic Dreamcars, Inc. 210 Tequesta Drive /Tequesta Plaza Tom, attached are nineteen (19) packets for the above referenced Public Hearing. Please place this item on the agenda of the March 4, 1999, Village Council meeting. An examination of-the special exception criteria by staff indicates the following: ~ The proposed use is a valid use for consideration by the Village Council. ~ The proposed use is designed, located and proposed to be operated so that the public health, safety and welfare will be protected. ~ With the recommended conditions stated below in staff comments, there should be no adverse affect on the value of surrounding properties. ~ The use is substantially compatible with adjacent development and the character of the zoning district where it is to be located (M-U, Mixed Use District). ~ Adequate landscaping and screening are not provided at this time as required by Ordinance 377. ~ Adequate off-street parking and loading is provided in accordance with the code requirement and ingress and egress is provided and causes minimal interterence with traffic on abutting streets. ~ With the conditions as set forth below, the use conforms with all applicable regulations of the M-U Mixed -Use District. Staff Comments: Classic Dreamcars requests permission to amend the conditions of a previously approved Special Exception Hearing that prohibited the outdoor parking and/or display of vehicles even if the vehicles are properly tagged and registered. Mr. Bogard wishes to use his facility for catered parties in order to raise money for a new showroom. The events would require the removal of 5-6 cars from the showroom floor, which would be parked and covered in the rear parking area of Tequesta Plaza. The cars would be outside only during party events. This approval should be subject to the following conditions; 1.) Council limits number of cars allowed to be parked outside, 2.) Limits on how often weekly and/or monthly the cars can be parked outside, 3.) Limits how long the cars can be left outside the building during a scheduled event. 4.) The Council should also require that the-cars be covered while parked outside and have registration and tags. 5.) Mr. Bogard must also comply with the safety requirements set forth in the memo from Chief James Weinand dated February 22, 1999 marked "Exhibit A", which requires; - a.)Assembly Occupancies must have. fire exit hardware on their exit doors therefore; the primary entrance door and exit doors must have this hardwares. to assure the individuals can exit the facility at the location where_they entered thefacility. b.) The exit doors must remain open and unlocked while these facilities are occupied. 6.) Weinand, Fire Chi ~,,.~ Date: February 22, 1999 ~ Subject: Classic Dreamcars' Reque' for Catering Parties .~ After reviewing the above request and reviewing the Code, there is only one area of concern that I have. The original intent of Mr. Bogard's facility ~ was to have an access controlled egress device on the front principal Q, entrance to the store to limit the number of individuals that could enter his facility without his knowledge. We accommodated his request by letting him use the door next to it to be a fire exit door due to the limited number ~ of people that would be in this building at one time. This classification r under that intent is considered to be a storage occupancy. Now, his intent ("~ with letting more than 50 to 100 people gather in this facility would change its classification and requirements to be an Assembly Occupancy. Assembly Occupancies must have fire exit hardware on their exit doors. The primary entrance door must have this hardware to assure that the individuals can exit the facility at the location where they entered the facility. Therefore, in order to accommodate this request, Mr. Bogard must install fire exit hardware on these exit doors, and the exit doors must remain open and unlocked while these facilities are occupied. X seeking relief by civil action through mandatory injunctive relief or other relief available through the courts. (5) Assessment to constitute a lien against the property. The bill referenced above.shall be assessed to the owner of the prop- erty and, if remaining unpaid for a period of sixty (60) days after issuance, the village manager shall cause a lien to be filed against the property, to be recorded in the public records of Palm Beach County. , (6) Performance surety. In the event that the landscaping re- quirements of this ordinance have not been met at the time that a certificate of occupancy, or certificate of use is requested, the village may approve such request provided the village enters into an agreement with the owner or his/her agent that the provisions and requirements of this ordinance will be complied with. The owner or his/her agent shall post a performance bond or other approved surety in an amount equal to one hundred ten (110) percent of the cost of materials and labor and other attendant costs incidental to the installation of the required landscaping. This surety shall run to the Village of Tequesta, and shall be in a form satisfactory and acceptable to the village, specifying the time for the completion of the landscape requirements. It is recognized, however, that there are cer- tain. uses and features which because of their unique chazacteris- tics, cannot be distinctly classified or regulated in a particular district or districts, without consideration in each case, of the ialpact of such uses and features upon neighboring uses and the surrounding -area, compared with the public need for them at particular locations. Such uses and features are therefore treated as special exceptions. A special exception . is not the automatic right of any applicant. (2) Criteria. Special exception uses and their related accessory uses or any expansion, enlargement, or modification of an exist- ing special exception use shall be permitted only upon authoriza- tion of the village.council provided that such uses shall be found by the village council to comply with the following requirements and other applicable requirements as set forth in this ordinance. (a) That the proposed use ie a permitted special exception use. X determine that satisfactory provision and arrangement of the following factors have been met by the petitioner, where applicable. (a) Compliance with all elements of the Village of Tequest~ Comprehensive Plan; (b) Ingress and egress to property and proposed structures thereon with particular reference to automotive and pe- destrian safety and convenience, traffic flow and control, , and access in case of fire or catastrophe, (c) Off street parking and loading area where required with particular attention to the items in (b) above; (d) Refuse and service areas with particular reference to items (b) and (c) above; (e) Nuisance factors detrimental to adjacent and nearby prop- erties and the village as a whole. Nuisance factors shall include but not necessarily be limited to noise, odor, smoke, glare, electrical interference and/or mechanical vibrations; Sec. X APPENDIX A-ZONING Sec. Regulations for the particular use involved. (4) Conditions and safeguards. In addition to the standards listed above and specific conditions listed for each particular special exception listed within any particular zoning district, the village council may impose other such conditions and safeguards as it deems appropriate in conformity with these zoning regula- tions for the protection of the surrounding properties and the neighborhood, or general welfare of the public. (5) Denial. Should the village council deny a special exception, it shall state fully for the record the reasons for doing so. Such reasons shall take into account the factors under subsection (3) above and all other conditions and particular regulations relat- ~ng to the specific special exception requested. (6) Limitations on the filing of a special exception. (a) Whenever village council has denied an application for a special exception, the village shall not thereafter consider any further application for special exception on any part of or all of the same property for a period of twelve (12) months from the date of such action. Weinand, Fire and Chie~ Stephen J. Allison, Police, relating to your request to host catered parties at your ~acility. In order to alleviate sa~ety concerns and approve. this accessory use, the Department o~ Community Development will need floor plans depicting square ~ootage of the ~ood service and reception areas. Highlight how these areas will be arranged to accommodate the events. All exits, emergency lighting and emergency equipment (e. g. {ire extinguishers) must be shown. Please address the concerns of Chief Allison relating to alcoholic consumption outside the premises and sa~ety concerns o~ Chie~ Weinand. Also, outline your procedures for these events including but not limited to security, lochs, and sa~ety exits. The site lighting o~ the parizing area is a public sa~ety concern. Weinand, Fire Chi ~.,.~ Date: February 5, 1999 ~ Subject: Classic Dreamcars Request to Entertain Clientele .~ Pursuant to your memorandum dated February 3, 1999, in regard to Mr. Bogard's written request to cater parties on the premises located in Tequesta Plaza, we would need a set of blueprints denoting how Mr. ~} Bogard would be separating these facilities, if any are anticipated. The Q,~ current N.F.P.A. 101 Life Safety Code classification for this building is a storage occupancy. With this new request to entertain clientele in the 50 to 100 people range, it would change the occupancy classification to Q, assembly. This change in occupancy could initiate several new code requirements concerning the means of egress, locks and exit hardware on the doors, and also possibly requiring some type of fire protection separation from hazards. Until I see specific blueprint or floor plans of what Mr. Bogard's intentions are, I would not be able to give any professional comments as to what would be required for this to occur. If he intends to move forward with this project, a floor plan would be required and additional safeguards may be needed on this premise.
