I. CALL TO ORDER AND ROLL CALL
The Tequesta Local Planning Agency held a scheduled Public
Hearing at the Village Hall, 357 Tequesta Drive, Tequesta,
Florida, on Thursday, August 13, 1992. The meeting was called
to order at 7:00 P.M. by Mayor Earl L. Collings. A roll call
was taken by the Recording Secretary, Fran Bitters.
Councilmembers present were: Mayor Earl L. Collings, Vice-
Mayor Edward C. Howell, William E. Burckart, Ron T. Mackail
and Joseph N. Capretta. Village Officials present were:
• Village Manager Thomas G. Bradford, and Joann Manganiello,
Village Clerk. Department Heads and Village Attorney John C.
Randolph were also in attendance.
II. INVOCATION AND PLEDGE OF ALLEGIANCE
Councilmember William E. Burckart gave the Invocation and led
those in attendance to the Pledge of Allegiance to the
American Flag.
III. PUBLIC HEARING
A) Consideration of Proposed Comprehensive Plan Amendment
(Change of Land Use) Pursuant to Chapter 163,3161, et.
seq., Florida Statutes, and Transmittal to the State of
Florida Department of Community Affairs.
Scott Ladd explained that this is a proposal from Developers,
Edward and Monica Armor, to effectuate a land use change on
a little less than an acre of land located at the corner of
Pine Tree Drive and Tequesta Drive. In order for the
Developer to present their proposed project, it is necessary
• for the Village to do a Comprehensive Plan Amendment, changing
the subject property from residential low density (current R-
1 zoning district allowing from 0-5.5 single family dwelling

units per acre) to residential medium density (allowing for
5.5-12 units per acre). The size of the parcel dictates that
no more than 10 multi-family units could be built at that
location.
Mr. Ladd reminded the Planning Agency that they are not, at
this time, reviewing a Site Plan, but the presentation is
merely for the Planning Agency to review and determine whether
there is merit, in the application, to justify a change in
land use in order to change the density by five dwelling
units. If the land use is changed, a zoning change must
occur, followed by an application before the Community
Appearance Board and a Site Plan Review before the Village
Council for the actual project.
Attorney Randolph advised the Planning Agency that this is
merely the first step in a process where applicant comes
before the Village Council to make a request for the land
• change, and a 1/4 page ad is placed in the newspaper, before
the Public Hearing. The first step that is taken, in the
event the Council decides to move forward, is to send the
proposed land use change to the State for review. Once all
reviewing agencies have reviewed, another advertisement, and
a Final Public Hearing would be necessary.
Jay Sweet, of Sweet & Associates, Inc., 220 Venus Stret,
Jupiter, was in attendance as representative of Developers.
Mr. Sweet explained that the subject property is surrounded
by (i.e., Whitehall Condominiums and Carriage House
Condominiums) more intense land uses than that for which the
Developers are applying. The property immediately to the west
of the proposed location is zoned single family, and a higher
density immediately to the east. A zoning change would allow
the applicant to build two-story, fee-simple townhomes, at a
price range a little over $100,000. Preliminary renderings
have been done showing the concept, with heavy landscaping.

3) Local Planning Agency and Public Comments.
Councilmember Capretta inquired as to the density of Whitehall
and Carriage House. Scott Ladd answered he did not know at
the present moment.
A citizen asked if a traffic study had been done to consider
the impact the new housing would have on that area to
determine whether a traffic light would be required at that
location. Village Manager Bradford answered that area was
looked at in a rough fashion and compared the proposal to what
the traffic generation would be if single family homes were
built there. As far as a traffic light is concerned, those
are provided by Palm Beach County. Mr. Bradford felt the
level of traffic at that location would not warrant a traffic
light, but if it meets the criteria, the County would
entertain placing one there.
A local citizen inquired as to whether the new residences
would be hooked up to sewer, and the answer was affirmative.

4) Local Planning Agency Recommendation to the Village
Council Regarding Resolution No. 26-91/92 and the
Proposed Comprehensive Plan Amendment.
XIV. ADJOURNMENT
Vice Mayor Howell moved that the Public Hearing be adjourned.
Councilmember Capretta seconded the motion. The vote on the
motion was:

Edward C. Howell - for
the motion was therefore passed and adopted and the meeting
was adjourned at 7:15 p.m.

Attorney Randolph reminded the Village Council that, since
they are sitting as a Local Planning Agency, it would be
necessary for that Agency to recommend to the Village Council
whatever action they wished to take in regard to Resolution
No. 26-91/92, and therefore should re-convene the Public
Hearing for that purpose.
The Public Hearing was therefore re-convened.
4j Local Planning Agency Recommendation to the Village
Council Regarding Resolution No. 26-91/92 and the
Proposed Comprehensive Plan Amendment.
Councilmember Mackail moved that the Planning Agency recommend
that the Village Council consider approving Resolution No. 16-
91/92, amending the Village Comprehensive Plan changing the
subject property from residential low density, currently an
R-1 zoning district, to residential medium density.
Councilmember Burckart seconded the motion. The vote on the
motion was:

the motion was therefore passed and adopted.
